B. Pursuant to notice provided according to law , bids for Bid Schedule No. 1454, the Glenoaks Boulevard Arterial and First Street Signal Improvements Project [Metro MR310.46] (“Project”) have been received, publicly opened, declared, and evaluated.

C. The City Manager reports that the lowest responsive and responsible bid for the P roject was received from International Line Builders Inc., that the bid is as set forth below, and recommends that the bid be accepted.

D. The Plans and Specifications for the Glenoaks Boulevard Arterial and First Street Signal Improvements Project [Metro MR310.46] , Bid Schedule No. 14 54, are on file at the Public Works Department and the City Council Office . ( “Plans and Specifications”.) The City Council has considered these Plans and Specifications, as well as any evidence presented at the city council meeting.

THE COUNCIL OF THE CITY OF BURBANK RESOLVES:

1. The Contract Documents consisting of all the documents within Bid Schedule No. 1454, including but not limited to the Notice Inviting Bids, Instructions to Bidders, Bidder's Proposal, Bidder's Performance and Payment Bonds, Agreement, City of Burbank Additions and Amendments to the Standard Specifications for Public Works Construction, Special Provisions, Plans and Speci fications, and Appendices for Bid Schedule No. 14 54, the Glenoaks Boulevard Arterial and First Street Signal Improvements Project [Metro MR310.46], all of which Contract Documents are on file in the Public Works Department and City Council Office, are approved and adopted as the Contract Documents, Bid Schedule No. 1454 with such non-substantive changes as may be approved by the City Attorney. 2 2. The lowest responsive and responsible bidder for the Project is International Line Builders Inc. , whose address is 3955 Temescal Canyon Road, Corona , California 92883, and whose total lump sum price of $4,266,250.00 is set forth in the Bidder's Proposal included in the Contract Documents, on file in the Purchasing Division. This bid is accepted, and the City Manager or his designee is authorized to reject all other bids once the lowest responsive and responsible bidder has executed and forwarded all the necessary Contract Documents to the City.

3. The Public Works Director, or their designee, is authorized to approve any changes to the Plans and Specifications.

4. The City Council exercises its independent judgment and finds that t his Project is categorically exempt pursuant to Section 15301( c) of the State CEQA Guidelines. Section 15301( c) exempts activities involving the operation, repair, maintenance, and minor alteration of existing public facilities, including existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities , that involve negligible or no expansion of existing or former use. This project qualifies for this exemption because it updates existing traffic signals, streets, and similar facilities to current state codes and standards and alterations to accommodate bicycle and pedestrian uses that do not create additional automobile lanes, and additional traffic safety devices that do not change the existing use of the facilitie s. In addition, there are no exceptions or unique circumstances that apply that would affect the application of this exemption. Accordingly, no further environment review is necessary and City staff is directed to file a notice of exemption (NOE) with the California State Clearinghouse, as permitted under CEQA Guidelines Sections 15061 and 15062, that reflects the finding above that this action is exempt from CEQA.

5. The total construction budget for Bid Schedule No. 1454 shall be $4,906,187.50, which includes a construction cost of $4,266,250.00 for Bid Schedule No. 1454 and a 15 percent project construction contingency in the amount of $639,937.50.

6. The City's Fiscal Year (FY) 2023/2024 Annual Budget is amended by appropriating $800,000 from Development Impact Fee account no. 127.CD000.30011 (Public Improvements, Transportation) to expenditure account no.127.CD33A.70002.0000.22690 (Public Improvements, Transport ation, Public Improvements, Glenoaks Boulevard Arterial and First Street Signal Improvements Project). The City Manager or his designee is authorized to make such revisions to the FY 202 3/24 Adopted Budget, and other budget documents as deemed necessary or prudent to implement the approvals as set forth in this resolution.

23-29,455

3 7. The City Manager or their designee is further authorized to execute all necessary Contract Documents under Bid Schedule No. 1 454 and future change orders (if any) up to the amount budgeted for the Project with such non-substantive changes as may be approved by the City Attorney and the City Clerk is authorized to attest.
