SUBJECT: Approval of a Sixth Amendment to a Professional Services Agreement with Elizabeth Moule & Stefanos Polyzoides, Architects and Urbanists, for the Downtown Burbank Transit Oriented Development Specific Plan; and Amending the Fiscal Year 2023-2024 Budget

RECOMMENDATION

1. Approve a Sixth Amendment to Professional Services Agreement (PSA) with Elizabeth Moule & Stefanos Polyzoides, Architects and Urbanists (Attachment 1) for the Downtown Burbank Transit Oriented Development (TOD) Specific Plan.

2. Amend Fiscal Year (FY) 2023-2024 Budget by appropriating $314,000.

BACKGROUND
The City entered into a PSA with Elizabeth Moule & Stefanos Polyzoides, Architects and Urbanists (Moule & Polyzoides or Consultants) on May 5, 2020, to prepare the Downtown Burbank TOD Specific Plan (Project) and conduct the associated environmental review. The original cost of service was $1,125,000 (Attachment 7).

First and Second Amendments were made to this PSA on September 8, 2020 and April 6, 2021 respectively, to amend the Consultant’s business name and extend the term. A Third Amendment was made on November 16, 2021 to increase the Project budget to $1,147,000 ($22,000 increase). A Fourth Amendment was made on November 1, 2022 to increase the Project budget to $1,373,500 ($226,500 increase) and extended the term of the PSA to December 31, 2023. A Fifth Amendment was entered into on December 30, 2023 to extend the term of the PSA to January 31, 2024 (Attachments 2-6).

COMMUNITY

DEVELOPMENT
2 A Sixth Amendment is now being requested to extend the term of the PSA to June 30, 2025 and increase the Project budget to account for additional work necessary for completion of the specific plan and the associated environmental analysis. This Sixth Amendment would increase the Project budget by $314,000 for a total cost of service of $1,687,500.

DISCUSSION
Staff is requesting that the City Council (Council) approve a Sixth Amendment to the PSA with Moule & Polyzoides to extend the term of the PSA to June 30, 2025 and increase the project budget by $314,000. Based on the work completed to date, it was determined that an increase to the P roject budget would be necessary for Moule & Polyzoides to account for additional technical analysis and public outreach that is necessary to facilitate the completion of the required Project environmental analysis and specific plan document.

The additional funds would be used to complete the following tasks:

• Additional California Environmental Quality Act (CEQA) work related to perform a comprehensive analysis of an Increased Growth Alternative that addresses the same thresholds that will be analyzed for each Environmental Impact Report (EIR) section under the Preferred Project; inclusion of additional analysis associated with the Civic Center Project, including analysis on the demolition of the Burbank Central Library and the impacts of development around the existing City Hall. • Additional funds to forecast utility capacity (sewer, water, and power) necessary for the envisioned build-out being analyzed under the Preferred Project and Increased Growth Alternative.
• Additional funds to undertake work to compete the specific plan draft. • The provisions to enhance community participation through the inclusion of three additional in-person community workshops that will allow the Consultant team to moderate the workshops, prepare and create workshop advertising materials (handouts, boards, et cetera), and interpretation of workshop materials.

COMMUNITY OUTREACH
This report summarizes a request for approval of a Sixth Amendment to a PSA with Moule & Polyzoides and an Amendment to the FY 2023-2024 Budget related to the continued processing of the Downtown Burbank TOD Specific Plan and associated General Plan Amendment Project. There is no community outreach required for this type of request; however, extensive community outreach has been done for the associated Project including community workshops , reports to City Council and City Boards and Commissions, CEQA Scoping Meetings , and meetings with Project stakeholders.

Additional community outreach is planned for the Project, including work shops, presentations to various Burbank Boards, Commissions, and Committees, and key stakeholder meetings leading up to the release and review of draft documents related to the Project and Council review and approval of the Project.

ENVIRONMENTAL ASSESSMENT
This Report has no potential for resulting in a direct or indirect physical change to the environment and falls outside the definition of a “project” under CEQA and is therefore not subject to CEQA pursuant to Section 15378 of Titl e 14 of the California Code of Regulations. This staff report is related to the proposed Sixth Amendment to a PSA and Amendment to the FY 2023-2024 Budget related to the continued processing of the 3 Downtown Burbank TOD Specific Plan and associated General Plan Amendment Project.

However, the Downtown Burbank TOD Specific Plan Project is subject to CEQA ; a Program Environmental Impact Report (EIR) is being prepared for the Project.

FISCAL IMPACT
For the Downtown Burbank TOD Specific Plan, the PSA Amendment is a total of $314,000. Therefore, staff is requesting Council authority to amend the FY 2023-2024 Budget by appropriating $314,000 from revenue account number 001.ND000.30010.0000.00000 (General Fund, Non- Departmental, Unassigned Fund Balance) to expenditure account number 001.CD31A.62085.0000.23217 (General Fund, Community Development Planning, Other Professional Services, Downtown Burbank Specific Plan).

CONCLUSION
Staff recommends Council ap prove the Sixth Amendment to the PSA with Moule & Polyzoides for the Downtown Burbank TOD Specific Plan and the FY 2023-2024 Budget Amendment to appropriate $314,000. Approval of this amendment is consistent with the Burbank2035 General Plan Land Use and Housing Element Goals and will ensure long- range planning project s are on track for completion by early 2025. Approving the Sixth Amendment is also consistent with the Realization Plan Program LU -3 that provides an update for the City’s existing specific plans and creation of the Golden State Specific Plan.

Lastly, approving the Sixth Amendment will allow for increased community participation in the City’s planning processes.
