Status:

The application for the Fifth Amendment to the Planned Development Zone was filed on June 27, 2016. In 2022, the project request was withdrawn by the landowner, however, the City continues to work with property ownership on possible future land uses to be considered in alignment with the proposed Downtown Burbank Transit Oriented Development Specific Plan Project. City staff continues to engage with the current ownership entities, ( which as of March 2023, includes the Onni Group - a Toronto-based investor and developer with expertise in the construction of office space and mixed-use developments) on the future redevelopment of the properties.

The site is developed with a multiple family residential development consisting of 255 units in seven three-story buildings and one three-story office building totaling 30,000 square feet. Parking is provided in three two-story subterranean garages beneath the commercial and residential buildings. The Project Site has two zoning designations, PD 88-2 and 99-1, that are part of a single Development Agreement for the Project Site. Construction of this project is co mplete, and the project has complied with all conditions of approval.

On February 5, 2019, the City Council approved an ordinance amending the DA allowing a request to allow (1) 51 parking spaces previously allocated for residential use to be used exclusively by tenants of the 30,000- square-foot office building, (2) removing the language that allows commercial parking to be used by residential tenants after hours and on weekends, and (3) a change in the maximum square footage and height allowed for the commercial office building to 30,000 square feet and three stories, excluding parking levels. The PD 88- 2 and 99- 1 zoning designations, boundaries, and acreage remained unchanged for the subject properties comprising the Project Site.

Status:

The project is a large office complex in a campus setting, and many tenants are media companies. To date, 622,553 adjusted gross square feet have been constructed. In 2013, the Council approved a five- year extension of the DA to May 10, 2018. In addition to the five-year extension, 73,000 adjusted gross square feet were added to the entitlement (for a new grand total of 783,000 square feet of development) to allow for the construction of a 160,447- square-foot office building. Two subsequent amendments for time extensions have been approved, the F ourth Amendment extended the expiration date from May 10, 2018 to January 31, 2019, and the F ifth Amendment from January 31, 2019 to May 10, 2028.

Mitigation Monitoring:

The project meets all conditions of approval for the DA’s constructed square footage.

Construction of the remaining 160,447 square feet requires additional intersection improvements to be constructed at Hollywood Way / Thornton Ave. and Hollywood Way / Winona Ave. However, these improvements are currently under construction by the Avion Development project, which also contributes additional traffic to the area that is mitigated by the two intersection improvements

Status:

The City Council approved the 18- year extension to the DA on August 16, 2016, extending the term of the DA to November 2035. The PD appr oved construction of 1,932,528 Office Equivalent Gross Square F eet (OE -GSF) of unique studio development, including sound stage and related production facilities, production support facilities, media office buildings, employee center and other facilities to be constructed over a 25-year period. OE-GSF is a calculation used in the Media District to limit development based on traffic impacts. To date, Disney has developed approximately 65% (approximately 1,251,398 OE-GSF) of their total entitlement . All conditions of approval required for the current construction have been met. Disney did not undertake any development projects in 2022 that triggered mitigation measures related to demolition or new construction activities on the Studio Lot. Disney continued to comply with all mitigation measures related to the ongoing operation of the Studio Lot.

Mitigation Monitoring:

The traffic improvements required to- date (i.e., mitigation measures) have been installed and completed on Buena Vista Street, Alameda Avenue, and Riverside Drive.

The traffic mitigation measures were updated with the DA extension (via Supplemental EIR), and the new mitigation measure for the intersection of Olive Avenue/Buena Vista Street will be implemented when total square- footage reaches 1,550,000 OE -GSF.

Disney continued to comply with all mitigation measures related to the ongoing operation of the Studio Lot.

The PD was approved in 1995, and development has occurred slowly but steadily since. To date, Warner Bros. has develo ped approximately 8.9 % of their entitled Master Plan for the Main Lot. With the existing development to date, the Main Lot has constructed approximately 188,491 net new Office Equivalent Gross Square Feet (OE-GSF) of the 2,123,000 net new OE-GSF (2,664,714 gross square feet) that was entitled. OE-GSF is a calculation used in the Media District to limit development based on traffic impacts. The most recent developments were Stage 29 within Subarea 3, completed in Q3 of 2018 and the Tour Center and Parking Structure, completed in Q1 of 2020. An appli cation was received in 2021 for a proposed 15,620 square feet employee Child Care Center for 132 children on the main studio lot as well as a permit ATTACHMENT 1-6

for new perimeter fencing. The proposed Child Care Center was approved in 2022 and is currently under construction, which is anticipated to be completed in 2023.

