Recommendation:

Authorize City Manager to Sign Amendment No. 4 to the Agreement of Professional Services in the Amount of $100,000.00 with Michael Baker International to provide Construction Support Services to the City, including Review/Evaluation of Specific Submittals for the Construction of the New River Improvement Project - Calexico Reach.

Background:

The New River is a Water of the United States and a California Water. It originates approximately 18 miles south of the US-Mexico Border, in the Mexicali Valley, Mexico. It enters the United States by the Calexico West Port of Entry, in Calexico, California. The City of Calexico (hereafter "City") is proposing to implement the New River Improvement Project - Calexico Reach (hereafter "Project"). The City became Project Lead and pursuant to the California Environmental Quality Act it certified a Mitigated Negative Declaration for the Project in April 2020. The Project consists of three primary construction components:

AGENDA

1. Trash screen and diversion structure for the New River downstream from the International Boundary with Mexico. ITEM

2. Bypass encasement infrastructure for the New River from a point downstream of the International Boundary to a point downstream of the eastern boundary of the City of Calexico to address the public health threat that new River water quality poses to the southern area of the city.

3. A pump-back system to take treated wastewater from the existing Calexico Wastewater Treatment Plant (WWTP) and discharge it into the New River channel at a point near the proposed river diversion and encasement structure.

The City and the California Department of Water Resources (DWR) executed a $28,000,000 Funding Agreement (hereafter "Funding Agreement") in May 2021 to implement the Project. On February 15, 2023, the City Council of City of Calexico adopted Resolution No. 2023-04, which (1) authorizes the city to accept eighteen million, five hundred and thirty thousand, and forty-seven dollars ($18,530,047.00) from the State Water Resources Control Board's California-Mexico Border Rivers Program in additional funding for the construction of the New River Improvement Project Calexico Reach; and (2) authorizes the City Manager to execute Amendment 2 to the Funding Agreement.

Amendment 2, in substantive part, makes the SWRB's $18,530,047 in additional funding available to build the Project and extends the deadlines to complete construction of the Project. The City Manager executed Amendment 2 to the Funding Agreement on February 15, 2023, also.

Michael Baker International (MBI) is the Design Engineer for the Project, and it has been on contract with the city since January 2022 to provide engineering services to the city, which included finalizing the plans and specifications for construction of the Project and other technical support services during the Project's bid process. Dynamic Consulting Engineers (DCE) is the Project's Construction Manager and has been on contract with the City since November 2021. On February 15, 2023, the city awarded to Mountain Cascade, Inc. (MCI) a forty million, six hundred and nine thousand, and nine-hundred and eighty dollars with four cents ($40,609,980.04) contract to construct the Project. Since then, MCI has been submitting technical documentation for review and approval by the city to build the Project, including critical components of the Project (e.g., pump station's backup generator, switchboards, panelboards; proposed 72-inch bypass pipe; ground improvements; electrical switches for Diversion Structure), which DCE recommends are best evaluated by the MBI, the Design Engineer. The Contract Agreement with MBI, as amended to date, has approximately $4,557.91 left in funding for support services, which is not sufficient to cover the MBl's costs for reviewing certain MCI submittals, as recommended by DCE. It is estimated that an additional one hundred thousand dollars ($100,000) would be needed to cover MBI's costs.

Discussion & Analysis:

City staff supports DCE's recommendation that certain MCI submittals be reviewed by MBI for approval—The Project Design Engineer of record, and that is prudent to have MBI participate in certain construction meetings, where key issues may be raised on the plans and specifications for the Project. Therefore, and in concurrence with DCE, the City Public Works Department Manager and City Project Manager are recommending that the City of Calexico Council adopt Amendment No. 4 to the Contract Agreement with MBI to fund an additional $100,000 in support services from MBI. The scope of work under the proposed Amendment is included in Exhibit A and focuses on the review specific submittals from MCI, including submittals dealing with key Project components for the pump station (e.g., standby generator and electrical hardware), bypass pipe, and Diversion Structure; and on participating on key construction meetings.

Exhibit B shows the proposed MBI's hourly rates for the required services. The costs for the additional services will be covered by the City-DWR Funding Agreement. The City Public Works Manager, the City's Project Construction Manager, and New River Improvement Project Manager have reviewed the scope of work and recommend that the City Council of the City of Calexico authorize the City Manager to sign Amendment No. 4 to the Agreement for additional Professional Services with MBI for the New River Improvement Project - Calexico Reach.
