1 STAFF REPORT

DATE: November 1, 2022

TO: Justin Hess, City Manager

FROM: Patrick Prescott, Community Development Director Via: Fred Ramirez, Assistant Community Development Director By: Karen Pan, Administrative Officer

SUBJECT: Approval of a Fifth Amendment to Professional Services Agreement with AECOM Technical Services, Inc. for the Golden State Specific Plan

RECOMMENDATION
Approve the Fifth Amendment to Professional Services Agreement (PSA) with AECOM Technical Services, Inc. (Attachment 1) for preparation of the Golden State Specific Plan.

BACKGROUND
The City entered into a PSA with AECOM Technical Services Inc. on August 10, 2016 to help the City develop the Golden State Specific Plan and conduct the associated environmental review (Attachment 2). The original cost of service was $1,189,000.

A First and Second Amendment were made to this PSA on August 23, 2018, and March 1, 2020, respectively, to extend the term of the agreement. Subsequently, a Third Amendment was made on May 1, 2020, to extend the term to December 31, 2021 and increase the project budget by $31,000 for a total of $1,220,000. A Fourth Amendment was made on September 28, 2021, to increase the project budget by $111,000, to $1,331,000. A Fifth Amendment to the PSA is now being requested to extend the term of the PSA to December 31, 2023 and to further supplement the project budget, to account for additional work necessary for completion of the specific plan document and the associated environmental analysis. This Fifth Amendment would increase the project budget by $130,000 for a total of $1,461,000.

COMMUNITY

DEVELOPMENT
2 DISCUSSION
Staff is requesting that the City Council approve a Fifth Amendment to the PSA with AECOM Technical Services, Inc. to extend the term of the PSA to December 31, 2023 and to increase the project budget by $130,000. The additional time and funds would be used to complete the following tasks:

• Additional project management services. Originally initiated in 2016, the project has taken longer than anticipated due to limited staffing resources and unexpected but necessary coordination with other concurrent long- range planning efforts being undertaken by the City , which include the recently completed Hosing Element Update, the Downtown Transit Oriented Specific Plan, the Media District Specific Plan as well as coordination with other departments to coordinate further studies to ensure sufficient infrastructure is in place to support future development that is envisioned with these planning efforts . Supplemental funds are necessary to continue having AECOM Technical Services, Inc. manage the project to its completion.
• Additional funds to account for cost increases in technical services since commencement of the project. The cost of technical services has increased across several tasks.
• Additional funds to undertake additional transportation analysis and modeling. • Additional funds to forecast utility capacity (i.e., sewer and power) necessary for the envisioned build-out.

FISCAL IMPACT
There is no fiscal impact to the General Fund for the Golden State Specific Plan. There are funds available in the current Fiscal Year 2022-2023 Budget for $130,000 in account number 001.CD31A.62085.0000.22489 (General Fund, Community Development – Planning Division, Other Professional Services, Golden State Specific Plan).

CONCLUSION
Staff recommends City Council to approve the Fifth Amendment to PSA with AECOM Technical Services, Inc. for the preparation of the Golden State Specific Plan. Approval of the amendment will ensure long-range planning projects are on track for completion at the end of 2023. Approving all amendments is also consistent with the Burbank2035 General Plan Land Use and goals and programs of the recently adopted 2021- 2029 Housing Element as well as the Realization Plan Program LU -3 that provides for the update for the City’s existing specific plans as well as a creation of the Golden State Specific Plan.
