Attachment 5 – Survey of Neighboring Jurisdictions

Staff reviewed the zoning codes of other local jurisdictions, such as Arcadia, South Pasadena, Pasadena, Glendale, Los Angeles County, West Hollywood, Beverly Hills, and Long Beach, and found that of the eight surveyed cities, five have procedures in place to for minor modifications of existing conditional use permits.

The County of Los Angeles offers a process called “Minor Modification or Elimination of Conditional Use Permit Conditions.” This process allows applicants to request changes or eliminations of conditions of approval from an already approved CUP without applying for an entirely new CUP application. The process may be used when t he proposed change does not result in a substantial deviation from the original conditions and is necessary to support the reasonable use of the property as previously approved. These requests are subject to discretionary review by a Hearing Officer, who m ust determine whether the necessary findings can be made to approve or deny the modification.

However, Los Angeles County’s process also includes specific limitations on what can be modified. Prohibited changes include altering an approved alcohol license; increasing shelf space for alcohol; any modification requiring further environmental review under CEQA; significant alterations or material deviations from the previously approved conditions; changes to mandatory conditions; changes to development standar ds that would require a variance; or extensions of the use period, grant term, or expiration date.

The City of West Hollywood also has a similar approach. There, the Community Development Director has the authority to approve, modify, or deny minor changes to an approved land use permit. The Director also determines whether a proposed change qualifies as minor or major. If deemed major, the request must go through the same review process as the original permit and be considered by the original review authority.

To make this determination, the Director uses a set of criteria, or “triggers,” which include factors such as significant neighborhood or environmental impacts, substantial changes to the approved use or design, or any change affecting the basis for the project’s environmental review or original approval findings.

Other cities, such as Long Beach, Pasadena, and Beverly Hills, have similar processes that allow for minor modifications to existing land use permits, provided the changes do not result in significant deviations from the original approval.
