Funds Transfer Agreement Between the California Department of Transportation and the City of Burbank

1.1 The California Department of Transportation (Caltrans) and the City of Burbank (City) hereby enter into this Funds Transfer Agreement (Agreement) on the terms and conditions set forth below.

1.2 This Agreement is not valid until signed by both parties. This Agreement shall expire on City’s completion of its obligations under this Agreement, but may be extended by amending this Agreement.

BACKGROUND

2.1 Section 19.56, subdivision (g) (1) (AV) of the Budget Act of 2022 (the Act) appropriated $3,000,000 (the Funds) from the State General Fund to Caltrans, to be allocated to the City for Active Transportation Infrastructure.

2.2 Caltrans determined the best method for allocation to ensure the funds are used for the purposes specified in Section 19.56 of the Act is a funds transfer agreement.

2.3 The Funds are intended to support the following Active Transportation Infrastructure Needs and Goals:

The City is constructing the San Fernando Bikeway Project along an unused portion of the Metro/Metrolink Antelope Valley rail line, which consists of a three- mile Class I bike path located primarily within Metro railroad right of way along San Fernando Boulevard, Victory Place, Lake Street, and the Burbank Western Flood Control Channel near the Downtown Metrolink Station. The San Fernando Bikeway will be constructed as a separate Class I bicycle path for much of the project length with only minimal street crossings. When complete the bikeway will help extend the County's network of regional Class I bike paths and connect directly to the Downtown Burbank Metrolink Station. This project will augment the bikeway project by enhancing the railroad right of way adjacent to the project. The Funds will support remediation of right of way along the San Fernando Bikeway Project that were damaged by past construction projects, and help fund additional landscaping between the bikeway and the active rail line.

SCOPE OF WORK

3.1 The Funds provided under this Agreement will be used to support the City’s San Fernando Bikeway Project along the Metropolitan Transportation Project ID PLBP-5200(052)
