RE: Proposed Mixed-Use Project at 3201 W. Olive Avenue, Burbank Dear Patrick,
Please consider this letter in support of the proposed mixed-use project at 3201 W. Olive Avenue, Burbank that is subject to City Council review on February 27, 2024. This high-density, high-quality project, with its 144 residential rental units located in close proximity to transit and employment, is the type of project that this community desperately needs.
Also note that we are the adjacent property owner of the Talaria Burbank project, as well as more than a dozen other properties that are within walking distance of this site. The proposed project will be a benefit to the neighborhood and to the greater community in general. We urge you to approve this project without delay

Re: Proposed SB 35 Project at 3201 West Olive Avenue
By email: [email protected]; [email protected]; [email protected]; [email protected]; [email protected]; [email protected]
Cc: [email protected]; [email protected] Dear Burbank City Council:
The California Housing Defense Fund ("CalHDF") submits this letter to remind the Council of its obligation to abide by all relevant state housing laws when evaluating the proposed 144- unit housing development project at 3201 West Olive Avenue. These laws include Senate Bill 35 ("SB 35"), the Housing Accountability Act ('HAA"), the Density Bonus Law ("DBL"), and California Environmental Quality Act ("CEQA") Guidelines.
SB 35 exempts the project from accessory parking requirements, as it is within ½ mile of public transit (Gov. Code § 65913.4(e)). SB 35 also creates a streamlined approval pathway - a "ministerial approval" process - for multi-family housing development projects that meet certain affordability criteria and that comply with all objective zoning standards. (Id., subds. (a), (b).) Ministerial approval means the City has no discretion to disapprove the project: so long as the SB 35 criteria are satisfied, the project must be allowed to proceed. As staff notes, the project here satisfies SB 35's criteria, including objective zoning and design review standards, and is eligible for ministerial approval.
CalHDF notes that the Council has elected to hold a second public hearing on this development project. While the Council, pursuant to Gov't Code § 65913.4, subd. (c), may conduct design review or public oversight of the project, such oversight must be concluded within 90 days and "shall not in any way inhibit, chill, or preclude the ministerial approval provided by this section." (Id., subd. (c)(1).) The Council must therefore allow city staff to ministerially approve the project.
Oakland 94610
The HAA provides the project further legal protections. It requires approval of zoning and general plan compliant housing development projects unless findings can be made regarding specific, objective, written health and safety hazards. (Gov. Code § 65589.5, subd. (j).) The project here conforms with all applicable objective zoning, subdivision, and design review standards, and therefore the HAAs protections apply. Note that concessions of development standards pursuant to the DBL, discussed below, do not render the project noncompliant with local development standards for HAA purposes. (Id. at subd. (j)(3).)) Additionally, there is no identified noncompliance with objective, written health and safety standards. The Council cannot reject the project without violating the HAA.
The DBL offers the project certain benefits. (See Gov. Code § 65915.) The Council must respect these benefits. Specifically, it must grant the developer's requested concession to use the gross area of the project site to calculate the allowable density. The Council also must grant the requested waivers for maximum structure height, average building setback, and on-site tree requirements. (And, as mentioned above, these concessions and waivers do not impede the HAA's application to the project.)
Finally, the Project is statutorily exempt from environmental review under CEQA Guidelines Section 15268 (Ministerial Projects).
As you are well aware, California remains in the throes of a statewide crisis-level housing shortage. New housing such as this is a public benefit; it will bring increased tax revenue to the city; it will bring new customers to local businesses, and it will reduce displacement of existing residents. It will also help cut down on transportation-related greenhouse gas emissions by providing housing in denser, more urban areas, as opposed to farther-flung regions in the state (and out of state). While no one project will solve the statewide housing crisis, the proposed development at 3201 W. Olive Avenue is a step in the right direction.
CalHDF urges the City Council to approve it, consistent with its obligations under state law.
CalHDF is a 501(c)3 non-profit corporation whose mission includes advocating for increased access to housing for Californians at all income levels, including low-income households.

Dear Catlan,
Thank you for contacting me about the proposed SB 35 project at 3201 West Olive Avenue. The Project will provide 15 very low-income units, which will meet the City and State's affordability requirements for the Project.
For your reference, the City's adopted Housing Element (Burbank 2021-2029 Housing Element - Housing Element, page 1-19 and 1-20) has information about the City's household income-level percentages as it relates to lower income households.
If you have further questions or would like to talk to me about the Project, please contact me at 818-238-5250. Thank you and have a great day.

Dear Mr. Kim,
I live in the Burbank Rancho and own a 5-unit apartment building in the Rancho and a 3-unit commercial property on Victory in 91502. I live and run my businesses here and I want Burbank to remain strong and affordable for the many people who work in and contribute to our city. 1 I think a multi-unit mixed-use development is an excellent use of this site, but the number of low-income units is unconscionably low. What percentage of the population of Burbank is low to moderate income? That should be the target in all new development in order to preserve the flavor of our community. This development should have at the very least 33% low to moderate income deed restrictions.
We do not need a partner to the Talaria project with exorbitant rents and high vacancies. We need realistic and affordable housing being built in Burbank. During the review process, please ensure that this developer, who cares only about making money and almost nothing about the city of Burbank, is forced to build the kind of housing that we need.
Best regards,
Catlan

Hello David Kim - I am not able to make it to the public hearing today regarding the proposed development at 3201 W.
Olive Ave. but as a homeowner in the residential area to the immediate North of the development / wanted to share my opinion.
I am not opposed to the development in principle - but I do feel that the number of waivers that are being asked for are out of proportion to the relatively small number of low income units the developers are committing too. In a 144 unit building only 15 units are set aside as low-income residential units. Yet they are requesting waivers to MDC-2 on the Maximum Structure Height, Average Building Setback, and the number of On-Site Trees.
These all feel like major concessions that will negatively impact the larger community while providing very little benefit to the community with only 15 units of low-income housing.
I think the development at this site is an opportunity to create a space that improves the quality of life for residents and workers in the Media District and surrounding neighborhoods. However the waivers to the MDC-2 that are being requested are an overall negative for the community.
In Attachment 1-5 under each waiver that is requested it is stated: "The requested waiver is necessary to build out the proposed affordable housing project and state-mandated dwelling units; therefore, the requested waiver can be granted." Yet there are only 15 low-income units out of 144. These really do not seem like necessary or reasonable waivers to grant for such a small number of low income units.
I would encourage the city council to not approve these waivers to MDC-2 or to push for a larger percentage of low income units - closer to 30% - which would really have a positive impact on the community.
Thanks for your consideration,
Tim Mapp

Just not in favor of a 5 story building with 144 units in an already over-trafficked, pedestrian and cycle-unfriendly area of the Media District, adjacent to the Rancho District. The Olive/Alameda intersection is already nearly impassable and unsafe to cross as a pedestrian. Since the opening of Talaria/Whole Foods, Alameda the amount of traffic and unsafe driving in that area has increased substantially. This is the only remaining open space" in that section of town and if approved, will have a behemoth building blocking light and sun. Just not in favor.
