STAFF REPORT
CITY OF BURBANk
PUBLIC
WORKS
DATE: November 15, 2022
TO: Justin Hess, City Manager
FROM: Ken Berkman, Public Works Director KB
VIA: Stephen Walker, Assistant Public Works Director - Wastewater Systems BY: Seiko Oishi, Senior Civil Engineer
SUBJECT: Adoption of a Resolution Approving Contract Documents and Awarding a Construction Contract to Creative Home/DBA: CHI Construction for the Providencia Sewer Improvement Project, Phase 2

RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK APPROVING

AND ADOPTING CONTRACT DOCUMENTS, PLANS AND SPECIFICATIONS, AND

DETERMINING THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER,

ACCEPTING THE BID, AND AUTHORIZING EXECUTION OF A CONTRACT FOR BID SCHEDULE NO. 1508 - PROVIDENCIA SEWER IMPROVEMENT PROJECT, PHASE 2 TO CREATIVE HOME/DBA: CHI CONSTRUCTION. (ATTACHMENT 1).

BACKGROUND
The City of Burbank (City) operates and maintains its own wastewater system, which is comprised of approximately 230 miles of sewer pipelines, the Beachwood Pump Station, the Mariposa Pump Station and the Burbank Water Reclamation Plant (BWRP). To ensure compliance with the Statewide General Waste Discharge Requirements for Sanitary Sewer Systems, the City is responsible for not only maintaining, but also replacing or upgrading components of the City's wastewater system when necessary.

Potential sewer capacity deficiencies have been identified and prioritized in the Sewer System Evaluation and Capacity Assurance Plan (Master Plan) and are subsequently included as potential projects in the long-term Capital Improvement Program for the wastewater system. One of the identified projects is the Providencia Sewer Improvement Project, Phase 2 (Project).

This Project is necessary due to existing sewer capacity deficiencies along Providencia Avenue from Bonnywood Place to Varney Street, along Varney Street from Providencia

Avenue to the alley north of Providencia, and along the alley north of Providencia from Varney to east of the Burbank West Channel (see Attachment 2). The scope of work includes approximately 1,500 linear feet of sewer pipeline replacement/installation along with new manholes, lateral connections, and associated pavement restoration.

DISCUSSION
Bid Schedule No. 1508 was advertised on October 12, 2022 and October 19, 2022. A bid opening was held on November 8, 2022. Five (5) contractors submitted bids ranging from $2,452,692.50 to $3,679,556.25 (see Attachment 3). Creative Home/DBA: CHI Construction of Anaheim, California, submitted the lowest responsive and responsible bid of $2,452,692.50. All bids included a set allowance of $500,000, as specified in Addendum No. 2 of the Contract Documents; the allowance may need to be utilized at the discretion of the City if the primary method of bypass (an abandoned 12-inch sewer) is found to be infeasible, to temporarily bypass or permanently divert the sewage around the construction work area. The lowest bid of $2,452,692.50 exceeds the estimated cost of $2.3M, which is the combined total of the Engineer's Estimate of approximately $1.8M and the $500,000 bid allowance. Creative Home/DBA: CHI Construction has not done any work for the City over the last twenty years. Public Works staff has verified the references provided in their bid submittal.

If approved by Council, construction is slated for December 2022 through March 2023.

As with all Public Works bid schedules affecting the public right-of-way, the contractor is required to coordinate with potentially affected local businesses, schools, and residents, and must provide notification in writing to them at least five working days in advance of the start of construction in each specific area.

Award of this contract and construction of the Project helps accomplish City Council's goals of City Services, Infrastructure, and Quality of Life.

Project plans and specifications are available for review at the Public Works Department located at 150 N. Third Street, Burbank, California and the City Council Office located in the Burbank City Hall, 275 E. Olive, Burbank, California.

ENVIRONMENTAL REVIEW
Staff conducted an initial environmental review and recommends City Council find that this proposed project is categorically exempt from review under the California Environmental Quality Act (CEQA) pursuant to the following sections of the CEQA Guidelines: Section 15282(k), because this project involves new sewer pipeline and the maintenance, repair, restoration, removal, or demolition of an existing sewer pipeline that is less than one mile in length; 15303(d), because this project involves replacing existing sewer pipelines to serve existing construction; and 15304(f), because any excavation will be restored after installation of the sewer pipelines.

FISCAL IMPACT
The projected construction cost for this project (construction bid plus 15% contingency) is $2,820,596.00. Sufficient funds are available in the following project accounts:
