Happy Friday Mayor Anthony, Vice Mayor Schultz, Councilmembers Mullins, Perez, & Takahashi:
First of all, thank you for taking the time to listen to your constituents.
I was able to watch the council meeting
yesterday, curious to hear the responses from council.
Thank
you Vice-Mayor Schultz for expressing at the beginning of the discussion the concerns of our residents, expressed most eloquently during the comment period by Melissa Webster. We may not be able to stop a school shooting - however, if we don't do everything in our power to protect our residents, young and old, the blood will still be on our hands. And we'll wonder why we kept kicking the can down the road when we could start by taking steps like liability insurance, like inspections, additional buy-back dates.
The moratorium should remain in
place and I'm pretty sure I can count on this council to do that. We have more than enough gun stores/ammunition retailers in our city to service LA county. More than enough, that was an oversight on us as residents who weren't paying attention as each store opened - now we are and personally I'm disgusted and embarrassed I wasn't paying attention. I understand we have an overworked city attorney staff - that's the job they've signed up for. It will always be busy, they will always be
overworked.
That's not an excuse. Making this firearm
regulation a high priority keeps the focus on action not just words.
This isn't an us vs them issue, it's not about taking
anyone's guns - it's about making sure we have done our due diligence to keep our community and our residents, keeping those who work here, who visit here, as safe as we possibly can. And then, if a mass-shooting tragedy happens, and I sincerely hope it is an if and not a when, we'll know in our hearts that we did our absolute best to avoid that incident.
Laws are on the books, we know that, we also know almost every gun purchased by a mass shooter was purchased legally. So we can't rely on only those laws.
I was encouraged by the responses of Ms. Perez, Ms. Mullins, and Ms. Takahashi that you were also pushing for action to be taken sooner rather than later and I look forward to hearing
what steps Mr. Thomas (and his binder) will bring to the forefront, steps that hopefully include actions.
Thank you once again for your time and focus on this issue.
Have a wonderful weekend!

Things don't get done without
the government intervening. Countries without guns have lower crime rates and people feel safer. If our country can't get their act together, maybe Burbank can, and be an example for other communities. There are so many other ways to protect our citizens, and getting proactive about an approach that eliminates the potential of death by gun violence is worth pursuing.
I could share extensive strategies on how to proceed, however, the solution begins when we stop perpetuating fear in our communities.

June 6, 2023 City Council Office 275 East Olive Avenue Burbank, CA 91502 Sent via email Re: Support for Ordinance Strengthening Regulation of Gun Dealers Dear Members of the City Council, On behalf of Giffords Law Center to Prevent Gun Violence (“Giffords Law Center”), I write to express our support for the proposed ordinance creating new licensing and security requirements for firearms and ammunition retail businesses. We also encourage the city to adopt regulations that zone firearms dealers safe distances from sensitive uses such as schools and residential neighborhoods, places of worship, and public parks. Now led by former Congresswoman and gun violence survivor, Gabby Giffords, Giffords Law Center has been providing legal and technical assistance in support of gun violence prevention to federal, state, and local legislators nationwide for 30 years. Expanded oversight of gun dealers via a comprehensive licensing system is necessary to ensure that sellers of lethal weapons comply with the law and do not jeopardize public safety. Currently, Burbank Municipal Code allows the city to require firearm retailers to apply for a license but does not provide clear regulations governing the application process. This ordinance would enact explicit licensing requirements, provide for routine law enforcement inspection, and outline mandatory security practices thereby providing necessary oversight of local gun and ammunition sellers. Local oversight of gun dealers is necessary because the federal Bureau of Alcohol, Tobacco, Firearms & Explosives (ATF) does not have the resources to properly oversee the 134,000 federally licensed gun dealers in the U.S. The California Department of Justice is similarly restrained in its ability to police the more than 1,700 gun dealers currently operating in California. Dealer licensing ordinances of this type have been upheld as constitutional and are already in effect in at least 105 California communities.i Inventory reporting requirements and mandatory inspections will provide law enforcement with more opportunities to detect illegal gun activity. ATF has found that dealers and pawnbrokers were associated with the largest number of trafficked guns and concluded that “[Federally licensed gun dealers’] access to large numbers of firearms makes them a particular threat to public safety when they fail to comply with the law.”ii Requiring gun dealers to periodically report their inventory will help deter
2 giffordslawcenter.org
dealers from altering their inventory to cover up illegal transactions. At least eleven California jurisdictions currently require dealers to periodically report their inventory to local officials or law enforcement. And at least five require law enforcement to inspect dealers for compliance with local, state, and federal laws. Videotaping sales helps prevent gun-related crimes and aids law enforcement in solving these crimes. In 2022, California became the second state following Illinois to require licensed gun dealers to maintain a video surveillance system.iii California’s law goes into effect on January 1, 2024 and will require all licensed gun dealers to install and maintain a fixed video surveillance system on their business premises to continuously record for 24 hours per day and record areas including interior views of all entries or exists, all areas where firearms are displayed, and all points of sale sufficient to identify the parties involved in the transaction. The proposed ordinance would be consistent with the video surveillance requirements mandated by 2022 CA SB 1384. Video recordings will provide valuable evidence to law enforcement officers who are enforcing gun laws and prosecuting gun crimes. Video surveillance will also likely prevent crimes at the store itself, such as straw purchases (when a legal buyer purchases a firearm or ammunition on behalf of a person who is prohibited from doing so), burglaries and robberies. Though straw purchases are a leading source of crime guns, they often appear legal on paper without security cameras to visibly capture the sale. Burbank’s ordinance will likely become effective before state law goes into effect thus providing local law enforcement with valuable investigation tools as soon as possible. The ordinance will also allow the police chief discretion to determine the appropriate numbers and locations of cameras to suit the safety needs of each business. The proposed ordinance also allows Burbank to join dozens of others California jurisdictions in: 1. Requiring dealers to maintain liability insurance, thereby ensuring businesses can afford to pay out for any injuries or deaths resulting from their negligent or reckless conduct. 2. Restricting admittance of minors and other prohibited purchasers thus ensuring that parents have the freedom to decide whether to expose their children to firearms; and 3. Requiring posted warnings on the dangers of firearm using, thereby helping to ensure purchasers know the risks of gun ownership and relevant laws. The requirements of the proposed changes are constitutional and legally defensible. Courts have held that local dealer ordinances are not preempted by state lawiv nor do they violate the Second Amendment to the United States Constitution.v California law authorizes local governments to require gun dealers to obtain a local permit to operatevi and impose security requirements on firearms dealers that are stricter than those mandated by state law. Notably, the United States Supreme Court stated in
3 giffordslawcenter.org
District of Columbia v. Heller, that the commercial sale of firearms was a presumptively valid area of regulation.vii In the Court’s 2022 opinion, NYSRPA v. Bruen, the Court reaffirmed Heller and the proposition that regulations on the commercial sale of firearms are presumptively lawful.viii
The proposed ordinance enacts commonsense measures already employed by responsible dealers.
Accordingly, we urge you to support the proposed gun dealer regulation.ix Sincerely,
Allison Anderman

