Supplemental Agreement- Mariposa Tree Management, Inc.
FIRST AMENDMENT
TO CITY OF BURBANK SUPPLEMENTAL AGREEMENT DATED NOVEMBER 1, 2024
FOR TREE MAINTENANCE SERVICE
This First Amendment to City of Burbank Supplemental Agreement (“First Amendment”) is made on ___________ (“Effective Date”) by and between the CITY OF BURBANK (“City”), a California municipal corporation and charter city, and MARIPOSA TREE MANAGEMENT, INC. (“Contractor") (collectively, the “Parties”).
RECITALS
A. As a result of a Request for Proposal (“RFP”) issued by the City of Port Hueneme, a municipal corporation, County of Ventura, the City of Port Hueneme awarded a contract for tree management and tree maintenance to Mariposa Tree Management, Inc. (“Contract”) dated September 5, 2023.
B. The City and Contractor entered into a Supplemental Agreement (“Supplemental Agreement”) on November 1, 2024, for tree trimming and maintenance pursuant to Public Contract Code § 10298 which authorizes a local agency to contract with suppliers awarded contracts through a competitive bidding process with another State or local public agency.
C. Due to recent weather events, the parties hereby desire to amend the compensation of the Supplemental Agreement to account for the additional needs of the City to address tree trimming and maintenance.
AMENDED TERMS
1. INCORPORATION OF TERMS AND CONDITIONS. Except as expressly stated in this First Amendment, the Parties hereby adopt all terms and conditions set forth in the Contract dated September 5, 2023, and the Supplemental Agreement dated November 1, 2024.
2. COMPENSATION AND BILLING
Section 2.1 Compensation shall be amended as follows:
Contractor shall be paid in accordance with the fee schedule set forth in Exhibit “C”, attached to the Supplemental Agreement dated November 1, 2024. (the “Fee Schedule”). The total Contract amount shall not exceed $3,286,000.
3. RATIFICATION OF TERMS
All other provisions of the Supplemental Agreement and any amendments thereto, not inconsistent with this First Amendment, shall remain in full force and effect and are specifically incorporated herein.
In recognition of the obligations stated in this First Amendment, the parties have executed this First Amendment on the date indicated above.