Mitigation Monitoring:

All conditions of approval required for the construction to date have been met , including near-term traffic improvements (mitigation measures) such as signal control systems improvements. Additional long-term traffic improvements will be implemented when future construction reaches square-footage thresholds specified in the DA.

In 2011, the DA was extended an additional 15 years until 2030. Since then, several buildings have been constructed. The new campus will contain approximately 337,164 net new OE -GSF.

When built, Warner Bros. will develop approximately 45% (or 337,164 OE-GSF) of the 749,00 OE-GSF that was entitled.

Mitigation Monitoring:

The applicant has conducted a project condition compliance review. City s taff is working with the Worthe Real Estate Group (property owner) and Krismar Construction (contractor) to ensure compliance with all mitigation measures applicable with the proposed redevelopment of the project site, including traffic mitigation measures addressed as part of the proposed development.

Status:

Originally approved in 1997, PD 96- 01 approved the Burbank Studios Master Plan (also known as, “the former NBC Studios Property”). When approved the City also approved a 20- year Development Agreement that provided the property owner the right to develop a total of 1,825,865 Office- Equivalent Gross Square Feet (OE -GSF) on the property by 2017. OE-GSF is a calculation used in the Media District to limit development based on traffic impacts. The term of this Development Agreement was extended by the City Council in 2013, to March 19, 2024.

Following the approval of PD 96- 01, The Pointe Burbank was constructed in 2006/2007 – an approximately 480,000-square-foot (329,000 OE-GSF) office building at 2900 West Alameda Avenue. Also, more recently in 2020 Worthe Real Estate Group began work on building two new iconic Frank Gehry Buildings on the Burbank Studios Lot that contain an approximate office floor area of 800,000 square feet (566,046 OE-GSF). It is expected that these new buildings – as well as the rest of the Burbank Studios Lot – will be fully occupied by Warner Brothers once construction is completed in June 2023.

Two Frank Gehry-designed Buildings, also known as “Second Century Project,” are currently under construction. When complete, the Burbank Studios Master Plan will have 617,983 OE-GSF of vested development potential remaining. This development potential is vested through the term of the Development Agreement (2024).

Mitigation Monitoring:

PD 96-01 is complying with all conditions of approval, including the construction of traffic improvements that are required as certain OE -GSF thresholds are met. This includes signal improvements at the Buena Vista / Riverside / SR -134 Ramps intersection, pos sible intersection improvements at the intersection of Barham and Forest Lawn Drive, and site access improvements at Bob Hope Drive and Parkside Avenue. Additionally, the property owner and City staff will work collaboratively with City of Los Angeles, NBC Universal, and Caltrans in confirming that mitigation measures resulting from PD 96-01 that are within their jurisdictions are completed.

Status:

On August 1, 2016, the City Council adopted an ordinance approving a Development Agreement (and related PD Amendments) for a 14- gate replacement terminal, other airport buildings and facilities, and related improvements. On November 8, 2016, Burbank residents approved Measure B (with 70% of the vote) to allow a new 14-gate, 355,000-square-foot replacement terminal to be built with up to 6,637 parking spaces.

The Authority began the Replacement Terminal Design Process by holding a total of nine public design charrette workshops between March 27, 2019, and October 26, 2019. A total of five design charrette work shops were held in Burbank and one each was held in the cities of Glendale, Pasadena, and Los Angeles. Furthermore, the Authority conducted a procurement and later released a request for proposals for the selection of a consultant firm that would provide project management and associated services for the replacement terminal project which include setting up the program control processes, supporting the Authority in soliciting progressive design- builder firms, and helping define the selection process by which the best value design-builder firm will be selected. In 2019, the Authority selected the firm of AECOM Technical Services, Inc. (AECOM) to provide program management and associated services for the replacement terminal project.

In March 2020, the Airpo rt Authority (Authority) suspended planning and implementation of all discretionary projects, including the replacement terminal, due to the COVID-19 Pandemic. As of September 2021, the Authority had authorized the restart of the replacement terminal proj ect by re -engaging AECOM Technical Services, Inc. consulting firm (AECOM) to manage the project and continue work on development of the Program Development Manual and preparation of a Request for Qualification in order to begin the selection of a progressi ve design builder for the project. On April 27, 2022 the Authority Commission voted to have Jacobs Project Management Co. (Jacobs) assume the program management services for the replacement terminal project.

