RESOLUTION NO.
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK TO AUTHORIZE THE GRANT APPLICATION
AND ACCEPTANCE OF A GRANT FROM THE CALIFORNIA
STATE LIBRARY IN THE AMOUNT OF $9,949,896, AND
AUTHORIZE THE CITY MANAGER OR HIS DESIGNEE TO
ENTER INTO A GRANT AGREEMENT ON THE CITY'S
BEHALF
THE COUNCIL OF THE CITY OF BURBANK FINDS:
The California State Legislature and Governor of the State of California have provided funds for the Building Forward Library Facilities Improvement Program through the State of California Budget Act of 2022 (AB 178) and the State of California Budget Act of 2023 (SB 101).
B. The California State Library has been delegated the responsibility for the administration of this grant program, establishing necessary procedures, and said procedures require a resolution certifying approval by the grantee's governing board prior to execution of the grant agreement.
C. The City of Burbank will enter into an agreement with the State of California to carry out the project, A Modern, Accessible, Sustainable Burbank Central Library; the City of Burbank has the legal authority and is authorized to enter into said funding agreement with the State of California; and the City of Burbank intends to receive grant funding from the California State Library for said project.
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
Pursuant and subject to all terms and provisions of the California Budget Act of 2022 and California Budget Act of 2023, the City of Burbank City Manager, or designee, is hereby authorized and directed to prepare and file required documents related to grant funding with the California State Library, and take such other actions necessary or appropriate to obtain grant funding.
The City of Burbank City Manager, or designee, is hereby authorized and directed to execute the funding agreement with the California State Library and any amendments thereto.
3. The City of Burbank City Manager, or designee, is hereby authorized and directed to submit any required documents, funding requests, and reports to obtain grant funding.

4. The City of Burbank will ensure the project complies with any laws and regulations including, but not limited to, the California Environmental Quality Act (CEQA), legal requirements for building codes, health and safety codes, the California Labor Code, disabled access laws, and that, prior to commencement of the project, all applicable permits have been obtained.
