Status:

This PD was previously built out (completed) and the DA expired in 2004. However, it is being included in this this report to provide the Council an update on updates about potential redevelopment of the site.

The application for the Fifth Amendment to the Planned Development Zone was filed on June 27, 2016. In 2022, the project request was withdrawn by the landowner, however, the City continues to work with property ownership on possible future land uses to be considered in alignment with the proposed Downtown Burbank Transit Oriented Development (TOD) Specific Plan Project. City staff continues to engage with the current ownership entities, (which as of March 2023, includes the Onni Group - a Toronto-based investor and developer with expertise in the construction of office space and mixed-use developments) on the future redevelopment of the properties , and any amendments will be submitted after the Downtown Burbank TOD Specific Plan is adopted.

Status:

This PD was previously built out (completed) and the DA expired in 2018. However, it is being included in this this report to provide the Council an update on a recent activities, including a new addition, and a lot line adjustment and variance application submitted for City review.

In March 2024, a request was submitted to allow an increase in the total square footage allowed in Sub Area A of the PD to accommodate a 400-square foot addition to provide the building engineers with a location to store and work on minor building related work. Through Condition of Approval #1, the Community Development Department Director authorized the square footage addition and deemed it to be in substantial conformance with the approved PD and associated conditions of approval.

Further, the City is currently working with the property owner and Caltrans to correct the current lot line location of the Empire Center property as a result of the Empire Avenue Interchange project. The affected project site area includes the unfinished right-of-way construction and landscaping along the south side of Empire Avenue near Victory Place that was part of the public right -of-way improvement for the Empire Avenue Interchange project. To address this change in property line location and the resulting reduction in existing building setback along this portion of the Empire Center, the property owner has requested and submitted a lot line adjustment and variance application with the City for review on May 6, 2024. The application is currently under review.

The Project Site has two zoning designations, PD 88-2 and 99-1, that are part of a single Development Agreement for the Project ATTACHMENT 1-4

Site. Construction of this project is complete, and the project has complied with all conditions of approval.

On February 5, 2019, the City Council approved an ordinance amending the DA allowing a request to allow (1) 51 parking spaces previously allocated for residential use to be used exclusively by tenants of the 30,000- square-foot office building, (2) removing the language that allows commercial parking to be used by residential tenants after hours and on weekends, and (3) a change in the maximum square footage and height allowed for the commercial office building to 30,000 square feet and three stories, excluding parking levels. The PD 88- 2 and 99- 1 zoning designations, boundaries, and acreage remained unchanged for the subject properties comprising the Project Site.

Since staff’s last PD/DA update to the City Council, there have been no changes. The property owner continues to comply with all mitigation measures related to the project.

Since staff’s last PD/DA update to the City Council, there have been no changes. The property owner continues to comply with all mitigation measures related to the project.

Mitigation Monitoring:

The project meets all conditions of approval for the DA’s constructed square footage.

Construction of the remaining 160,447 square feet would require additional intersection improvements to be constructed at Hollywood Way / Thornton Ave. and Hollywood Way / Winona Ave. However, these improvements have already been completed by the Avion Burbank Development Project to address traffic impacts associated with the Avion Burbank Development Project.

Status:

The PD was originally approved in 1995 and allowed for 749,000 net new Office- Equivalent Gross Square Feet (OE-GSF) in addition to the square footage that existed in 1995, which was 85,497OE-GSF. In the period between 1995 and 2022 , several buildings and sound stages were constructed. However, in 2023 the entire project site was cleared for the construction of an all- new campus, which, when completed, will contain 16 new sound stages, a five- story media office building, a five- level parking garage, a mill building for production manufacturing, and various site improvements, including modernized infrastructure and new landscaping. The new campus will represent approximately 426,396 OE-GSF. When built, Warner Bros. will develop approximately 50% of the 843,497 OE-GSF that is allowed on site . The construction is expected to be completed in Q4 of 2025.

In addition, on August 8, 2023, the City Council approved Resolution No. 23- 29,452 consenting to the transfer of the Ranch Lot Development Agreement from Warner Bros. Entertainment Inc. to “Ranch Lot Studios Owner, LLC,” as allowed by Section

1.4 of the Development Agreement. The new owner assumes the entirety of the obligations and terms of the Development Agreement.

The PD/DA were extended on April 26, 2011, for an additional 15 years. They are set to expire November 25, 2030.

Mitigation Monitoring:

The applicant has conducted a project condition compliance review. City s taff is working with the Ranch Lot Studios Owner, LLC / Worthe Real Estate Group (property owner) and Krismar Construction (contractor) to ensure compliance with all mitigation measures applicable with the proposed redevelopment of the project site, including traffic mitigation measures addressed as part of the proposed development.

Status:

Originally approved in 1997, PD 96- 01 approved the Burbank Studios Master Plan (also known as, “the former NBC Studios Property”). When approved the City also approved a 20- year Development Agreement that provided the property owner the right to develop a total of 1,825,865 Office-Equivalent Gross Square Feet (OE -GSF) on the property by 2017. OE-GSF is a calculation used in the Media District to limit development based on traffic impacts. Following the approval of PD 96- 01, The Pointe Burbank was constructed in 2006/2007 – an approximately 480,000- square- foot (329,000 OE -GSF) office building at 2900 West Alameda Avenue. Also, more recently Two Frank Gehry -designed Buildings, also known as “Second Century Project,” were completed between 2022 and 2023. With the completion of the Second Century Project, the Burbank Studios Master Plan has 882,396 of OE-GSF built, and will have 614,458 OE-GSF of vested development potential remaining, or approximately 33.6 percent of the total.

In addition, i n 2023, the Developer completed an internal lot line adjustment for the Project Site. This change resulted in an update to the legal description of the Project site as well as the street addresses associated with the Project site, but did not expand, reduce, or otherw ise change the exterior boundaries of the Project site or create new parcels within the Project site.

Finally, in February of 2024 the Second
Amendment of the Development Agreement was approved by the City Council, extending the term of the DA by three years until March 19, 2027.

The PD/DA were extended on February 13, 2024, for an additional 3 years. They are set to expire March 19, 2027.

Mitigation Monitoring:

PD 96-01 is complying with all conditions of approval, including the construction of traffic improvements that are required as certain OE -GSF thresholds are met. This includes (1) signal improvements at the Buena Vista / Riverside / SR -134 ramps; (2) possible intersection improvements at the intersection of Barham and Forest Lawn Drive; and (3) site access improvements at Bob Hope Drive and Parkside Avenue.

There is a determination from the City of Los Angeles, dated June 29, 2023, that the City of Los Angeles did not consent to the implementation of Condition 18. Condition 18 requires improvements to Barham Boulevard/Forest Lawn Drive/Lakeside Plaza Drive when certain thresholds were met. However, this does not conflict with the terms of the DA, which allow s deviations from the c onditions through Condition 15, when any approving agency other than the City of Burbank does not approve of the implementation of a condition.

Notwithstanding, the property owner and City staff will continue to work collaboratively with City of Los Angeles, NBC Universal , and Caltrans in confirming that mitigation measures resulting from PD 96-01 that are within their jurisdictions are completed.

Status:

On August 1, 2016, the City Council adopted an ordinance approving a Development Agreement (and related PD Amendments) for a 14- gate replacement terminal, other airport buildings and facilities, and related improvements. On November 8, 2016, Burbank residents approved Measure B (with 70% of the vote) to allow a new 14-gate, 355,000-square-foot replacement terminal to be built with up to 3,180 public and 600 employee parking spaces.

The Authority began the Replacement Terminal Design Process by holding a series of public design charrette workshops between March 27, 2019, and October 26, 2019.

The design charrette workshops were held in the City of Burbank , as well as in the cities of Glendale, Pasadena, and Los Angeles. Furthermore, the Authority conducted a procurement and later released a request for proposals for the selection of a consultant firm that would provide project management and associated services for the replacement terminal project which include setting up the program control processes, supporting the Authority in soliciting progressive design-builder firms, and helping define the selection process by which the best value design- builder firm will be selected. In 2019, the Authority selected the firm of AECOM Technical Services, Inc. (AECOM) to provide program management and associated services for the replacement terminal project.

In March 2020, the Airport Authority (Authority) suspended planning and implementation of all discretionary projects, including the replacement terminal, due to the COVID-19 Pandemic. As of September 2021, the Authority had authorized the restart of the replacement terminal project by re- engaging AECOM Technical Services, Inc. consulting firm (AECOM) to manage the project and continue work on development of the Program Development Manual and preparation of a Request for Qualification in order to begin the selection of a progressive design builder for the project. On April 27, 2022, the Authority Commission voted to have Jacobs Project Management Co. (Jacobs) assume the program management services for the replacement terminal project.

ATTACHMENT 1-10

In early 2022, the Authority initiated a procurement process for the project to solicit for a design- builder to provide planning, design, construction, and commissioning services. On December 19, 2022, the Authority Commission awarded a design- build agreement to the Holder, Pankow, TEC, Joint Venture (HPTJV) to provide design- build services for the replacement terminal project. A notice to proceed was subsequently issued to HPTJV the same day for Phase 1 (Preliminary State) of the project which involves construction spec ifications up to 60% completion and construction planning services.

On October 3, 2022, the Authority Commission designated the Adjacent Property as the site of the replacement passenger terminal and approved a Covenant and Environmental Restriction on Property (Land Use Covenant) for the Benefit of the Los Angeles Regional Water Quality Control Board (LARWQCB). The Land Use Covenant memorializes development and use restrictions imposed on the Adjacent Property by the LARWQCB. The Memorandum of Adjacent Property Replacement Passenger Terminal Selection was recorded with the County Registrar -Recorder on October 6, 2022, and the Land Use Covenant was recorded with the County Registrar-Recorder on December 5, 2022.

In November 2022, Jacobs began the process of meeting with various City departments and divisions to discuss various City requirements as they began to work with the design-build team to formalize a project schedule. The project applicant and staff met in March 2023 to discuss timelines for plan check submittal.

The Project was formally submitted into Plan Check under a new a ddress, 2827 N .

Hollywood Way, in September of 2023 and began demolition of the property in December of 2023. Other site preparation permits were issued in early 2024 for mass grading and site work. The remainder of the building permits, including permits for the new terminal structure, parking structure, Airline support facility, and utility/infrastructure upgrades are currently in Plan Check. All City Departments are diligently reviewing the project permits against the requirement in the Development Agreement and the Conditions of Compliance contained therein.

The PD/DA are set to expire February 7, 2037.

Mitigation Monitoring:

The Authority received LA County approval in 2018 of the Human Health Risk Assessment (HRRA) and conditional Federal Aviation Administration ( FAA) approval on the Airport Layout Plan (ALP) in 2020.

In 2018, the Authority began work on the Environmental Impact Statement (EIS) required under the National Environmental Protection Act (NEPA) and a Notice of Intent was released in December 2018. A 30- day public scoping period was held in early 2019 with two scoping meetings being held for the Agency and public to solicit input on the EIS. The Draft EIS was released for a 67-day public review and comment period starting on August 21, 2020, and ending on October 27, 2020. During the public ATTACHMENT 1-11

review and comment period, two virtual public workshops were held where the FAA provided a presentation about the project, the alternatives, and an overview of the impacts; and one public hearing was held to allow the public to provide oral comments.

In May 2021, the FAA issued a Final EIS and Record of Decision (ROD) for the proposed construction and operation of the 14-gate replacement passenger terminal.

As noted above, the Authority has selected both a project manager and design- build team for the project. City staff continues to monitor the project and compliance with the Mitigation Monitoring and Reporting Program (MMRP) that was approved as part of the DA and Final EIR.
