1. Award the Bid Proposal from Mountain Cascade, Inc. in the amount of $40,690,908.04.
2. Authorize City Manager to Sign Construction Agreement between the City of Calexico and Mountain Cascade, Inc. in the amount of $40,690,908.04 for the New River Improvement Project - Calexico Reach.

Background:
The New River is a Water of the United States and a California Water. It originates approximately 18 miles south of the US-Mexico Border, in the Mexicali Valley, Mexico. It enters the United States by the Calexico West Port of Entry, in Calexico, California. The City is proposing to implement New River Improvement AGENDA Project - Calexico Reach. The Project consists of three primary ITEM components:
14 1. Trash screen and diversion structure for the New River downstream from the International Boundary with Mexico.
Bypass encasement infrastructure for the New River from a point downstream of the International Boundary to a point downstream of the eastern boundary of the City of Calexico to address the public health threat that new River water quality poses to the southern area of the city.
3. A pump-back system to take treated wastewater from the existing Calexico Waste Water Treatment Plant (WWTP) and discharge it into the New River channel at a point near the proposed river diversion and encasement structure.
Milestones:
Project's Initial Funding from California Department of Water Resources On November 18, 2020, the City Council of the City of Calexico adopted Resolution 2020- 52, which in substantive part accepted twenty-eight million dollars ($28,000,000) of grant funds from the California Department of Water Resources (DWR) to build the New River Improvement Project - Calexico Reach (Project). The provided funding was based on the Opinion of Probable Project Cost prepared by Michael Baker International prepared for the Project in 2018 as part of its plans and specifications for the Project.
Funding Agreement #4600014089
April 26, 2021, the City of Calexico entered into Funding Agreement # 4600014089 with the California Department of Water Resources (DWR) for the disposition of twenty-eight- million dollars ($28,000,000) of state funds to build the Project. Of this amount, twenty- three million, seventy-ninety-five thousand dollars are set aside for construction of the Project. The rest of the money is set aside for Project administration, environmental compliance and permitting, and construction contracting and administration.
Project Permitting, Due Diligence, and Final Plans and Specifications Since the execution of the Funding Agreement with DWR, the City's efforts focused on finalizing the plans and specification for building the Project and obtaining the required permits to build the Project, including all environmental permits. In April 2022, the City obtained the necessary pre-construction permits to start building the Project and finalize the Project's plans and specifications to bid the Project. 1st Invitation for Bids
On May 16, 2022, the City issued, and the Imperial Valley Press published an Invitation for Bids for the construction of the Project. On June 28, 2022, the City received only one bid-from Mountain Cascade, Inc.—to build the Project at a cost of forty-one million, seven-hundred and thirty-four thousand, and six-hundred and seventy-six dollars ($41,734,276). On July 28, 2022, because the bid received significantly exceeded the available funding to build the Project, and without prejudice to the bidder, the City Council of the City of Calexico rejected the bid, during a public meeting, to allow for state funding partners to provide additional funding to implement the Project in its totality. It also directed the City staff to draft a new Invitation for Bids, with changes/provisions to implement the Project in Phases, as needed, and ensure the full amount of funding is available in a timely manner to implement the Project in its totality. 2n° Invitation for Bids
On August 10, 2022, in a Special City of Calexico Council public meeting, City staff presented a new Invitation for Bids for the Project as requested by the Council. The new Invitation for Bids, in relevant part, proposed to implement the Project in two Phases, with Phase 1 consisting of building the Trash Screen and Diversion Structure and Pump-back System; and Phase 2 consisting in the installation of the 72-inch bypass pipe; its energy dissipater, and stabilization and erosion control of an area at the western end of the Project. During the meeting, the City Manager informed the Council that, just before the Council meeting, DWR provided comments to City staff on the new Invitation for Bids.
The Council approved this new Invitation for Bids but directed the City staff to address the DWR comments before it issued and published the Bid.
