SUBJECT: Approval of a First Amendment to a Supplemental Agreement with Mariposa Tree Management, Inc. to Increase the Cost For Tree Maintenance

RECOMMENDATION
Approve a First Amendment to a Supplemental Agreement with Mariposa Tree Management, Inc. (Mariposa) to increase the cost of services for tree maintenance in an amount of $786,000 (Attachment 1).

BACKGROUND
The City of Burbank (City) maintains approximately 3 3,000 public trees throughout parkways, parks, and other public spaces. These trees serve as a critical component of the City’s infrastructure, providing numerous environmental, economic, and social benefits including improved air quality, reduced urban hea t, enhanced property values, and increased biodiversity.

The care and preservation of Burbank’s urban forest is managed by the Parks and Recreation Department (Department). Due to the scale and complexity of maintaining such a large number of trees, the City supplements in -house resources by contracting with a professional tree service provider.

To ensure continued service delivery , the City entered into a Supplemental Agreement with Mariposa Tree Management, Inc. (Mariposa) on November 1, 2024 (Attachment 2), for tree maintenance services. This agreement was executed pursuant to Public Contract

2 Code § 10298, which allows local agencies to contract with vendors who have been awarded contracts through a competitive procurement process conducted by another public agency. In this case, the City of Port Hueneme awarded a contract to Mariposa on September 5, 2023 (Attachment 3).

The agreement with Mariposa enables the City to ensure timely and efficient delivery of essential services such as tree trimming, removals, and emergency response. This partnership allows the City to keep pace with ongoing tree maintenance needs while supporting public safety, environmental sustainability, and the long -term health of Burbank’s urban canopy.

DISCUSSION
Due to recent storm activity and associated weather -related impacts, the City has experienced an increased demand for tree maintenance services in order to maintain public safety and preserve infrastructure. The City requested Mariposa to deploy additional crews to address the maintenance backlog, respond to citizen requests, and prioritize high-importance trees. More crews were also necessary to maintain the regular trimming schedule and address weather related emergency tree work. In light of these developments, additional funding capacity is necessary to meet service needs in a timely and efficient manner.

The proposed First Amendment maintains the original scope, performance standards, and terms of the existing agreement , while increasing the cost of services by $786,000, addressing approximately 2,351 trees, and resulting in a total not -to-exceed contract amount of $3,286,000. This adjustment ensures the City is adequately resourced to respond to increased maintenance demands and continue providing high-quality care for its urban forestry assets.

ENVIROMENTAL REVIEW
This project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) in accordance with Article 19, § 15301 (h) as it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existin g or former use. This exemption includes the maintenance of existing landscaping.

FISCAL IMPACT
There is no fiscal impact associated with this report, as sufficient funding is available within the Fiscal Year 2024-25 Adopted B udget to support the proposed First Amendment. The total amount of the First Amendment is $786,000, which will be funded from account s 534.PR21A.62170.1010 (Tree Trimming Services) and 001.PR22A.62170.1001 (Private Contractual Services – Temporary Staffing).

3 CONCLUSION
Staff recommends that the City Council approve the First Amendment to the Supplemental Agreement with Mariposa Tree Management, Inc. The amendment allows the City to proactively address tree maintenance needs and increased emergency responses as it continues to prioritize the safety and well-being of the community and its natural environment.
