SUBJECT: Adoption of a Resolution Approving Contract Documents , Plans and Specifications, and Authorizing Execution of a Contract for Bid Schedule No. 1519 - Annual Sidewalk Repair Project in Zones 15, 16, 17 and 18 to Kalban, Inc.; Finding of CEQA Exemption (14 CCR § 15301).
RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK APPROVING
CONTRACT DOCUMENTS, PLANS AND SPECIFICATIONS, AND AUTHORIZING EXECUTION OF A CONTRACT FOR BID SCHEDULE NO. 1519 – ANNUAL SIDEWALK REPAIR PROJECT (ZONES 15 – 18), TO KALBAN, INC. (Attachment 1).
BACKGROUND
The project is a continuation of the City’s ongoing efforts to maintain its sidewalks. This project aligns with City Council (Council) goals (City Services, Quality of Life, and Infrastructure) and is the third phase of the new five-year cycle of the Citywide Annual Sidewalk Repair program. The Project will remove and reconstruct damaged sidewalks, curbs, gutters, driveways, and pedestrian ramps in four zones in the City (Attachment 2).
Additionally, the project will ensure that infrastructure is maintained in compliance with legal requirements and standards expected by Council and the community.
DISCUSSION
Bid Schedule No. 1519 was advertised on January 3 and January 10, 2024. A bid opening was held on February 6, 2024. Five contractors submitted bids, with costs ranging from $1,498,500 to $2,660,170 (Attachment 3 ). Kalban, Inc. of Santa Clarita , California, submitted the lowest responsive and responsible bid of $1,498,500, which is within the engineer’s estimate of approximately $1.5M. Kalban, Inc. has previously performed work similar to the scope of work in this project for the City of Burbank with satisfactory results.
If approved by Council, construction is planned to start in May 2024 and expected to end in August 2024. As with all Public Works bid schedules affecting the public right-of-way, the contractor is required to coordinate with potentially affected local businesses, schools, and residents , and must provide notification in writing at least five working days in advance of the start of construction in each specific area.
Project plans and specifications are available for review at the Public Works Department, located at 150 N. Third Street, Burbank, California, and the City Clerk’s Office located in the Burbank City Hall, 275 E. Olive, Burbank, California.
ENVIRONMENTAL REVIEW
Staff recommends that the Council find that adoption of this resolution i s categorically exempt under the California Environmental Quality Act (CEQA) Section 15301, which exempts the operation, repair, maintenance, and minor alteration of existing public structures and facilities (including sidewalks) that involve negligible or no expansion of existing or former use . This project includes the repairing and maintenance of existing sidewalks for public right of way purposes, and there are no exceptions or unique circumstances that apply that would affect the application of this exemption . A section referencing such a finding is included in the r esolution should Council agree with staff’s recommendation.
FISCAL IMPACT
The engineer’s estimate, prepared approximately a year ago, was $1.5M and included a 10% contingency for construction. However, given the contract award amount , staff recommends an additional 20% of the construction cost, $299,700, be added to the Project to provide the original 10% contingency and the actual 10% contingency based upon the contract award amount of $1,498,500. Sufficient funds are available in the following project accounts:
• 108.PW21A.70002.0000.24542 (Measure M Transportation, Street Design & Construction Improvements – FY 22-23 Sidewalk Rehab - $1,478,224) • 534.PW21A.70002.0000.24542 (Municipal Infrastructure , Street Design & Construction Improvements – FY 22-23 Sidewalk Rehab - $517,793)
CONCLUSION
Staff respectfully recommends that Council adopt the proposed resolution to approve the contract documents and award a construction contract to Kalban, Inc. for Bid Schedule No. 1519 – Annual Sidewalk Repair Project (Zones 15 – 18) and find the adoption of the resolution categorically exempt from CEQA.