The City staff and its Project consultants worked closely with the staff from DWR to address DWR's comments as directed by the Council. Additionally, City staff and its Project consultants worked closely with representatives of the State Water Resources Control Board (SWRCB), California Environmental Protection Agency (CalEPA), California Natural Resources Agency (CNRA), DWR, and elected officials to secure sufficient funding to build the Project in its totality as directed by the City Council.
On October 17, 2022, after addressing the DWR comments, the City issued the new IFB, hereafter referred to as "October 2022 new IFB." Michael Baker International (MBI)-the project design engineer—prepared a new Engineer Cost Estimate (ECE) in support of this new IFB. The October 2022 new IFB was published in the Imperial Valley Press and San Diego Union Tribune and was posted in various plan-rooms. Additionally, it was emailed directly to over 300 potential contractors. Further, City staff held two pre-bid meetings with potential bidders to provide an overview of the Project and answer questions about the Project. At the request of two bidders, the City extended the deadline for submitting bids from November 16 to November 30, 2022. On November 30, 2022, in spite of extended outreach to potential bidders and extension of the bid deadline, the City received again only one bid to build the Project. The bidder is again Mountain Cascade, Inc. (MCI), whose bid this time came in at forty-million, six-hundred and nine thousand, and nine-hundred and eight dollars with four cents ($40,609,908.04).
Attachment No. 1 is MCI's bid.
Additional Funding to Complete the Project and Bid Evaluation On January 3, 2023, SWRCB staff also informed the City Manager that the SWRCB Director of Financial Assistance has approved SWRCB staff's recommendation to award the City of Calexico eighteen million, five hundred and thirty thousand, and forty-seven dollars ($18,530,047.00) from the California-Mexico Border Rivers Program to complete construction of the Project. Pursuant to this additional funding for the Project, SWRCB and DWR executed an Interagency Agreement on January 30, 2023, to transfer the $18,530,047.00 in additional funding to DWR so that DWR can provide the additional funding to the City to build the Project in its entirety:
• This additional funding brings the total funds available for construction of the Project to forty-six million, five hundred and thirty thousand, and forty-seven dollars ($46,530,047).
• On February 15, 2023, the City Council will consider the adoption of a Resolution which (a) accepts the additional funding from SWRCB to build the Project, and (b) authorizes the City Manager to execute Amendment 2 to City-DWR Funding Agreement # 4600014089 to build the Project.
• Amendment 2, in substantive part, make the $18,530,047 in additional funding available to the City to build the Project, extends the deadline to build the Project till June 30, 2024.
Discussion & Analysis:
City staff and its Project consultants evaluated Mountain Cascade, Inc. bid to determine whether it is responsive and from a responsible bidder. It also held two meetings with DWR staff to discuss the bid, and a meeting with the bidder to ask for clarification on specific bid items.
West and Associates Engineering, Inc. (WAE), who represents the City on the Project as the City Engineer evaluated MCI's bid against the Project's Engineer Cost Estimate (ECE) that Michael Baker International prepared for the Project on October 10, 2022.
Attachment No. 2 provides WAE's evaluation of the bid. WAE also conducted job and professional references checks for MCI for specific jobs similar in nature and cost to the Project, to ensure MCI is qualified to build the Project (see Attachment No. 3). WAE analysis show that MCI's bid is responsive and that:
1. Most of the individual bid prices were within a reasonable level of deviation from the Engineer's Cost Estimate (ECE)
2. only thirteen (13) out of the 143 bid items had pricing that differed greatly from the ECE (by 300% or greater). However, these items represented only 7% of the overall bid price;
3. The checked references provided a positive review of MCI's work, with one reference highlighting MCI's "truly cares" about providing a "quality project for the client;" and
4. MCI has demonstrated a solid understanding of the essential tasks required for the Project and pleasant disposition to work with the City to make the Project construction successful.
