1 STAFF REPORT

DATE: July 18, 2023

TO: Honorable Mayor and Members of the City Council

FROM: Kimberley Clark, City Clerk
BY: Melissa Dekermenji, CMC, Records Manager

SUBJECT: Introduction of an Ordinance Amending Burbank Municipal Code Section 2- 1-426, to Change the Total Membership of the Infrastructure Oversight Board from Seven Members to Five Members

RECOMMENDATION
Introduce AN ORDINANCE OF THE COUNCIL OF THE CITY OF BURBANK AMENDING BURBANK MUNICIPAL CODE SECTION 2 -1-426 TO CHANGE THE

TOTAL MEMBERSHIP OF THE INFRASTRUCTURE OVERSIGHT BOARD FROM SEVEN MEMBERS TO FIVE MEMBERS.

BACKGROUND
In November 2018, Burbank voters passed Measure P - Burbank Infrastructure and Community Services Protection Transactions and Use Tax, a local sales tax ordinance.

Under the Sales Tax Ordinance, Burbank Municipal Code (BMC) Section 2-4- 2114 provides for oversight and required Council to establish a new board. On April 16, 2019, the Council adopted Ordinance No. 19-3,914, adding the Infrastructure Oversight Board (IOB) to Burbank Municipal Code Section 2-1-426.

The IOB oversees and makes recommendations to the Council regarding the infrastructure of the City (not part of an enterprise fund). The mission of this Board, in part, is to ensure the reliability, maintenance, and safety of the City’s infrastructure. Some oversight parameters inc lude safety, funding, planning, construction, (i.e. , high level review of scope, schedule, cost, and risk of infrastructure projects), operations, maintenance (reviewing the adequacy of existing maintenance programs), and implementation of best practices related to infrastructure. The Board also makes recommendations on traffic programs.

CITY CLERK’S
OFFICE
2 DISCUSSION
The City Clerk’s Office has advertised/appointed 76 members to the City’s various Boards and Commissions between the months of July 2022 and July 2023 and has experienced an extensive challenge in recruit ing applicants for the openings. Recruitment efforts include advertising through the following:
• The City website
• City Council meeting announcements
• All social media platforms overseen by the City Clerk’s Office • Press releases sent to The LA Times, Burbank Leader, and MyBurbank.com • Notices posted on the City Hall Bulletin Board
• Community Groups and Organizations

Despite the extensive recruitment efforts, the City Clerk’s Office is faced with a minimal number of applications for most of its Boards and Commissions openings throughout the year. The number of applications received for IOB has been low during every recruitment and staff aims to mitigate the impact to the IOB before it becomes a problem, such as not having enough applicants to fill the vacancies and the Board not having a quorum to hold its meetings. To address these ongoing recruitment challenges with the City’s Boards, Commissions, and Committees, staff recommends Council formally change the structure of the membership of IOB with zero impact to the IOB’s mission.

Due to the advisory functions of the IOB, staff recommends Council consider introducing an Ordinance (Attachment 1) to formally implement the member composition changes , as stated in BMC Section 2-1-426, subsection B(1)(a) to reduce the membership from seven (7) to five (5) members and Section E to reduce the number of voting members constituting a quorum from four (4) to three (3).

Please note that the remainder of the IOB section of the BMC remains the same.

ENVIRONMENTAL REVIEW
This activity has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment and, as such, is not a “project” subject to the requirements of the California Environmental Quality Act (CEQA) 14 Cal. Code Regs § 15378.

FISCAL IMPACT
There is no fiscal impact for this item.

3 CONCLUSION
Staff is seeking Council’s consideration to introduce an Ordinance to change the member composition of the IOB.

If Council agrees with staff’s recommendation, this will change the number of vacancy appointments needed for the IOB presented on July 18 , 20 23. In stead of five (5) appointments (comprised of four (4) full four-year terms and one (1) unexpired term) that evening, Council will only need to make three (3) appointments.

If Council does not proceed with staff’s recommendation, Council will appoint five (5) members of the seven (7) total this evening to fill four (4) full four-year terms and one (1) unexpired term.
