AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BURBANK ADDING A NEW ARTICLE 3 TO TITLE 2 OF THE
BURBANK MUNICIPAL CODE TO CHANGE THE CITY’S

ELECTORAL SYSTEM FROM AT -LARGE TO BY- DISTRICT

WHEREAS, the five members of the Burbank City Council (“City Council”) are currently elected in at -large elections, in which each City Council member is elected by all registered voters of the entire City; and

WHEREAS, California Elections Code section 14027 et seq, the California Voting Rights Act of 2001 (“CVRA”) prohibits the implementation of an at-large electoral system that impairs the ability of a protected class to elect candidates of its choice or its ability to influence the outcome of an election, as a result of the dilution or the abridgment of the rights of voters who are members of a protected class; and

WHEREAS, Section 800 of the City Charter requires, “Except as otherwise provided by this Charter or ordinance, all municipal elections shall be held in accordance with the election laws of the State of California”; and

WHEREAS, California Government Code section 34886 authorizes the city council to adopt an ordinance changing to a by-district system of electing c ity council members without the need to submit such an ordinance to voters for approval to further the purposes of the CVRA; and

WHEREAS, California Elections Code section 10010 establishes procedures for changing from an at-large to a by-district electoral system; and

WHEREAS, Section 10010 also requires a prospective plaintiff under the CVRA to first send a written notice to the city against which the action would be brought indicating that the at-large method of election used by the city may violate the CVRA; and

who are members of a protected class under the CVRA and denies that it is in violation of the CVRA; and

WHEREAS, the letter does not contain evidence of a violation of the CV RA, but the cost of defending against a lawsuit under the CVRA is extremely high, even if the City is successful, and such an expensive defense would burden the City’s budget impacting the City’s ability to provide needed services to its residents , and a successful defense would not protect the City from future claims under the CVRA; and

WHEREAS, to avoid spending taxpayer dollars in the defense of a potentially extremely expensive lawsuit, the City Council determined that it is in the best interest of the City to move from its current at-large electoral system to a by-district electoral system for members of the City Council, pursuant to California Government Code section 34886 and in furtherance of the purposes of CVRA favoring district-based elections; and

WHEREAS, on January 24, 202 3, the City Council adopted a Resolution of Intention, outlining the City Council’s intention to transition from at -large to district-based elections, specific steps the City Council would undertake to facilitate this transition, and an estimated time frame for so doing; and

WHEREAS, under the provisions of California Election Code section 10010, a city that changes from an at -large method of election to a district -based election must do all of the following before a public hearing at which the City Council votes to approve or defeat an ordinance establishing district-based elections:

• The City must hold at least two additional hearings over a period of no more than 45 days, at which the public is invited to provide input regarding the content of the draft map(s) and the proposed sequence of elections.; and

WHEREAS, the City retained a well- qualified and experienced professional demographer to assist with the process of drawing draft district maps and a well-qualified and experienced public outreach consultant to engage the public in the districting process; and

WHEREAS, the City Council also established a website dedicated to information about the districting process, and conducted public workshops/forums on March 30, 2023, April 6, 2023, and April 8 , 202 3, at which the City received input and also provided information on the districting process and on opportunities for the public to become involved including providing facilities to allow members of the public to identify “communities of interest” by mapping their location and to draw draft districting maps, and instruction on the use of those facilities; and

WHEREAS, 15 maps of communities of interest and 27 fully formed election district draft maps were submitted to the City by members of the public by the first deadline set for draft map submission, and t wo (2 ) draft district maps were drawn by the City’s demographic consultant, all of which included a proposed sequencing of elections and were published on the City’s districting website on June 7, 2023;

WHEREAS, on June 14, 2023, the City conducted a third public hearing after which it selected three (3) draft maps and two (2) combinations of draft maps as “focus” maps for the process going forward; and

WHEREAS, 13 additional draft maps or map requests were submitted to the City by the second map- submission deadline, and these maps , including a sequencing of elections were published on the City’s districting website on July 11, 2023; and

WHEREAS, on July 18, 2023, the City Council held a fourth public hearing on the draft maps and after the close of the public hearing, it selected draft Map 130 for additional focus and instructed the demographer to develop specified variations to Map 130 for the City Council’s consideration; and

WHEREAS, the Map 130 variations developed by the demographer, which were labeled Map 130B, Map 130C, Map 130D , and Map 130E, were published on the City’s website on July 28, 2023 along with a proposed sequencing of elections for each map; and
