A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BURBANK AUTHORIZING THE CITY MANAGER TO
EXECUTE AN OFFER TO PURCHASE EASEMENT
INTEREST IN A PROPERTY AND A CERTIFICATE OF
ACCEPTANCE AND CONSENT TO RECORDATION FOR
AN EASEMENT DEED WITH LOS ANGELES COUNTY
FLOOD CONTROL DISTRICT FOR THE BURBANK
WATER AND POWER CAMPUS STORMWATER
IMPROVEMENT PROJECT
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. The Burbank Water and Power (BWP) campus is an industrial site with stormwater discharges to the Burbank Western Channel (BWC) subject to the National Pollutant Discharge Elimination System General Permit No. CAS00001 issued under the Federal Water Pollution Control Act. In order to address stormwater compliance issues, BWP is in t he process of implementing a stormwater improvement project (the “Project”).
B. As part of this project, an offsite city -owned stormwater line will be rerouted to discharge directly to the BWC . The rerouting of this stormwater line will prevent offsite stormwater from mixing with BWP’s campus stormwater system.
C. A portion of the land where the new stormwater line will be installed is owned by the Los Angeles County Flood Control District (LACFCD). In order to install the new stormwater line on this land, BWP must obtain a utility easement with LACFCD.
D. The Community Development Department (CDD) worked with BWP to obtain an appraisal of the value of the offsite easement area, and, based on this appraisal value submitted an offer to purchase the subject easement. LACFCD accepted this offer and provided an easement deed for execution and recordation.
E. The cost of this easement is $36,053 and funds have been budgeted as part of the project budget.
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. Council approves the delegation of authority to the City Manager to execute an offer to purchase property and a certificate of acceptance and consent to recordation for an easement deed with Los Angeles County Flood Control District for the Burbank Water and Power campus stormwater improvement project.

2. The City Clerk shall be the custodian of all documents and records which constitute the record of proceedings for the Project, and such documents and records shall be maintained in the office of the City Clerk at 275 East Olive Avenue, in Burbank, California.
