2 DISCUSSION
The Project includes the following improvements:

 Repair concrete cracking and spalling, including sealing of concrete surfaces;  Repair and replace worn and broken stairwell metal work;  Repaint the garage interior and first floor exterior façade;  Repair and replace signage with updated wayfinding; and  Clean and restripe garage interior.

The design and technical specifications have been completed and a building permit has been obtained. Staff recommends that construction services be procured through a Cooperative Agreement alternate delivery method (Co-op), which allows the City to utilize another public agency’s competitive bid process that includes bidding language on behalf of the members of the nationwide Co-op. This method is ideal for small construction projects as it reduces the cost of goods and services by aggregating the purchasing power of public agencies nationwide. The procurement and/or construction agreements are awarded to those companies providing the best value. Utilizing a Co-op eliminates much of the bid processing time and is a preferable method for furnishing management, labor, materials, equipment, and incidental design support. Specifically for this Project, staff can select the design and items that best suit the City’s needs while still receiving the benefit of nationwide pricing.

Staff recommends executing this Co-op via Sourcewell’s Indefinite Delivery Indefinite Quantity (IDIQ) construction contracts. Under Burbank Municipal Code (BMC) § 2-2-116, subdivisions (I) and (J), Council shall waive the requirement for competitive bidding by Resolution finding that it is in the best interest of the City and award the contract to the proposer offering the Best Value as more fully defined in the solicitation.

Mackone Development Inc. (Mackone), a local Los Angeles company, is the selected vendor. Mackone has met all the requirements and expectations of the City and is utilizing a Sourcewell contract for the Co-op (Attachment 2). The Gordian Group, Inc. (Gordian) is Sourcewell’s designated representative and contract administrator for the cooperative agreement. Gordian’s support includes preparing construction task catalogs and related technical specifications, providing information management systems, providing training for contractors, administering fee collection, and assisting with proposal or work order development.

Council’s approval of the plans and specifications provides design immunity protection under California Government Code § 830.6. Any changes in the final plans and specifications may be approved by the Public Works Director and/or City Engineer under the authority conferred through BMC § 2-2-104.
3 ENVIRONMENTAL REVIEW
This Project is categorically exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to § 15302 of the State CEQA Guidelines, which allows for replacement or reconstruction of existing structures and facilities, where the new structures and facilities will be located on the same site and will have substantially the same purpose and capacity as the structures and facilities being replaced. Staff recommends Council find the Project exempt from CEQA.

FISCAL IMPACT
The construction contract price is $927,334.52 (Attachment 3). The Project budget with the standard 10% contingency is $1,020,068. The Project was approved as part of the FY 2024-25 Adopted Budget and sufficient funds are available in the following two project accounts: 534.PW32A.70019.0000.22365 (Municipal Infrastructure Fund, Orange Grove Parking Structure) and 310.PW22F.70019.0000.22365 (Parking Authority Fund).

CONCLUSION
Council recently approved a Parking Management program for on-street parking spaces in Downtown Burbank that ensures reinvestment of a portion of the revenues back into Downtown parking assets. This reinvestment will enhance the City’s ability to proactively maintain parking structures and complete related improvement projects in Downtown.

Staff respectfully recommends that Council adopt the proposed resolution to approve the cooperative agreement with Mackone to restore, repair, and paint the Orange Grove Parking Structure. With Council approval, the Project is slated to commence in August 2025 and be completed by November 2025.
