SUBJECT: Approval to Excuse Absences of Sustainable Burbank Commissioner
RECOMMENDATION
Excuse the absences of Sustainable Burbank Commissioner Kevin O’Brien.
BACKGROUND
Section 2-1-403 of the Burbank Municipal Code (BMC) requires that a Member who fails to attend at least seventy five percent (75%) of the regularly scheduled meetings during a twelve (12) month period be reviewed by the Board, Commission, or Committee on which they serve , and a recommendation made to the Council to either excuse the absences, remove the Member, or take any other appropriate action deemed necessary by the Council.
DISCUSSION
Commissioner Kevin O’Brien was originally appointed to the Sustainable Burbank Commission by the Council on July 11, 2017, and was reappointed on July 13, 2021, to serve a term that is set to expire on July 31, 2025 . According to the Board attendance report, Commissioner O’Brien has missed four regularly scheduled meetings, July and October 2022 and March and April 2023, bringing his attendance rate below the 75% threshold due to unforeseen personal and family emergencies.
At the Commission Meeting on June 26, 2023, the Commission reviewed the absences of Commissioner O’Brien and are recommending that the Council excuse the absences, as stated in the recommendation letter from Chair Robin Gemmill ( Attachment 1). The Commission agrees that Commissioner O’Brien ’s exemplary service is of value to the mission of the Commission.

This activity has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment and, as such, is not a “project” subject to the requirements of the California Environmental Quality Act (CEQA) 14 Cal. Code Regs § 15378.
FISCAL IMPACT
There is no fiscal impact for this item.
CONCLUSION
The Commission is aware of Commissioner O’Brien ’s absences and the reasons for them. They recommend the absences be excused as h is continued participation on the Commission is of value. The absences are outlined in the Chair’s letter (Attachment 1).