In early 2022, the Authority initiated a two-step procurement process for the project to solicit for a design -builder to provide planning, design, construction, and commissioning services. The first step included a Request for Qualification (RFQ) being posted on May 20, 2022. The Authority received five statements of qualifications and subsequently selected a shortlist of three progressive-design build teams that was later approved by the Authority Commission. The three teams were invited to respond ATTACHMENT 1-9

to a Request for Proposals that was issued in July 202 2. On December 19, 2022 the Authority Commission awarded a design- build agreement to the Holder, Pankow, TEC, Joint Venture (HPTJV) to provide design- build services for the replacement terminal project. A notice to proceed was subsequently issued to HPTJV the same day for Phase 1 (Preliminary State) of the project which involves construction specifications up to 60% completion and construction planning services.

On October 3, 2022 the Authority Commission designated the Adjacent Property as the site of th e replacement passenger terminal and approved a Covenant and Environmental Restriction on Property (Land Use Covenant) for the Benefit of the Los Angeles Regional Water Quality Control Board (LARWQCB). The Land Use Covenant memorializes development and use restrictions imposed on the Adjacent Property by the LARWQCB. The Memorandum of Adjacent Property Replacement Passenger Terminal Selection was recorded with the County Registrar -Recorder on October 6, 2022 and the Land Use Covenant was recorded with the C ounty Registrar-Recorder on December 5, 2022.

In November 2022, Jacobs began the process of meeting with various City departments and divisions to discuss various City requirements as they began to work with the design-build team to formalize a project schedule. The project applicant and staff met on March 7 to discuss timelines for plan check submittal.

Mitigation Monitoring:

The Authority received LA County approval in 2018 of the Human Health Risk Assessment (HRRA) and conditional Federal Aviation Administration ( FAA) approval on the Airport Layout Plan (ALP) in 2020.

In 2018 t he Authority began work on the Environmental Impact Statement (EIS) required under the National Environmental Protection Act (NEPA) and a Notice of Intent was released in December 2018. A 30- day public scoping period was held in early 2019 with two scoping meetings being held for the Agency and public to solicit input on the EIS. The Draft EIS was released for a 67-day public review and comment period starting on August 21, 2020 and ending on October 27, 2020. During the public review and comment period, two virtual public workshops were held where the FAA provided a presentation about the project, the alternatives, and an overview of the impacts; and one public hearing was held to allow the public to provide oral comments.

In May 2021, the FAA issued a Final EIS and Record of Decision (ROD) for the proposed construction and operation of the 14-gate replacement passenger terminal.

As noted above, the Authority has selected both a project manager and design- build team for the project. City staff continues to monitor the project and compliance with the Mitigation Monitoring and Reporting Program (MMRP) that was approved as part of the DA and Final EIR.

PD 2001- 02 (Bob Hope Office Center Development) and the associated DA was approved in 2001 to allow construction of an office building of 103,500 square feet and a performing arts theater or museum of 20,000 square feet. On May 14, 2019, the City Council approved an extension for PD 2001-2 (“Bob Hope Center Development Project”) through December 31, 2020. Just prior to the December 2020 expiration, the applicant indicated continued interest in pursuing the Project. To avoid expiration of the DA on December 31, 2020 and to allow staff to complete the Project EI R, the Applicant requested an extension pursuant to Section 7.03 in Article 7 of the DA pertaining to Enforced Delay and Extension of Time Performance. Upon reviewing the request, the Community Development Director approved a 4-month extension of the DA for PD 2001- 2 through April 30, 2021. Because the long-term extension still requires completion of an EIR, staff recommended a 12-month extension of the DA to April 30, 2022, to provide the necessary time to complete the pending EIR process. On March 2, 2021, the City Council approved another extension through April 30, 2022.

The extension is no longer valid as it expired on April 30, 2022. The Project which included entitlements for a 109,470 adjusted gross square foot office building on 61,301.5 square feet (1.4 acres) of vacant land within the Media District did not move for ward. Since the date of expiration, the PD has reverted to the Media District Commercial (MDC-2) Zone.

On June 24, 2022, Worthe Real Estate Group (applicant) submitted an SB 35 Notice of Intent (NOI) application to redevelop the subject property as a proposed mixed -use project of 144 new rental units with 1,058 square feet of ground floor commercial and a publicly accessible Bob Hope Park. Proposed parking would be provided at subterranean level consisting of 196 spaces.

The project is currently in the NOI application review stage. Once the SB 35 NOI application process is considered complete, the applicant may submit for a SB 35 streamlined ministerial approval process application review in accordance with Burbank Municipal Code Section 10-1-19302 (Streamlined Ministerial Approval Process).

DENIED OR WITHDRAWN:
