RESOLUTION NO. _______________
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK AUTHORIZING THE MOVE TO STAGE II FROM
STAGE III OF THE SUSTAINABLE WATER USE
ORDINANCE
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. Burbank Municipal Code (“BMC”) Section 8-2-301 and following sets forth the City’s Sustainable Water Use Ordinance.
B. BMC Section 8-2-304 provides the sustainable water use stages that sets forth water use restrictions within the City. Currently, the City is on a Stage III water use restriction level.
C. BMC Section 8-2-305 provides that the City Council, may adopt a resolution to implement the appropriate sustainable water use stages contained in BMC section 8- 2-304 if such stage is supported by the findings.
D. On July 25, 2023, the City Council received an update on the City’s existing water conditions and to considered whether to move to another sustainable use stage.
E. At the meeting, the City Council made the following findings:
1. Due to recent wet years, the State Water Project’s (SWP) allocation is at 100%;
2. There is enough water stored to account for the additional day of watering;
3. There is sufficient groundwater balance to account for the additional day of watering;
4. The Lower Division States (which includes California) of the Colorado River Basin have committed to conserve an additional 3 million acre- feet of Colorado River water by the end of calendar year 2026 to address ongoing severe drought conditions and a changing climate in the Colorado River Basin;
5. Water waste predominantly occurs through automated irrigation – either too long, wrong days, or overspray, and Stage II only allows hand watering without restrictions.
F. Based upon the staff report, public testimony, and other evidence presented before the City Council, the City Council finds that the Stage II practices set forth in BMC Section 8-2-304 (B) are appropriate based upon current conditions.

G. The City Council exercises its independent judgment and finds that adoption of this resolution is categorically exempt under State CEQA Guidelines Section 15308 as an action under regulatory process es and procedures for protection of the environment related to water conservation, and that no unusual circumstances under Section 15300.2 apply to pr eclude the use of this exemption. Therefore, no additional environmental review is necessary.
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. That the City implement t he sustainable water use practices set forth in Stage II of BMC Section 8- 2-304 on August 1, 2023, until changed by action of the City Council.
2. That staff is directed to file a notice of exemption (NOE) with the California State Clearinghouse, as permitted under CEQA Guidelines Sections 15061 and 15062, that reflects the finding above that this action is exempt from CEQA.
3. The City Clerk shall certify to the passage and adoption of this Resolution.
PASSED AND ADOPTED this _____ day of July, 2023.
