1 STAFF REPORT

DATE: February 11, 2025

TO: Justin Hess, City Manager

FROM: Ken Berkman, Public Works Director
VIA: Lifan Xu, Chief Assistant Public Works Director-City Engineer BY: Jose Rodriguez, Civil Engineering Associate

SUBJECT: Adoption of a Resolution Approving a Cooperative Agreement with Wyatt Trapp, Inc. for the City Attorney Office Reconfiguration Project

RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK APPROVING A COOPERATIVE AGREEMENT WITH WYATT TRAPP, INC. AND AUTHORIZE THE

PUBLIC WORKS DIRECTOR OR HIS DESIGNEE TO APPROVE ANY CHANGES TO

FINAL PLANS AND SPECIFICATIONS FOR THE CITY ATTORNEY OFFICE RECONFIGURATION PROJECT (Attachment 1).

BACKGROUND
The City Council (Council) approved the City Attorney Office Reconfiguration Project (Project) as part of the Fiscal Year (FY) 2024- 25 Adopted Budget and Capital Improvement Program. The purpose of this project is to reconfigure space in the City Attorney’s Office to create additional offices and work areas to accommodate staff hired to implement new and expanded programs, including the Housing Enforcement Program.

DISCUSSION
The design and technical specifications were completed, and plan check was approved in December 2024. Construction services are being procured through a Cooperative Agreement alternate delivery method (Co-op). By using a Co-op, the City is able to utilize another public agency’s competitive bid process that includes bidding language on behalf of the members of the nationwide Co- op. This method is ideal for small construction projects as it reduces the cost of goods and services by aggregating the purchasing power of public agencies nationwide. The procurement and/or construction agreements are awarded to those companies providing the best value. Utilizing a Co-op eliminates much of the bid processing time and is a preferable method for furnishing management, labor, materials, equipment, and incidental design support. Specifically for this Project, staff can select the design and items that best suit the City Attorney Office’s needs while still receiving the benefit of nationwide pricing.

PUBLIC
WORKS

2 Staff recommends executing the cooperative purchasing process via Sourcewell’s Indefinite Delivery Indefinite Quantity (IDIQ) construction contracts . Under Burbank Municipal Code § 2-2-116, subdivisions (I) and (J), Council shall waive the requirement for competitive bidding by Resolution finding that it is in the best interest of the City and award the contract to the proposer offering the Best Value as more fully defined in the solicitation.

Wyatt Trapp, Inc. (Wyatt Trapp), a local Burbank company, is the selected vendor and an approved supplier of cooperative purchaser Sourcewell . Wyatt Trapp has met all the requirements and expectations of the Public Works Department and the City and is utilizing a contract established by Sourcewell’s cooperative agreement (Attachment 2 ).

The Gordian Group, Inc. (Gordian) is Sourcewell’s designated representative and contract administrator for the cooperative agreement. Gordian’s support includes preparing Construct ion Task Catalogs and related technical specificati ons, providing information management systems, providing training for contractors, administering fee collection, and assisting with proposal or work order development.

Design Immunity
Staff recommends Council approve the final plans and specifications to invoke design immunity protection under California Government Code § 830.6. Any changes in the final plans and specifications may be approved by the Public Works Director and/or City Engineer under the authority conferred through BMC § 2-2-104.

ENVIRONMENTAL REVIEW
This Project is categorically exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to § 15302 of the State CEQA Guidelines, which allows for replacement or reconstruction of existing structures and facilities, where the new structures and facilities will be located on the same site and will have substantially the same purpose and capacity as the structures and facilities being replaced. Staff recommends Council find the Project exempt from CEQA.

FISCAL IMPACT
The total construction contract price is $234,865.46 (Attachment 3). The Project was approved as part of the FY 2024-25 Adopted Budget, and sufficient funds are available in the following project account: 534.PW33A.70019.0000.24982 (Municipal Infrastructure Fund, City Attorney Office Reconfiguration).

CONCLUSION
The completion of this Project will provide sufficient offices and work areas for new staff hired to implement new and expanded programs and create a more efficient and modern work environment within the City Attorney’s Office. The Project is slated to be completed by May 2025.
