RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK APPROVING AND ADOPTING CONTRACT
DOCUMENTS, PLANS AND SPECIFICATIONS, AND
DETERMINING THE LOWEST RESPONSIVE AND
RESPONSIBLE BIDDER, ACCEPTING THE BID, AND
AUTHORIZING EXECUTION OF A CONTRACT FOR BID
SCHEDULE NO. 1 508 – PROVIDENCIA SEWER
IMPROVEMENT PROJECT, PHASE 2 TO CREATIVE HOME/
DBA: CHI CONSTRUCTION.

HE COUNCIL OF THE CITY OF BURBANK FINDS:
A. P
ursuant to notice provided according to law, bids for Bid Schedule No. 1508, the Providencia Sewer Improvement Project, Phase 2 (the “Project”) have been received, publicly opened, declared, and evaluated.
B. T
he City Manager reports that the lowest responsive and responsible bid for the Project was received from Creative Home/DBA: CHI Construction, that the bid is as set forth below, and recommends that the bid be accepted.
C. The Plans and Specification s for the Providencia Sewer Improvement Project, Phase 2, Bid Schedule No. 1508, are on file at the Public Works Department and the City Council Office. The Plans and Specifications for the Providencia Sewer Improvement Project, Phase 2, Bid Schedule No. 1508 (hereafter “Plans and Specifications”) along with a staff report and other supporting documentation, have been provided for City Council’s review and approval.

HE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. T
he Contract Documents consisting of all the documents within Bid Schedule No. 1508, including but not limited to the Notice Inviting Bids, Instructions to Bidders, Bidder's Proposal, Bidder's Performance and Payment Bonds, Agreement, City of Burbank Additions and Amendments to the Standard Specifications for Public Works Construction, Special Provisions, Plans and Specifications, and Appendices for Bid Schedule No. 1508, the Providencia Sewer Improvement Project, Phase 2, all of which Contract Documents are on file in the Public Works Department and City Council Office, are approved and adopted as the Contract Documents, Bid Schedule No. 1508 with such non-substantive changes as may be approved by the City Attorney. Reference is made to these Contract Documents for further particulars.

he lowest responsive and responsible bidder for the Providencia Sewer Improvement Project, Phase 2 in accordance with Bid Schedule No. 1508 is Creative Home/DBA: CHI Construction, whose address is 701 E. Ball Rd. #101, Anaheim, California, 92805 and whose total lump sum price of $2,452,692.50 is set forth in the Attachment 1
2 Bidder's Proposal included in the Contract Documents, on file in the Purchasing Division. This bid is accepted, and the City Manager or his designee is authorized to reject all other bids once the lowest responsive and responsible bidder has executed and forwarded all the necessary Contract Documents to the City.
3. T
he City Council has considered the Plans and Specifications for the Providencia Sewer Improvement Project, Phase 2, Bid Schedule No. 1508, and approves the Plans and Specifications. The Public Works Director, or his designee, is authorized to approve any changes to the Plans and Specifications.
4. C
ity Council exercises its independent judgment and finds that this Project is categorically exempt from the California Environmental Quality Act (CEQA), pursuant to the following sections of the CEQA Guidelines: Section 15282(k), because this project involves new sewer pipeline and the maintenance, repair, restoration, removal, or demolition of an existing sewer pipeline that is less than one mile in length; 15303(d), because this project involves replacing existing sewer pipelines to serve existing construction; and 15304(f), because any excavation will be restored after installation of the sewer pipelines.
5. T
he total construction budget for Bid Schedule No. 1508 shall be $2,820,596.00, which includes a 15% construction contingency in the amount of $367,903.50.
6. T
he City Manager or his designee is authorized to execute all necessary Contract Documents under Bid Schedule No. 1508 and future change orders (if any) up to the amount budgeted for the Project with such non-substantive changes as may be approved by the City Attorney and the City Clerk is authorized to attest.
