DATE: March 26, 2024

TO: Justin Hess, City Manager
Joe McDougall, City Attorney

FROM: Betsy McClinton, Management Services Director

SUBJECT: Approval of a First Amendment to the City Attorney Employment Agreement between the City of Burbank and Joseph H. McDougall Approving a 7% A nnual Salary Increase

RECOMMENDATION
Approve a First Amendment to the City Attorney Employment Agreement between the City of Burbank and Joseph H. McDougall Approving a 7% Annual Salary Increase .

BACKGROUND AND DISCUSSION
The City Council entered into a City Attorney Employment Agreement (Agreement) with Joseph H. McDougall on November 10, 2021.

The City Council and Mr. McDougall desire to amend the Agreement to add the following paragraph (d) to Section 3.A.(1) as follow s:

(d) To incentivize retention, the City Attorney’s base salary range shall be increased upon adoption of this First Amendment, and annually thereafter, by seven percent (7%), provided such annual increase shall not result in a salary range exceeding the top of the City Manager’s then- current salary range. In such event, the annual increase will be rounded down to a full percentage point that results in a salary range that falls below the top of the City Manager’s salary range.

2 ENVIRONMENTAL IMPACT
This activity has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and such as, is not a “project” subject to the requirements of the California Environmental Quality Act (CEQA) 14 Cal. Code Regs §15378.

FISCAL IMPACT
The total annual Fiscal Impact associated with the proposed First Amendment is $21,942. For the remainder of FY 23- 24, the Fiscal Impact is $5,907. The City Attorney’s Office FY 23 -24 budget has sufficient salary savings available to cover this impact. Sta ff will incorporate future increases as required by the Amendment into the proposed FY 24- 25 budget and proposed budgets thereafter.

CONCLUSION
The proposed First Amendment as negotiated between the City Council and Mr.

McDougall will ensure that the sal ary provided to Burbank’s City Attorney will remain competitive within Burbank’s local employment market in alignment with the City Council’s adopted Compensation Policy .