The City Project Manager agrees with WAE conclusions. The City Project Manager also evaluated MCI's bid to determine whether it meets the specified requirements of the new Invitation for Bid (October 2022 |FB). Attachment No. 4 contains his evaluation, which also concludes that MCI's bid is responsive and meets the Invitation for Bids' requirements. The City Public Works Manager agrees with the conclusions also. The additional funding provided by the SWRCB to build the Project, together with the existing funding set aside for construction from the original Funding Agreement with DWR, is sufficient to cover the projected construction costs for the Project and includes a five percent (5%) contingency, which can be used to cover potential change orders for the Project.
Based on the foregoing, City staff recommending that the City Council of the City of Calexico award the bid proposal and authorize the City Manager to sign a construction agreement with Mountain Cascade, Inc. for the New River Improvement Project - Calexico Reach.

City Public Works Manager / City Project Manager
City of Calexico

Calexico, CA 92231
Subject: Bid Analysis and Recommendations for the New River Improvement Project - Calexico Reach Dear Ms. Falomir and Mr. Angel,
Per our telephone and email conversations, West & Associates Engineering (WAE) has completed our bid analysis for the New River Improvement Project (NRIP) - Calexico Reach. Our review was conducted on the bid submitted by Mountain Cascade, Inc. (MCI). We understand that MCI's bid represents the sole bid received by the City for the NRIP at the date of bid closing (Wednesday November 30, 2022). Therefore, the purpose of our bid analysis was to verify that the bid submitted by MCI is a responsive bid (i.e. a bid that complies with the Bid Documents), and that MCI is qualified to perform the work in accordance with the Contract Documents. The results of our bid analysis is provided below and on the following page.
Background
Based on our conversations with the City, we understand that the City's Project Manager (PM) and Public Works Department Manager (PWM) reviewed MCI's bid to ensure it complies with the bid requirements specified in the City's Invitation for Bids (IFB). The City found that MCI's bid contained the necessary attachments, including the bonding forms and guaranty check (payable to the City of Calexico). To this extent, the City found that MCI's Bid is a responsive bid. The details of the City's review of MCl's bid are provided in a separate City Staff Report. However, to complete the review of MCl's bid to a satisfactory level for the NRIP funding partners/stakeholders, WAE was tasked with review of MCI's bid from a technical standpoint.
Scope of Review
As the Consultant City Engineer for the NRIP, WAE has been providing the City with general bidding support for the NRIP. As such, our services for this bid analysis included preparation of a bid tabulation, background verification of project references provided in MC's bid, and coordination with the City and NRIP partners/stakeholders to convey the results of our review.
Our team prepared a bid tabulation in Excel, in order to review MCI's bid for accuracy and for conformity to the requirements of the City's IFB. The results of the bid tabulation analysis revealed that most of the individual bid prices were within a reasonable level of deviation from the Engineer's Cost Estimate (ECE). Only thirteen (13) out of the 143 bid items had pricing that differed greatly from the ECE (by 300% or greater). However, these items represented only 7% of the overall bid price!. Our team 1 Besides these items, there was one (1) minor calculation error in MCl's bid, which results in an additional amount of $57,500 that should have been added for freight/delivery of the large 72-inch bypass pipe. If the Council awards the contract to MCI, this error would be corrected after execution of the Construction Contract Agreement with MCL West & Associates Engineering, Inc. • 78 Anacapa Court, Foothill Ranch, CA 92610 • 949.716.7670 | 714.728.8082 • westaeng.com City of Calexico
Bid Analysis and Recommendations for the New River Improvement Project - Calexico Reach December 20, 2022
presented the bid tabulation to the City PM, whereupon the City PM reviewed the tabulation and concurred with our team's analysis. Based on this bid tabulation analysis, WAE and the City PM have determined that MCI provided a responsive bid in this regard also.
Our team also conducted a background check of the project references provided by MCI. A total of three (3) project references were contacted. The references were asked about MCI's overall jobsite performance, telephone and email coordination, responsiveness to field issues, and schedule. Each reference provided a positive review of MCI's work, with one reference highlighting MCI's "truly cares" about providing a "quality project for the client." The results of the background checks were shared with the City PM.
Finally, our team (WAE), the City PM, and the City PWM held two (2) meetings with the Department of Water Resources (DWR) to discuss MCI's bid. One meeting occurred on December 6, 2022, and the other meeting on December 9, 2022. The latter meeting included members of MC's staff and the City PM and PWM. During the latter meeting, MCI suggested that there was potential opportunity for "value engineering", which may be able to reduce overall construction costs, or to offset any potential increases in construction costs in other areas of the project.
Recommendations
As a result of the above bid analyses, WAE, the City PM, and the City PWM have all determined that MCI has provided a responsive bid, is a responsible bidder, is invested in cost savings for the City, and has the appropriate level of experience for this project. Therefore, we recommend that the City award the NRIP construction contract to MCI.
Thank you for this opportunity. Please contact me if you have any questions.
Sincerely,
We
Phillip West, P.E., QSD/QSP

Good Evening,
We are consultants for the City of Calexico and are conducting a reference check for the low-bidder (Mountain Cascade Inc or "MCI") on the City's New River Improvement Project. We were provided a reference from MCI for a project that they worked on for your agency. The project is Treasure Island/Yerba Buena Street Improvements.
We would like to receive feedback from you on MCI's performance on this project. In particular, we would like to receive feedback on the following:
• How was MCI's performance on the project overall?
MCI had a few setbacks but ultimately performed on an extremely challenging project. • Was MCI's superintendent and foreman responsive to issues and questions? Yes - MCI always responded proactively and was very solutions oriented when it came to issues. •
• Did MCI submit their submittals on-time?
When the submittals came from their office, yes. They struggled a bit with submittals from their subcontractors, biggest one being Tesco. • Did the project finish an schedule? If not, were any schedule extensions justifiable or reasonable? The schedule for this project was justifiably extended through no issue with MCI. • Were there any change orders or product substitution requests? If so, were they justifiable? Yes, there were change orders for added scope and they were justified. While substitutions were submitted, many were not approved due to the need to follow City Standards, therefore MCI provided specified products. • How was the quality of MCI's jobsite safety and traffic control? MCI had good jobsite safety protocols and traffic control. • Any notable issues found and/or fixed by MCI? (Unforeseen or anticipated issues).
MCI spent a fair amount of time working with the City, both water and sewer departments to get newly installed pump stations up and running. There was a disconnect between design documents and what the departments actually needed. MCI worked well with the City teams to get things operating the way they needed.
• Would you work with MCI again?
Yes, I would work with MCI again. I worked with one of their principles who truly cares about providing a quality product for the client.
If you are unsure of any of the answers to our questions above, that is ok. We appreciate any feedback you can provide.
Thank you,
Bryan

NRIP CALEXICO REACH
MEMORANDUM
DATE: December 27, 2022
TO: Ms. Lily Falomir, City of Calexico Public Works Manager FROM: Jose L. Angel, P.E., Project Manager: far 1. Angel RE: NRIP Calexico Reach (Project) - Review of 11/30/2022 Mountain Cascade Inc. Bid Dear Lily,
I have reviewed the bid that Mountain Cascade, Inc. (MCI) submitted on November 30, 2022, to requirements of the Invitation for Bids the city issued on October 17, 2022 for the Project. Exhibit 1 (attached) presents a matrix that I prepared for the review of and my analysis of the bid. My review and analysis indicate that:
1. MBl's bid is responsive to the new IFB;
2. MCI's bid meets the Bid Requirements specified in the new IFB;
3. MCI is a California licensed contractor, in good standing with the California Department of Consumer Affairs; and
4. MCI and its proposed subcontractors are registered with the Department of Industrial Consequently, it is my opinion that MCI's bid is responsive to the new IFB. Additionally, I have reviewed the evaluation that West and Associates Engineering (WAE) conducted of MCI's bid and the job reterences check it conducted on MCl. I agree with WAE's conclusions, including that MCl is a responsible bidder and qualified to build the Project. Further, I agree with WAE's recommendation for the City to award the contract for construction of the Project to MCI.
Please let me know if you have questions about this matter or would like more details on any of the topics covered. I am available at (760) 877-0234. Thanks.
