RESOLUTION NO. ____________
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK AUTHORIZING AGREEMENTS FOR THE
PURCHASE AND INSTALLATION OF AN
AGRICULTURAL STRUCTURE AND CONCRETE
FOUNDATION BLOCKS TO COVER BURBANK LANDFILL
NO. 3’S ORGANICS TRANSFER SITE ; AND APPROVAL
OF BUDGET AMENDMENT
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. The City’s Public Works Department is responsible for operating Burbank Landfill No. 3 (Landfill) since 1971. Due to new waste-related regulations, a cover system is to be placed over the organics to ensure that the State’s water resources are adequately protected. This cover system will also require the installation of a floating foundation to support such system.
B. Under the Charter (section 1205) and the Burbank Municipal Code (section 2- 2- 116), the City Council may approve public work contracts greater than $200,000 and waive the requirement for competitive bidding by a resolution finding that doing so provides the City the best value and is in the best interest of the City.
C. Based upon the staff report and the evidence provided to the City Council, the City Council finds agreements with ClearSpan Fabric Structures and Concrete Block Supply to be the best value and in the best interest of the City, due to the specialized nature of such landfill- related cover systems and the City’s need for immediate work to ensure compliance with waste and organics-related regulations.
D. The City Council desires to approve and authorize the City Manager and the Public Works Director to enter into and execute an a greement with ClearSpan Fabric Structures and a separate agreement Concrete Block Supply , in the combined amount of $376,263.03 (“Agreements”) consistent with the existing quotes received by the City.
E. The work subject to these agreements are related to the operation, repair, maintenance, and permitting, leasing, licensing, or minor alteration of existing City Landfill facilities and mechanical equipment, and adds safety or health protection devices for use in conjunction with existing structures, facilities, or mechanical equipment. It involves no expansion of the existing use beyond that of the Landfill’s permitted requirements, and no exceptions to categorical exemptions appear to apply. Accordingly, s uch activity is categorically exempt under the California Environmental Quality Act (CEQA) Guidelines. (14 CCR §§ 15300.2; 15301.)
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
Attachment 1-2
1. That approval of these agreements based upon the provided quotes constitute the best value and is in the best interest of the City.
2. That the City Manager or the Public Works Director may: (a) enter into and execute these agreements, s ubject to approval from the City Attorney’s Office ; and (b) award and execute any ancillary documents and amendments as may be approved by the City Attorney’s Office, but only to the extent the applicable funds are available and budgeted.
3. That the Public Works Director, or their designee, is authorized to review and in their discretion, to approve the project plans and specifications if necessary for this project.
4. That the City Clerk be the custodian of all documents and records which constitute the record of proceedings for the p roject, and such documents and records shall be maintained in the office of the City Clerk at 275 East Olive Avenue, in Burbank California.
5. The City's Fiscal Year (FY) 2023/2024 Annual Budget is amended by appropriating $376,263.03 from 498.ND000.30011.0000.00000 (Refuse Collection and Disposal Fund, Non- Departmental Assigned Fund Balance) to expenditure account no.498.PW31B.15032.0000.24910 (Refuse Collection and Dis posal, Refuse Disposal, Infrastructure, Landfill Organics Cover ). The City Manager or his designee is authorized to make such revisions to the FY 2023/24 Adopted Budget, and other budget documents as deemed necessary or prudent to im plement the approvals as set forth in this resolution.
6. That City staff is directed to file a notice of exemption (NOE) with the California State Clearinghouse, as permitted under CEQA Guidelines Sections 15061 and 15062, that reflects the finding above that this action is exempt from CEQA.
PASSED and ADOPTED this ___ day of December, 2023.
