SPORTS LIGHTING, LLC. AND DELEGATING AUTHORITY

TO APPROVE PLANS AND SPECIFICATIONS FOR
EQUIPMENT TO UPGRADE THE EXISTING 1500 -WATT

METAL-HALIDE LIGHTING AT SCHAFER BALLFIELD TO

LIGHT-EMITTING DIODE TECHNOLOGY

THE COUNCIL OF THE CITY OF BURBANK FINDS:

A. Section 1205 of the Burbank City Charter and Burbank Municipal Code section 2-2-111 provide that the City Council may waive formal competitive bidding by resolution and approve alternate project delivery methods such as a “cooperative agreement” to award public works construction projects when it is in the best interests of the City.

B. The cooperative agreement delivery method allows the City to utilize another public agency’s bid, which includes language that the public agency is bidding on behalf of the member of the Cooperative, nationwide. This streamlines the project timeline as it reduces the cost of goods and services by aggregating the purchasing power of public agencies nationwide, and eliminates the extra time needed for a bid solicitation process.

C. The cooperative agreement delivery method is an acceptable and preferable method of procurement for ballfield lighting equipment and installation, as each manufacturer provides proprietary equipment. Musco has the only monitoring service of its kind. Musco’s Control -Link® delivers a sports lighting system that is managed with 24/7 support from a fully staffed Musco team. Control-Link makes scheduling, controlling, and monitoring from a mobile phone or desktop computer accessible.

D. The Schafer Ballfield lighting systems located at Ralph Foy Park need replacements to enhance lighting features and improve energy efficiency. As a result, the City’s Parks and Recreation Department (“Department”), solicited a proposal under a cooperative purchase agreement to select a firm to perform the replacement of the existing ballfield lighting systems at the Schafer Ballfield (“Project”).

E. The design- build project method has gained favor in the construction industry because it facilitates the coordination of civil, structural , and electrical engineering in all phases of project design and construction, minimizes change orders through early collaboration between design and construction disciplines, and reallocates design liability, project management , and other risks from the City to the selected contractor.
24-29,547
2 F. As a result, the Department desires to utilize the design- build project delivery method to complete the Project. The design-build method is both appropriate for this Project and in the best interests of the City due to the benefits outlined above. In furtherance of the Project, the Department, in conjunction with the Purchasing Manager, solicited a proposal from a design- build firm under an existing cooperative purchase agreement to complete the Project. A proposal was received by M usco Sports Lighting, LLC, and independently evaluated by City staff pursuant to the City’s normal competitive purchasing procedures.

THE COUNCIL OF THE CITY OF BURBANK RESOLVES:

1. Pursuant to Burbank Municipal Code section 2- 2-116(I) and (J), the City Council hereby approves performing the Project using the cooperative agreement method of project delivery. Accordingly, the City Council hereby waives the traditional competitive bidding process as outlined in Burbank Municipal Code § 2-2-116 as it is determined that the cooperative agreement delivery method accompanied by a competitive proposal solicitation process is in the best interests of the City.

2. The design-build contract between the City and Musco Sports Lighting, LLC (“Contract”), for the design and construction of replacement Schafer Ballfield Lighting, on file at the City Council Office and the Purchasing Division , are approved with such modifications as may be deemed appropriate by the City Manager or his designee.

3. This Project is categorically exempt from the California Environmental Quality Act (CEQA), pursuant to Section 15302 of the State CEQA Guidelines pertaining to replacement or reconstruction of existing structures and facilities, because the new ballfield lighting systems will be located on the same sites as existing ballfield lighting systems and will have substantially the same recreational purpose and capacity as the existing equipment.

4. The current total construction budget of the Project is estimated to be $464,041, but may be adjusted by the City Manager or his designee up to the total budgeted amount for the Project.

5. The City Manager or his designee is authorized to execute an agreement with MUSCO Sports Lighting, LLC for the replacement of the existing ballfield lighting systems at the Schafer Ballfield, and the City Clerk is authorized to attest.

24-29,547
3 6. The Cooperative Agreement shall be retained as a permanent record.

PASSED and ADOPTED this 27th day of August, 2024.
