1 RESOLUTION NO.
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK AUTHORIZING AN AMENDMENT TO
INCREASE THE COST TO BID SCHEDULE NO. 1508 –
PROVIDENCIA SEWER PROJECT PHASE 2, IN THE
AMOUNT OF $ 2,340,000; AMEND THE FISCAL YEAR
2024/25 BUDGET TO APPROPRIATE SUCH FUNDS; AND
AUTHORIZE THE PUBLIC WORKS DIRECTOR TO
EXECUTE THE AMENDMENT
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. In an effort to properly plan for future development and provide the anticipated sewage conveyance capacity within the City of Burbank (“City”), the Public Works Department completed a Sewer System Master Plan in 2006 (“Sewer Master Plan”).
B. As part of the Sewer Master Plan, the City executed Bid Schedule No. 1508 for the Providencia Sewer Improvement Project, Phase 2 (“Project”) to provide 1,500 feet of new parallel or upsized sewer pipe.
C. City Council, pursuant to Bid Schedule 1508, awarded the contract in an amount of $2,820,596.00, which included a 15% construction contingency in an amount of $367,903.50 to Creative Home/ DBA Chi Construction (“Contractor”) on November 15, 2022. City Council further made a finding that this project was categorically exempt under the California Environmental Quality Act (CEQA).
D. To date, approximately 200 feet of pipe remains to be installed to complete the project. This requires a new steel casing to be jack -and-bored within an existing steel casing that goes underneath both the railroad tracks and the I-5 Freeway.
E. The Project was originally slated to be completed in July 2023, however, significant delays and additional costs have accumulated primarily due to six (6) utility conflicts that were either unmarked, were at different locations/depths from record drawings, or that required verification by the respective utility companies. These utility conflicts include two parallel abandoned Southern California Gas lines, an abandoned private sewer lateral, a live fiber optic line, an abandoned Burbank Water and Power electrical conduit, and a live 20-inch oil pipeline.
F. Upon discovering these conflicting utilities, Burbank Public Works Department (“Public Works”) contacted each utility provider to discuss the Project and obtain approvals to remove and/or relocate the utilit ies. As a result, significant delays occurred in progression of the Project.
G. Most significantly, the oil pipeline was located within the Southern California Regional Rail Authority (SCRRA) right-of-way. To resolve this conflict, the

2 City’s design consultant proposed to excavate in the SCRRA right-of-way beyond the oil pipeline at the edge of the existing steel casing. After the revised plans were approved by SCRRA and after excavation occurred, PW was unable to locate the existing steel casing.
H. Upon excavation, a sewer bypass was required to be installed to prevent the disruption of sewer services. The sewer bypass requires 24/7 observation due to the large flow being conveyed, which has continued to increase the cost of services under the Project.
I. Due to the above unforeseen conditions, City Council, pursuant to Bid Schedule 1508, approved Contract Amendment No. 1 to increase the budget of the project by $3,968,363.72, under resolution 24-29,549
, on August 27, 2024.
J. Public Works prepared updated shoring plans for additional potholing activities closer to the railroad tracks that required special review and approval from SCRRA for the work in their right of way. SCRRA granted approval and completed the Communications and Signal ( C&S) marking on November 14, 2024, well after the estimated approval date of late September 2024 that was anticipated by the City ; the additional potholing was completed on Saturday, November 16, 2024, to confirm the exact location of the edge of the existing steel casing. A specialized shoring solution has been designed and submitted to SCRRA for their complex review and approval process. Once approved by SCRRA, the final segment of construction work can occur to complete the Project.
K. Due to the unforeseen conditions and SCRRA’s extensive permit review times for proposed design solutions, the Project cannot be completed under the current budgeted amount. It is estimated that an additional $2,340,000 will be needed to complete the Project.
L. Public Works currently has existing funds to cover the cost of the second amendment in account 494.ND000.30011.0000.000000.00000 Water Reclamation and Sewer Fund.
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. An amendment to increase the cost to Bid Schedule 1508 is hereby authorized in the amount of $2,340,000.
2. Fiscal year 2024- 25 budget shall be amended to appropriate $2,340,000 from 494.ND000.30011.0000.000000.00000 Water Reclamation and Sewer Fund, Non- Departmental Assigned Fund Balance to the Project’s expenditure account number 494.PW23C.15032.19260.0000 (Water Reclamation and Sewer Plant Operations & Maintenance Infrastructure Work – Sanitary Sewer Repairs/Upgrades).
