SUBJECT: Adoption of a Resolution Amend ing the Citywide Objective Development Standards, Chapter 1: Complete Streets Objective Development Standards to Make Corrections to the Bicycle Parking and Equestrian Standards Sections

RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK AMENDING CHAPTER 1 (COMPLETE STREETS OBJECTIVE DEVELOPMENT STANDARDS) OF

THE CITYWIDE OBJECTIVE DESIGN AND DEVELOPMENT STANDARDS, AND DECLARING CATEGORICAL EXEMPTION UNDER CEQA (Attachment 1).

BACKGROUND
On June 27, 2023, the Council adopted the first chapter of the City’s Objective Design and Development Standards which established the Complete Streets Objective Development Standards (CSODS). When adopting CSODS, the Council directed staff to review and update Section 4.1 “Bicycle Parking Standards” to specify a different standard bicycle rack. Additionally, staff identified two typographical errors (during the presentation to Council) in Section 5, “Equestrian Improvements”. The proposed Amendment updates both sections.

DISCUSSION
Proposed Amendments to the CSODS
In accordance with the Council’s direction, staff reviewed CSODS Section 4, “Bicyclist Improvements – Requirements of Complete Our Streets Plan: Chapter 7” and made the following changes to the Bicycle Parking Standards:

COMMUNITY

DEVELOPMENT
2 1. Removed “Bike-Bike Rack” and related standards from the list of preferred rack designs for short-term bicycle parking. The remaining preferred design for short - term bicycle parking is the “Inverted “U” Rack.”

2. I ncluded additional spacing and placement standards for Inverted U Racks placed in the public right -of-way to facilitate placement that maximizes the number of bicycles that can park at an Inverted U Rack.

In addition, staff is also proposing to correct the typographical errors identified in Section 5 “Equestrian Improvements – Requirements of Complete Streets Plan: Chapter 10, ” which were identified during the June 27, 2023, Council meeting and consist of the following changes:

1. Correct the third bullet point under Section 5.1 to clarify that the required fencing between equestrian trails and sidewalks shall be constructed so as to “not” limit a horse’s peripheral vision and sense of security.

2. R emove the last sentence in Section 5.3 to correct an inconsistency in the requirements for equestrian crossings.

All proposed modifications are shown as redline corrections in Attachment 1, Exhibit A.

ENVIRONMENTAL ASSESSMENT
The proposed Resolution has no potential in resulting in either a direct or a reasonably foreseeable indirect physical change in the environment since these changes are related to the not-to-exceed amount and/or terms for professional consultant services. As such, it is not a “project” subject to the requirements of the California Environmental Quality Act (CEQA) 14 Cal. Code Regs §15378.

FISCAL IMPACT
There is no fiscal impact to adopting the proposed Resolution amending the Citywide Objective Design and Development Standards. The proposed amendments would make minor corrections to standards previously adopted by the Council.

CONCLUSION
The adoption of CSODS set a framework for staff and applicants to work together to build a safe, beautiful, and thriving community through the City’s O bjective Design and Development Standards that can be applied to housing development projects, including projects subject to State mandated streamlined ministerial review processes, that currently do not fully implement the City’s General Plan Mobility Element complete streets goals and policies. Adoption of the proposed Resolution clarifies the Bicycle Parking and Equestrian sections as directed by the Council when CSODS was adopted.
