RESOLUTION NO. ____________

A RESOLUTION OF THE COUNCIL OF THE CITY OF

BURBANK AUTHORIZING AN AGREEMENT WITH
STERNDAHL ENTERPRISES, INC. TO PROVIDE AS-

NEEDED ROADWAY SIGNING AND STRIPING

SERVICES FOR MOTORIST, BICYCLIST AND

PEDESTRIAN SAFETY

THE COUNCIL OF THE CITY OF BURBANK FINDS:

A. The City’s Public Works Department is responsible for installation and maintenance of all the City pavement markings and signs that regulate traffic and parking within the public right-of-way.

B. Sterndahl Enterprises, Inc. has been the City’s striping contractor that provides such maintenance services for several years. Their services were provided under a previously approved agreement that incorporated competitively bid services provided to other public agencies, including the City of Los Angeles. However, it appears that the City of Los Angeles have not renewed their existing agreement with the contractor , and this results in a need for the City to have its own agreement.

C. To avoid disruption and to continue using the contractor for services without going through a lengthy competitive solicitation process, the City Council may have to authorize and approve a new agreement with the contractor.

D. Under the Charter (section 1205) and the Burbank Municipal Code (section 2- 2- 116), the City Council may approve contracts greater than $200,000 and waive the requirement for competitive bidding by a resolution finding that doing so provides the City the best value and is in the best interest of the City.

E. Based upon the staff report and the evidence provided to the City Council, the City Council finds approval of a one-year agreement (Agreement) to be the best value and in the best interest of the City, due to the contractor’s competitive pricing and the City’s need for immediate work to maintain public facilities in a safe and orderly condition. T he City Council desires to approve and authorize the City Manager and the Public Works Director to finalize, award, and execute the Agreement with Sterndahl Enterprises, Inc.

F. The work subject to the Agreement is related to the operation, repair, maintenance, or minor alterations of existing public facilit ies, and no exceptions to categorical exemptions appear to apply. As street maintenance projects that d o not expand any existing use of the public facilities, such activity is categorically exempt under the California Environmental Quality Act (CEQA) Guidelines. (14 CCR §§ 15300.2; 15301.)

THE COUNCIL OF THE CITY OF BURBANK RESOLVES:

1. That approval of this Agreement provides the best value and is in the best interest of the City.

2. That the City Manager or the Public Works Director may: (a) finalize, award, and execute the Agreement with Sterndahl Enterprises, Inc ., subject to approval from the City Attorney’s Office; and (b) award and execute any ancillary documents and amendments as may be approved by the City Attorney’s Office , but only to the extent the applicable funds are available and budgeted.

3. That the Public Works Director, or their designee, is authorized to review and in their discretion, to approve the project plans and specifications if necessary for this project.

4. That the City Clerk be the custodian of all documents and records which constitute the record of proceedings for the p roject, and such documents and records shall be maintained in the office of the City Clerk at 275 East Olive Avenue, in Burbank California.

5. That City staff is directed to file a notice of exemption (NOE) with the California State Clearinghouse, as permitted under CEQA Guidelines Sections 15061 and 15062, that reflects the finding above that this action is exempt from CEQA.
