SUBJECT: Adoption of a Resolution Approving a Cooperative Agreement with PlayPower, Inc. DBA Miracle Recreation for the Ralph Foy Park Toddler Replacement Playground Project
RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK APPROVING A COOPERATIVE AGREEMENT WITH PLAYPOWER, INC. DBA MIRACLE
RECREATION FOR THE RALPH FOY PARK TO DDLER REPLACEMENT
PLAYGROUND PROJECT (Attachment 1).
BACKGROUND
The Parks and Recreation Department (Department) prides itself on creating unique play areas and experiences for all park users. It is the Department’s goal that park amenities and playgrounds throughout Burbank have a different element, look, and feel. The playground equipment selected for parks provide children with an innovative play area to exercise and develop other critical social skills.
Understanding the value and benefits of park playgrounds, t he Department has a replacement schedule for playground equipment citywide. The schedule reflects the age and condition of the equipment, as well as industry standards and compliance regulations.
Although the existing playground equipment at Foy Park was installed in 2017 and is not due for replacement, on February 28, 2023 , the toddler play area sustained significant structural damage as a result of a fallen tree during the heavy rain and windstorm. It is for this reason that the Department is replacing the toddler playground structure. The Ralph Foy Park Toddler Replacement Playground Project (Project) includes the design and installation of new play equipment to replace the damaged to ddler playground area at Ralph Foy Park.
2 DISCUSSION
The Department believes that the proposed playground equipment system detailed in the attached renderings (Attachment 2), accomplishes the Department’s goal of creating unique and fun play areas. Moreover, the proposed project includes additional elements that will augment the existing playground area.
As with the existing play equipment, the replacement equipment is for the age group 2-5.
The scope of work of the original supplier and selected vendor, Miracle Recreation , (Attachment 3) includes removal of existing damaged play equipment and installation of the new and augmented playground equipment . The new equipment includes slides, multiple climbing components, and interactive features.
The new playground will provide a variety of the latest play features and experiences for children of all abilities in a fun atmosphere and include five (5) elements of inclusion play for cognitive, strength, social/emotional, sensory, and motor engagement. Construction of the Project is slated to commence in January 2024 and be completed by March 2024.
For this Project, the Department is utilizing an alternate delivery method, the use of a Cooperative Agreement. By using a Cooperative Agreement, the City is a ble to utilize another public agency’s bid which includes bidding language on behalf of the members of the nationwide Cooperative. This process reduces the cost of goods and services by aggregating the purchasing power of public agencies nationwide. The pr ocurement and/or construction agreements are awarded to those company(ies) providing the best value. This process eliminates much of the time needed for a bid process and is a preferable method of procurement for playground equipment and installation, as each manufacturer provides proprietary equipment. Therefore, the Department can select the manufacturer and the design that best suits a particular park’s needs while still receiving the benefit of nationwide pricing. While industry standard is for the manufacturer to provide a public agency with an 8% price reduction, the manufacturer committed to providing the Department with a significant price reduction of 17%.
This method also helps with streamlining the project timeline. The Department believes that the cooperative purchasing process is the optimal purchasing procedure for it s playground replacement as it provides the greatest flexibility in selecting a unique product at a reduced cost. Under Burbank Municipal Code section 2-2-116, subdivisions (I) and (J), the City Council shall waive the requirement for competitive bidding by Resolution finding that it is in the best interest of the City and award the contract to the proposer offering the Best Value as more fully defined in the solicitation.
Miracle Recreation is an approved supplier of Cooperative purchaser Sourcewell and is utilizing a contract established by Sourcewell’s Cooperative Agreement (Attachment 4).
Miracle Recreation, the original supplier, is the selected vendor. They have met all the requirements and expectations of the Department. Again, the existing toddler playground equipment at Ralph Foy Park was designed and installed by Miracle Recreation.
CEQA Review
This Project is categorically exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to section 15302 of the State CEQA 3 Guidelines, which allows for replacement or reconstruction of existing structures and facilities, where the new structures and facilities will be located on the same site and will have substantially the same purpose and capacity as the structures and facilities being replaced. Staff recommends Council find the Project exempt from CEQA.
FISCAL IMPACT
The total contract price is $ 249,053.61. There is no fiscal impact resulting from the recommended action as funds from Fiscal Year 2022-2023 have been allocated to project account 534.PR21A.70003.24854 (Foy Playground Replacement) to offset the cost.
CONCLUSION
Staff has been extremely pleased with the proposed playground design and project schedule that Miracle Recreation has provided. The approval and completion of this Project will attract residents of all ages to come out and enjoy the wonderful amenities in the City’s park system.
