1 Eff.: 06-09-2023 ORDINANCE NO. 23-3,992

AN ORDINANCE OF THE COUNCIL OF THE CITY OF

BURBANK AMENDING BURBANK MUNICIPAL CODE
SECTION 2-1-416 YOUTH BOARD

City Attorney’s Synopsis

Burbank Municipal Code (BMC) Section 2-1- 416 Youth Board contains the establishment, composition, terms and powers and duties of the City’s Youth Board. The amendments to this provision remove outdated language regarding Bellarmine Jefferson High School and David Starr Jordan Middle School and allow for greater flexibility in future appointment of qualified and interested Members to the Board by the Council.

The Council of the City of Burbank finds

A. B urbank Municipal Code Section 2-1-416, subsection A. Establishment and Composition of Board currently designates a student representative from Bellarmine Jefferson High School to be appointed to the Youth Board.

Bellarmine-Jefferson High School permanently closed in 2018 and is no longer operating. The amended language removes the Bellarmine -Jefferson appointment.

B. BMC Section 2-1-416, subsection A. Establishment and Composition of Board currently provides for six (6) members to be appointed to the Youth Board as “at-large members.” The amended language increases to seven (7) at-l arge members to account for the loss of the designated Bellarmine-Jefferson High School appointment.

C. BMC Section 2-1-416, subsection A. Establishment and Composition of Board currently does not indicate how a vacant designated school representative seat should be filled if a designated school is unable or chooses not to provide a representative. The amended language allow s for an additional at-l arge member to be appointed by Council to fill a ny vacant designated school representative seat.

D. BMC Section 2-1-416, subsection A. Establishment and Composition of Board is amended to change Jordan Middle School to Dolores Huerta Middle School based on the school’s official name change in 2021.

E. BMC Section 2-1-416, subsection A Establishment and Composition of Board is amended to indicate that all middle school representatives must be in either 7 th or 8th grade.

F. BMC Section 2 -1-416, subsection D School Members is amended to allow middle school and high school administrators to select qualified and interested ATTACHMENT 1

2 students to serve as Youth Board members, instead of utilizing an election system.

G. BMC Section 2 -1-416, subsection D School Members is amended to replace “junior high school” with “middle school,” to reflect current school titles.

H. This activity involves administrative amendments of the Burbank Municipal Code (BMC) and has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and as such, is not a “project” subject to the requirements of the California Environmental Quality Act (CEQA) 14 Cal. Code Regs § 15378.

The Council of the City of Burbank does ordain as follows:

1. Burbank Municipal Code Section 2-1- 416, subsection A Establishment and Composition of Board is amended to read as follows:
