AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BURBANK AMENDING BURBANK MUNICIPAL CODE
SECTION 2-1-426, TO CHANGE THE TOTAL MEMBERSHIP
OF THE INFRASTRUCTURE OVERSIGHT BOARD FROM
SEVEN MEMBERS TO FIVE MEMBERS
City Attorney’s Synopsis
This ordinance a mends Burbank Municipal Code Section 2-1-4 26 by reducing the members of the Infrastructure Oversight Board from seven to five.
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. In November 2018, Burbank voters passed Measure P - Burbank Infrastructure and Community Services Protection Transactions and Use Tax, a local sales tax ordinance (Sales Tax Ordinance). Under the Sales Tax Ordinance, Burbank Municipal Code (BMC) Section 2-4-2114 required City Council to establish a new board to oversee the Measure P funds.
B. BMC Section 2 -1-426 was adopted to establish this new board – the Infrastructure Oversight Board (IOB). Section 2 -1.426.B.1.a currently provides for seven members to be appointed to the IOB.
C. Due to difficulties related to recruitment and managing a seven-member board, the City desires to reduce the number of IOB members from seven to five.
D. Consistent with Section 2 -4-2114.D, the purpose of this ordinance is to effectuate those amendments and will result in decreasing the number of members on the IOB from seven to five.
THE COUNCIL OF THE CITY OF BURBANK DOES ORDAIN AS FOLLOWS:
1. BMC Section 2-1-426.B.1.a is amended as follows:
“B. Composition of the Board:
1. The Infrastructure Oversight Board shall be composed of the following members:
a. Five (5) members to be appointed by Council.”
2. BMC Section 2-1-426.E is amended as follows:
