RESOLUTION NO. ____________
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK EXTENDING AN AGREEMENT WITH PAVECO
CONSTRUCTION, INC. FOR ON- CALL STREET REPAIR
SERVICES PREVIOUSLY AWARDED UNDER BID
SCHEDULE NO. 1480
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. The City’s Burbank Water and Power Department is responsible for installing and maintaining the City's water, electric, and fiber optic infrastructure within the public right -of-way. BWP frequently excavates City streets for the construction and upkeep of these essential services throughout the year. To ensure timely restoration of affected pavement, a contractor must be retained and available to perform repairs as needed to restore the affected pavement after the installation has been completed.
B. Under the Charter (section 1205) and the Burbank Municipal Code (section 2-2-116), the City Council may approve contracts greater than $200,000 and waive the requirement for competitive bidding by a resolution finding that doing so provides the City the best value and is in the best interest of the City.
C. Paveco Construction, Inc. (“Paveco”) has been the City’s paving contractor that provides such services for several years. Their services were competitively bid and provided under a previously awarded agreement (Agreement) that that the City determined was the best value and in the best interest of the City.
D. Based upon the staff report and the evidence provided to the City Council, the City Council finds approval of a one-year amendment to the current Agreement (First Amendment) to still be the best value and in the best interest of the City, due to the contractor’s competitive pricing and the City’s need for immediate work to maintain public facilities in a safe and orderly condition. The City Council desires to approve and authorize the City Manager and the Burbank Water and Power General Manager to execute the First Amendment that allows Paveco to continue pavement restoration and other street-related improvement work for another year.
E. The work subject to this resolution is related to the operation, repair, maintenance, or minor alterations of existing public facilities, and no exceptions to categorical exemptions appear to apply. A s street maintenance projects that do not expand any existing use of the public facilities, such activity is categorically exempt under the California Environmental Quality Act (CEQA) Guidelines. (14 CCR §15301.)
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. To approve this First Amendment.
