In addi
tion to those matters disclosed and agreed upon by the City of Burbank as set forth in the City Waiver , the undersigned on behalf of the City of Burbank hereby additionally agrees to the following:
1. That B
WS may continue to represent Metro in the Metro Matters (as those terms are defined in the Waiver).
2. That
Alan Sozio will not work on and will be ethically separated from the Eminent Domain Action (as that term is defined in the Waiver) to the extent that such work involves Metro.
3. That BW
S will not represent the City of Burbank in any litigation, arbitration or mediation against or adverse to Metro, and will not represent Metro against or adverse to any litigation, arbitration or mediation against the City of Burbank.