Good afternoon City Council members,
I just wanted to give my emphatic support for the "Introduction of an Ordinance to Amend Title 3 (Businesses and Licenses), Chapter 4 (Business and Occupations) to Establish Administrative Business License Requirements for Firearms and Ammunition Businesses." The amount of gun stores in Burbank is too high and affects our retail diversity. I believe it also acts as a hindrance to new development. Nearly all of the areas around Burbank, including North Hollywood, Studio City, and Glendale, all have nicer retail businesses than Burbank. I believe the high amount of gun retailers on major thoroughfares in Burbank acts as a deterrence to new businesses from investing in our community.
We have the second highest number of gun stores per capita of any city in the United States(!) Our by-right laws allowing gun stores to open anywhere without scrutiny led to the opening of Gun World less than a thousand feet from an elementary school, which should absolutely be criminal. I encourage you to act to limit this outdated by-right process for gun store ownership and consider the desires of your constituents, who overwhelmingly do not support more gun stores and want to see change.
I love living in Burbank, but the high concentration of gun stores makes me feel unsafe and, more importantly, makes me fear for my son's safety.
So I urge you to approve the proposed ordinance and encourage city staff to keep working on changes to the by-right zoning laws that are currently in place. As a Burbank resident and as a parent, my message is simple: protect kids, not guns. The Second Amendment contains the word "well-regulated" and that is what enacting these ordinances will do for Burbank.
Thank you for listening to the community and your efforts to get this passed.

Dear Mayor Anthony,
I am a Burbank resident and voter, so I wanted to reach out a week after the horrifying school shooting in Nashville. It is truly terrifying to keep hearing stories like this over and over, especially as a mom of a preschooler.
With so many gun stores here in Burbank - and some relatively near schools - I was surprised to learn that the city does not conduct its own inspections (in addition to the federal and state inspections, as other
cities like Los Angeles do) or prohibit unaccompanied minors from entering gun stores. While there is a lot happening at the state level to promote safety in regards to gun sales and access, it seems that these would be straightforward steps to take specifically here in Burbank to further protect our families and friends.
I urge you and your colleagues on City Council to push for changes like these designed to keep our community as safe as possible.

Dear Mayor, Vice Mayor, and City Council Members:
I am writing to
express my strong support for the proposed amendment to establish Administrative Business License Requirements for Firearms and Ammunitions Businesses.
The number and location of the gun stores we have in our community is a detriment to community safety, business development, and our community and children's mental health.
This amendment is also an important step in Burbank's future economic diversity and quality of life for residents.
I also urge you to keep working on necessary zoning changes to prevent gun and ammunition retailers from being in proximity to sensitive use locations. My son just finished Kindergarten at Roosevelt Elementary, less than 1000 feet away from Gun World. Gun World's inappropriately large building signage, neon "GUNS" sign, and window advertisements for weapons manufacturers are a blight on our neighborhood and a constant, stressful reminder of the epidemic of gun violence in our country. It is out of character with the rest of our neighborhood, in what is supposed to be a 1000 ft. CA Gun-Free School Zone. I also feel uncomfortable walking in the vicinity of the store. I adjust my daily walking route to avoid it, an indication that gun
stores are suppressing the foot traffic for neighboring businesses. Its presence so close to my child's school has a detrimental impact on my family, our neighbors, and mostly importantly, our students.
I appreciate the City Council and Staff's continued
work on this important issue. I urge you to
continue listening to the overwhelming constituent feedback in favor of continued regulations.
Unfortunately, I will be unable to attend Tuesday's meeting in person, but I look forward to seeing the result of The City Council and Staff's action on this issue.
Sincerely,
