A RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK APPROVING THE FINAL MAP OF TRACT NO.
83627 AND THE SUBDIVISION IMPROVEMENT
AGREEMENT RELATED THERETO BETWEEN PULTE
HOME COMPANY, LLC AND THE CITY OF BURBANK (921
WEST RIVERSIDE DRIVE)
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. In accordance with Burbank Municipal Code Section 11 -1-323 et seq., the Director of Community Development approved the Tentative Map for Tract No. 83627 , subject to the conditions set forth in the approval letter dated, October 25, 2022.
B. Final Tract Map No. 83627 is in conformance with the approved tentative map with respect to the lot boundaries as delineated on the enclosed tract map.
Easements for emergency services, waste collection, ingress and egress, roads, public utilities, and other public purposes pertaining to the lot shall be mapped and established through separate instruments in accordance with Burbank Municipal Code Section 11-1- 708. This tract map is in compliance with all applicable provisions of the local subdivision ordinances of the City of Burbank and the requirements set forth in Subdivision Map Act Section 66450(a)(1), (2), and (3).
C. Said Final Tract Map conforms to all the requirements of the Subdivision Map Act and of Title 11 of the Burbank Municipal Code.
D. All conditions proper to be performed before approval of such tract map have been fulfilled and accomplished. There are several outstanding conditions which have been itemized and incorporated within the proposed Subdivision Improvement Agreement for Tract Map 83627. Completion of the outstanding conditions will be guaranteed through bonds or other improvement security furnished concurrent with execution of the Subdivision Improvement Agreement.
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. The Final Tract Map for Tract No. 83627 is in substantial compliance with the approved Tentative Tract Map No. 83627.
2. The terms and provisions of the Subdivision Improvement Agreement between Pulte Home Company, LLC and the City of Burbank (“Agreement”) are approved. The City Manager, or hi s designee, is authorized to sign the Agreement on behalf of the City, and the City Clerk shall attest the signature. The City Attorney and the City Manager are further authorized to the extent necessary during the implementation of the Agreement, to make minor changes after execution, provided that said changes shall not in any manner materially affect the rights and obligations of the City. 2 3. All City conditions imposed in connection with the approval of the Tentative Map have been satisfied, or performance of the conditions are secured through the aforementioned Subdivision Improvement Agreement.
4. This Council hereby approves the Final Map of Tract No. 83627, in the City of Burbank.
5. The City Clerk is hereby directed to execute a certificate stating that this Council has approved the Tract Map No. 83627.
6. The Public Works Director is authorized to approve the Improvement Plan, which shall be submitted prior to any work under the Agreement.
