SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS
AND CITY OF BURBANK
FOR MEDIA DISTRICT SPECIFIC PLAN UPDATE
(SCAG Project/OWP No. 300-4887V9.01)
This Amendment No. 01 (“Amendment”) to the Memorandum of Understanding (“MOU” or “Agreement” herein) is entered by and between the SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS (herein referred to as “SCAG”), and the CITY OF BURBANK (“CITY”), for Media District Specific Plan Update, subsequently herein referred to as “Project.” SCAG and CITY are individually referred to herein as “Party” and may be collectively referred to herein as “Parties.”
RECITALS
WHEREAS, SCAG and the Sub -Recipient are parties to that certain Agreement dated February 15, 2022;
WHEREAS, Section 6 of the Agreement permits the parties to amend the Agreement through written amendment;
WHEREAS, California Senate Bill 197 amended the expenditure deadline for the Local Government Planning Support Grants Program and requires each recipient of funds under the Local Government Planning Support Grants Program to expend the funds no later than December 31, 2024; and WHEREAS, the purpose of this Amendment No. 01 is to modify the responsibilities of the parties, to extend the period of performance from June 30, 2023 to December 31, 2023, to extend the term of this Agreement from June 30, 2023, to December 31, 2023, and designate a new SCAG Project Manager.
NOW THEREFORE, IT IS MUTUALLY AGREED THAT:
1. Section 2.B1 (Responsibilities of the Parties) is amended as follows:
SCAG will:
Contribute a maximum, not to exceed Five Hundred Four Thousand Six Hundred Nine Dollars ($504,609 in REAP funds) towards the total value of the Project to be used solely for the SCP Plan.

2. Section 2.C1 (Responsibilities of the Parties) is amended as follows:
CITY will:
Contribute One Hundred Forty-Nine Thousand Nine Hundred Forty-One Dollars ($149,941 in LEAP Funds) towards the total value of the Project to be used solely for the LEAP Plan portion of the Project.
3. Section 3 (Term) is amended to read as follows:
The Term of this Agreement shall begin on the Effective Date of the Agreement and continue until December 31, 2023, hereinafter referred to as the “Completion Date,” unless terminated earlier as provided herein. Time is of the essence in the performance of services under this MOU.
4. Section 4.A1 (Program Management) is amended to read as follows:
For purposes of this MOU, SCAG designates the following individual as its Project Manager:

Parties reserve the right to change this designation upon written notice to the other Party.
In all other respects, the terms and conditions of the Agreement shall remain in full force and effect.
