1 STAFF REPORT

DATE: July 18, 2023

TO: Justin Hess, City Manager

FROM: Michael Albanese, Chief of Police
BY: Courtney Padgett, Police Administrator

SUBJECT: Approval of a Jail Food Services Agreement Between the City of Burbank and the County of Los Angeles to Provide Meals for Detainees

RECOMMENDATION
Approve a Food Services Agreement by and between the County of Los Angeles and the City of Burbank to provide meals for detainees in the jail facility.

BACKGROUND
The Burbank Police Department (Department) operates a 70- bed Type 1 jail facility. A Type 1 facility, as defined by the California Code of Regulations (CCR), is used for the detention of persons for a period of not more than 96 hours (excluding holidays) after booking. The jail provides a facility to conduct the intake and short-term detention of pre- arraigned inmates. The Department processes approximately 3,500 inmates annually through the jail facility.

DISCUSSION
CCR Title 15 – Crime Prevention and Corrections defines minimum standards for the operation of local detention facilities. Standards require that Type 1 facilities provide food service for detainees three times in any 24-hour period. Standards further define dietary, menu variety, and food preparation requirements. Since 2012, the City has worked with the Los Angeles County Sheriff’s Department, Food Services Unit (FSU) for the provision of meals for detainees in the jail facility. Meals are prepared, packaged, and delivered by the FSU to the Department jail facility where the meals are stored appropriately and provided to detainees. T he FSU works with 27 regional police departments to provide food services for local detainees, in addition to providing food services for the Sheriff’s Office patrol station jail facilities located throughout the County. The FSU prepares food

POLICE DEPARTMENT
2 in accordance with government regulations and meals comply with all standards set forth in the California Health and Safety Code.

The County has provided satisfactory service to the City throughout the duration of its provision of food services for the jail facility. The County offers a broad selection of menu choices and provides frequent and timely food deliveries. The Council approved the most recent agreement in 2018, which expired on June 30, 2023. The proposed new five-year agreement will cover the period from July 1, 2023, to June 30, 2028.

ENVIRONMENTAL REVIEW
Approval of the food services agreement has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and as such, is not a “project” subject to the requirements of the California Environmental Quality Act (CEQA) 14 Cal. Code Regs § 15378.

FISCAL IMPACT
The Department serves an average of 9,000 meals each year. The cost under the proposed agreement is $3.20 per meal for Fiscal Year 2023-24, with an estimated annual cost of $28,800. There is sufficient funding in the Department’s approved Fiscal Year 2023-24 budget to cover the cost for food services under the proposed agreement.

CONCLUSION
The Department operates a safe and secure jail facility that provides quality in- custody services to enhance the safety of the community. The jail maintains compliance with all applicable federal, state, and County standards, to include those related to the provision of food services. The FSU has provided satisfactory service to the City for over 10 years.
