RESOLUTION NO. ____________
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK APPROVING A PROFESSIONAL SERVICES
AGREEMENT WITH PACIFIC ADVANCED CIVIL
ENGINEERING, INC. FOR PHASE 1 DESIGN SERVICES
FOR THE SEISMIC RETROFIT OF WATER PIPELINES
PROJECT
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. The City of Burbank, through Burbank Water and Power (BWP), was awarded a $16.1 million grant from the Federal Emergency Management Agency (FEMA) under the Hazard Mitigation Grant Program (HMGP) to seismically retrofit approximately 30,000 linear feet of aging water pipelines that traverse the Verdugo Fault.
B. The project is divided into two phases: Phase 1 (Design), with a federal share of $1,201,410 and a City match of $133,490; and Phase 2 (Construction), with a federal share of $12,050,550 and a City match of $1,338,950.
C. Initial project planning and data collection began in 2021. A complete FEMA grant application, including a Benefit -Cost Analysis (BCA), was submitted in May 2022.
Formal grant approval was received in December 2023.
D. In accordance with FEMA’s procurement requirements, BWP conducted a federally compliant and competitive Request for Proposals (RFP) process. A second RFP issued in April 2024 resulted in five proposals. In July 2024, Pacific Advanced Civil Engineering, Inc. (PACE) was selected as the highest-ranked firm based on qualifications and proposal strength.
E. Following updated cost projections from PACE indicating that the full replacement of all 34 pipeline segments would exceed available funding, BWP coordinated with the California Governor’s Office of Emergency Services (CalOES) in August 2024 to revise the project scope. CalOES approved the revised concept in September 2024, which focuses on the replacement of the seven most critical pipeline segments. A Purchase Order was issued in December 2024 to PACE to complete a Value Engineering Study, which was final ized in April 2025 and confirmed the revised scope maintains a Benefit-Cost Ratio (BCR) greater than 1.0, thus preserving FEMA eligibility.
F. To accommodate the one- year design schedule and maintain eligibility under the expiring HMGP grant program, BWP submitted a formal Time Extension Request to CalOES on May 20, 2025, seeking to extend the grant deadline from October 31, 2025, to January 31, 2027. Additional supporting documentation was revised and resubmitted on June 6, 2025, following feedback received during a meeting with CalOES ATTACHMENT 1

on June 3, 2025. At that meeting, CalOES advised that FEMA’s review process may take three to six months and confirmed that the grant program expires on January 31, 2027.
G. To maintain project momentum for Phase 1 and avoid unnecessary delay, BWP recommends proceeding with obtaining Council approval for the funding and execution of the Professional Services Agreement (PSA) and issuance of a Purchase Order (PO) to PACE in advance of FEMA’s final decision on the pending time extension request. The PSA and PO would be conditionally approved upon FEMA’s acceptance of the time extension. If FEMA ultimately denies the request, the PSA and PO will be canceled with no financial obligation to the City.
H. Under the Burbank Municipal Code, Section 2- 2-102.C, City Council approval is required for certain professional services agreements in excess of $100,000.
The City Council desires to authorize approval of the proposed PSA with PACE, and the accompanying PO, that is conditioned upon FEMA funding.
I. The design work covered under Phase 1 qualifies as categorically exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Section 15306 of the CEQA Guidelines (14 CCR §15306), as it involves data collection and planning studies with no potential for serious disturbance to environmental resources.
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. The City Council hereby conditionally approves the execution of a PSA with PACE, subject to FEMA’s approval of the time extension, for Phase 1 Design Services for the Seismic Retrofit of Water Pipelines Project in the amount of $1,007,447, and any related POs necessary to pay for such PSA.
2. The General Manager of Burbank Water and Power, or their designee, is authorized to:
A. Finalize, award, and execute the PSA, upon receipt of, or conditioned upon, successful FEMA funding, and subject to approval as to form by the City Attorney’s Office; and
B. Execute any ancillary documents or amendments necessary to implement the agreement, as approved by the City Attorney’s Office, provided additional funds are available and appropriated.
3. The General Manager of Burbank Water and Power, or their designee, is further authorized to review and, in their discretion, approve the plans and specifications developed under this PSA as necessary to carry out this project.
