STAFF REPORT

DATE: August 22, 2023

TO: Justin Hess, City Manager

FROM: Ken Berkman, Public Works Director
VIA: Daniel Rynn, Chief Assistant Public Works Director – City Engineer BY: Artin Megerdichian, Principal Civil Engineer

SUBJECT: Adoption of a Resolution Approving Contract Documents and Related Striping Plan, and Awarding a Construction Contract for the Resurfacing of Local/Residential Streets in the Neighborhoods bounded by Amherst Dr, San Fernando Blvd, and Alameda Ave, to All American Asphalt; Finding of CEQA Exemption (14 CCR §15301)

RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK APPROVING

CONTRACT DOCUMENTS, PLANS AND SPECIFICATIONS, AND AUTHORIZING EXECUTION OF A CONTRACT FOR BID SCHEDULE NO. 1509 - LOCAL/RESIDENTIAL STREET IMPROVEMENT PROJECT (PHASE II OF CYCLE 2 ), TO ALL AMERICAN ASPHALT, AND APPROVING SIGNING AND STRIPING PLAN NO. 5129 (Attachment 1).

BACKGROUND
This project is the second phase of the second cycle of the Citywide Annual Local/Residential Street Rehabilitation Program. This phase will improve roadways rated “poor” or “very poor” (Pavement Condition Indexes of 55 or lower) in the hillside neighborhoods bounded by Amherst Dr, San Fernando Blvd, and the City limit at Alameda Ave, in zones 5 through 8 (see Attachment 2).

The work also includes minor removal and reconstruction of damaged or substandard curbs, gutters, sidewalks, driveways, and pedestrian ramps.

DISCUSSION
Bid Schedule No. 1509 was advertised on May 24 and May 31, 2023. A bid opening was held on June 20, 2023. Four contractors submit ted bids ranging from $6,968,305 to $9,100,000 (see Attachment 3). All American Asphalt of Corona, California, submitted

the lowest responsive and responsible bid of $6,968,305, which is over the engineer’s estimate of approximately $5M. The higher-than-anticipated bids that were received from all bidders are reflective of the inflationary effects on labor and materials and are also due to the unforeseen price increases of the two main items of work, milling and asphalt. The higher prices of these two items are due to the recent trucking cost increases and shortage of truck s and truck drivers in the industry which can create challenges in transporting materials to and from the project site.

If approved by Council, construction is planned to start in September 2023 and expected to end in February 2024. As with all Public Works bid schedules affecting the public right- of-way, the contractor is required to coordinate with potentially affected local businesses, schools, and residents, and must provide them notification in writing at least five working days in advance of the start of construction in each specific area.

Once the construction is finished, signing and striping work will be performed on those streets by a different contractor. The City currently contracts with Sterndahl Enterprises to stripe and sign throughout the City on an as-needed basis. Plan No. 5129 shows the specific striping and signing for the streets affected by Bid Schedule No. 1 509, and approval by the Council of this plan will help the City establish design immunity.

This project will use Asphalt Rubber Hot Mix (ARHM), which is a special blend of asphalt that uses crumb rubber from recycled tires . Given the 14 miles of paving slated for this project, approximately 75,000 discarded tires will be diverted from landfills.

ENVIRONMENTAL REVIEW
Staff recommends that the Council find that adoption of this resolution is categorically exempt under the California Environmental Quality Act (CEQA) and CEQA Guidelines Section 15301(c), which exempts the operation, repair, maintenance, and minor alteration of existing public structures, facilities, that involve negligible or no expansion of existing or former use. Here, the activity is repaving and maintenance of existing streets so they can continue to be used for public right of way purposes, and there are no exceptions or unique circumstances that apply that would affect the application of this exemption.

FISCAL IMPACT
The projected construction cost for this project (construction bid plus 10% contingency) is $7,665,136. Sufficient funds are available in the following project accounts:

• 534.PW21A.70002.0000.24543 (Measure P, Street Design & Construction Improvements – BS 1509 Street Improvement Phase II of Cycle 2) • 108.PW21A.70002.0000.24543 (Measure M, Street Design & Construction Improvements – BS 1509 Street Improvement Phase II of Cycle 2) • 123.PW21A.70002.0000.24543 (SB-1, Street Design & Construction Improvements – BS 1509 Street Improvement Phase II of Cycle 2) • 370.PW21A.70002.0000.24543 (General City Capital Improvements , Street Design & Construction Improvements – BS 1509 Street Improvement Phase II of Cycle 2)
