SUBJECT: Adoption of a Resolution Authorizing the Submittal of an Application to the California Department of Resources Recycling and Recovery for the Rubberized Pavement Grant Program
RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK AUTHORIZING
SUBMITTAL OF APPLICATIONS TO THE CALIFORNIA DEPARTMENT OF
RESOURCES RECYCLING AND RECOVERY (CALRECYCLE) FOR ALL CALRECYCLE GRANTS FOR WHICH THE CITY OF BURBANK IS ELIGIBLE.
BACKGROUND
CalRecycle’s Rubberized Pavement Grant Program promotes the use of recycled-content surfacing products derived from waste tires generated in California. This encourages the diversion of waste tires from landfill disposal, discourages illegal tire dumping, and promotes markets for recycled-content tire products. Rubberized pavement designs are more environmentally friendly and include up to 20% recycled asphalt aggregate, as well as 20% crumb rubber derived from shredded used tires.
The Public Works Department (Department) has applied for various grants via CalRecyle over the years. Procedures for administering the CalRecycle Rubberized Pavement Grant Program require an applicant’s governing body to pass a resolution authorizing the submittal of the grant application. The most recent resolution passed by City Council was Resolution No. 18-29, 044, which was adopted on October 16, 2018, and allowed for the submittal of grant applications for a period of five years. On October 12, 2022, the Department submitted an application for the Fiscal Year (FY) 2022-23 Rubberized
Pavement Grant Program from CalRecycle and was awarded $249,880 for the City’s resurfacing project.
DISCUSSION
On February 25, 2025, CalRecycle informed the Department that the City’s previous CalRecycle Grant Submittal Resolution (No. 18-29,044) had expired and an updated approved resolution would be required (by April 1, 2025) in order to be reimbursed the FY 2022-23 funds in the amount of $249,880 and to apply for future grants.
The adoption of the proposed resolution would provide the City Manager or his/her designee the authorization to execute all documents necessary to submit a CalRecycle Rubberized Pavement Grant Program application and secure payment if successful, including but not limited to the grant agreement, any amendments, and requests for payment. In addition, the proposed resolution would allow the City to submit grant applications for any and all future payment programs offered by CalRecycle over the next five years and similarly authorize the City Manager or his/her designee to execute all grant- related documents with CalRecycle for future awards, unless City Council approval is otherwise required by the Burbank Municipal Code.
ENVIRONMENTAL REVIEW
Adoption of this resolution is categorically exempt under the California Environmental Quality Act (CEQA), 14 CCR §15301, which exempts the operation, repair, maintenance, and minor alteration of existing public structures and facilities (including sidewalks) that involve negligible or no expansion of existing or former use. This project includes the repairing and maintenance of existing streets for public right of way purposes, and there are no exceptions or unique circumstances that apply that would affect the application of this exemption.
FISCAL IMPACT
The City was awarded $249,880 in grant funding for FY 2022-23, which allowed for the resurfacing of approximately three to five residential city blocks. The awarded grant funds will be provided on a reimbursement basis and no matching funds are required.
CONCLUSION
Staff respectfully recommends Council adopt the proposed Resolution authorizing the submittal of grant applications between the City of Burbank and CalRecycle, most notably the finalization of the FY 2022-23 Rubberized Pavement Grant Program application, which will need to be updated for reimbursement purposes, and authorize the City Manager or his designee to execute all necessary grant applications and grant documents.
