RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK APPROVING
CONTRACT DOCUMENTS, PLANS AND SPECIFICATIONS , AND AUTHORIZING EXECUTION OF A CONTRACT FOR BID SCHEDULE NO. 1 527 – 2023-24 ANNUAL
RESIDENTIAL PAVEMENT REHABILITATION PROJECT TO TORO ENTERPRISES, INC., (Attachment 1).
BACKGROUND
The third phase of the Citywide Annual Residential Street Rehabilitation Program (Project) will improve roadways rated “poor” or “very poor” (Pavement Condition Indexes of 55 or lower) in the neighborhoods bounded by Amherst Dr ., Buena Vista St., Victory Blvd., and the City limit at Scott Rd ., in zones 15 through 18 (Attachment 2). The work also includes minor removal and reconstruction of damaged or substandard curbs, gutters, sidewalks, driveways, and pedestrian ramps.
DISCUSSION
Bid Schedule No. 1527 was advertised on April 30, 2025 and May 7, 2025. A bid opening was held on May 22, 2025. Five contractors submitted bids ranging from $7,465,321 to $8,913,300 (Attachment 3 ). The lowest bid of $7,465,321 was submitted by Calmex
2 Engineering, Inc., however, they recently requested to withdraw their bid, citing a clerical error on their part. The City’s Purchasing Division and Public Works staff reviewed the withdrawal request and confirmed that it was an inadvertent clerical error per California Public Contract Code 5103 . With consent of the City Attorney’s office, staff recommend Council approve their withdrawal as part of the resolution adoption. Therefore, Toro Enterprises, Inc. of Oxnard , California, has the next lowest responsive and responsible bid of $7,631,227, which is about 17% over the engineer’s estimate of $6,500,000. Toro Enterprises, Inc. has previously performed similar work for the City with satisfactory results.
If approved by Council, c onstruction is expected to commence in September 2025 and end in April 2026. As with all Public Works bid schedules affecting the public right-of-way, the contractor is required to coordinate with potentially affected local businesses, schools, and residents , and must provide notification in writing at least five working days in advance of the start of construction in each specific area.
The Project will use Asphalt Rubber Hot Mix (ARHM), which is a special blend of asphalt that uses crumb rubber from recycled tires . Given the approximate ly twelve miles of paving slated for the Project, about 84,000 discarded tires will be diverted from landfills.
Project plans and specifications are available for review at the Public Works Department, located at 150 N. Third St ., Burbank, California , and the City C lerk’s Office at Burbank City Hall, located at 275 E. Olive Ave., Burbank, California.
ENVIRONMENTAL REVIEW
Adoption of this resolution is categorically exempt under the California Environmental Quality Act (CEQA), 14 CCR § 15301, which exempts the operation, repair, maintenance, and minor alteration of existing public structures and facilities (including sidewalks) that involve negligible or no expansion of existing or former use. This project includes the repairing and maintenance of existing streets for public right of way purposes, and there are no exceptions or unique circumstances that apply that would affect the application of this exemption.
FISCAL IMPACT
The projected construction cost for the Project (construction bid plus 10% contingency) is $8,394,350. Sufficient funds are available in the following project accounts:
• 108.PW21A.70002.0000.24820 (Measure M , Street Design & Construction Improvements – FY 23-24 Annual Residential Pavement Rehab) • 123.PW21A.70002.0000.24820 (SB-1, Street Design & Construction Improvements – FY 23-24 Annual Residential Pavement Rehab) 3 • 370.PW21A.70002.0000.24820 (General City Capital Improvements , Street Design & Construction Improvements – FY 23-24 Annual Residential Pavement Rehab)
