SUBJECT: Adoption of a Resolution Approving Contract Documents and Awarding a Construction Contract to Toro Enterprises Inc. for the 2021 Annual Arterial Pavement Rehabilitation Project on San Fernando Boulevard, Victory Boulevard, and Burbank Fire Training Center Parking Lot
RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK APPROVING
AND ADOPTING CONTRACT DOCUMENTS, PLANS AND SPECIFICATIONS, AND
DETERMINING THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER,
ACCEPTING THE BID, AND AUTHORIZING EXECUTION OF A CONTRACT FOR BID SCHEDULE NO. 1506 – 2021 ARTERIAL PAVEMENT REHABILITATION PROJECT, TO TORO ENTERPRISES, INC. (Attachment 1).
BACKGROUND
As part of the City’s Capital Improvement Program, the City’s arterial roadways are analyzed and rehabilitated on an annual basis. The typical scope of work includes resurfacing the roadways, signing and striping, removal and reconstruction of damaged curbs, gutters, sidewalks, and substandard pedestrian ramps , as well as City -owned parking lots (where practical). The 2021 Arterial Pavement Rehabilitation Project (Project) will rehabilitate segments of Victory and San Fernando Boulevards, and the Fire Department Training Center Parking Lot (see shaded segments in Attachment 2).
DISCUSSION
The Project was advertised for construction bids on August 31, 2022, and September 7, 2022. A bid opening was held on September 27, 202 2. While an Alternative Bid was requested for signing and striping, the basis for contract award was the Base Bid. Three (3) contractors submitted bids ranging from $3,383,127.75 to $3,990,000.00 (Attachment 3). Toro Enterprises, Inc. of Oxnard, California (Toro), submitted the lowest responsive PUBLIC
WORKS
and responsible base bid of $3,383,127.75, including an alternate bid of $141,612.46 (Attachment 4), for a total bid of $3,524,740.21, which is within the engineer’s estimate of approximately $3.6M.
The City reserves the right to add or remove any of the bid alternates at the time of award or by contract change order during construction. Plan No. 5126, which is part of the Bid Schedule (BS) No. 1506, shows the specific striping and signing for the streets affected by B S No. 1506, and approval by the Council of this plan will help the City establish design immunity.
Toro has previously performed similar work for the City with satisfactory results. The contractor possesses a valid state contractor’s license and is in good standing with the Contractors State License Board. The bid was reviewed for accuracy and conformance to the contract documents and found to be complete.
If approved by Council, construction is scheduled to start in February and expected to end in April 2023. As with all Public Works projects affecting the public right-of-way, the contractor is required to coordinate with potentially affected local businesses, schools, and residents, and must provide notification in writing to them at least five working days in advance of the start of construction in each specific area.
This project will use Asphalt Rubber Hot Mix (ARHM), which is a special blend of asphalt that uses crumb rubber from recycled tires. Given the approximate two (2) miles of paving slated for this project, approximately 28,000 discarded tires will be diverted from landfills.
Award of this contract and the ultimate construction of the Project helps accomplish City Council’s goals of City Services, Infrastructure, and Quality of Life.
ENVIRONMENTAL REVIEW
Staff has reviewed this project and recommends the City Council find this project Categorically Exempt under the California Environmental Quality Act (CEQA) and CEQA Guidelines Section 15301(c), which exempts the operation, repair, maintenance, or minor alteration of existing facilities such as highways and streets, where there is negligible or no expansion of the existing use. Awarding this contract will result in activity involving repair and maintenance of existing streets, and such activity is covered under the Section 15301(c) exemption.
