Recommendation:
Authorize City Manager to sign Amendment No. 1 to the Agreement of Professional services with AE Consulting, Inc. in the amount of $9,220.00 for construction management and inspection services for the Calexico International Airport Taxiway A Rehabilitation Project FAA AIP No: 3-06-0034-018-2020; 3-6-0034-021-2021.
Background:
On June 20, 2018, the Public Works Department requested Statements of Interest and Qualifications (RFSOQ) from Airport Engineering Consultants for the Calexico International Airport. The deadline for submittals was July 11, 2018, and the City Clerk's Office received three (3) SOQ's which were evaluated and ranked accordingly. On November 7, 2018, the City Council of the City of Calexico selected AE Consulting, Inc. to assist the City in the preparation of the plans and spec's and during the bid process of the Calexico International Airport Taxiway A Rehabilitation Project FAA AIP No: 3-06- 0034-018-2020; 3-6-0034-021-2021.
On November 3, 2021, the City Council of the City of Calexico authorized the City Manager to sign agreement of professional services with AE AGENDA Consulting, Inc. in the amount of $368,635.00 for construction management ITEM and inspection services for the Calexico International Airport Taxiway A Rehabilitation Project FAA AIP No: 3-06-0034-018-2020; 3-6-0034-021-2021. 5 Discussion & Analysis:
On a weekly basis, Public Works staff, AE Consulting, Inc. and Pyramid Construction & Aggregate, Inc. met to discuss the construction progress of Taxiway A Rehabilitation Project. During these meetings, additional work was observed that will benefit the infrastructure at the Calexico International Airport and can be funded by the federal grant.
On June 15, 2022, the City Council approved Pyramid Construction & Aggregates, Inc.
Change Order No. 1 which included the replacement of 4" sewer line and on August 17, 2022, the City Council approved Pyramid Construction & Aggregates, Inc. Change Order No. 2 which included the replacement of driveway and replacement of current regulator and replace metal enclosure of airfield electrical equipment with insulated metal container with mini split A/C unit. Due to Change Order No. 2, AE Consulting, Inc. will need to perform the following additional work:
1. Record drawing and final inspection for sanitary sewer
2. Record drawing and final inspection for driveway/curbs
3. Coordination replacement of Constant Current Regulator For this reason, Public Works staff is recommended that the City Council authorize the City Manager sign Amendment No. 1 with AE Consulting, Inc. for additional construction management and inspection services for the Calexico International Airport Taxiway A Rehabilitation Project FAA AIP No: 3-06-0034-018-2020; 3-6-0034-021-2021. With Amendment No. 1 the new contract will be $377,855.00.

AMENDMENT NUMBER 1 TO THE AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN THE CITY OF CALEXICO AND AE CONSULTING, INC.
AMENDMENT NUMBER 1 dated May 17, 2023, the agreement for professional services between the City of Calexico ("City") and AE Consulting, Inc. ("Consultant") dated November 3, 2021 (the "Agreement") concerning construction management services for Taxiway A Rehabilitation FAA AIP 3-06-0034-018-2020; 3-06-0034-021-2021.
The Consultant has entered into the Agreement with the City for the furnishing of professional services, and the parties now desire to amend the Agreement.
Therefore, it is mutually agreed that the Agreement is amended to include Additional Services to be performed by Consultant and provisions for additional compensation by the City to the Consultant, all set forth in:
Exhibit A - Proposal dated January 30, 2023
The parties ratify the terms and conditions of the Agreement not inconsistent with this Amendment, all of which are incorporated by reference.

Dear Ms. Falomir:
Pursuant to our teleconference with Mr. Joshua Baey held earlier today where he explained that the new electrical vault shelter is not eligible for inclusion as a change order to the subject AIP Project, we are hereby revising AE Consulting, Inc (AE)'s scope and fee proposal dated September 12, 2022, to provide additional services under our construction management agreement with the City of Calexico for the Taxiway A Rehabilitation Project dated 3d November, 2021, to exclude work associated with this item. The scope and fee are therefore revised as follows:
Scope of Services
Prepare Plan and Profile sheet for the 4" Sanitary Sewer that was replaced under Construction Change Order No.1 between the City and Pyramid Construction. This sheet will be included in the record drawing set for the Project. The construction of this work was mostly completed during our on-site engagement for the Taxiway A Rehab Project. A final inspection of punch list items associated with the sewer line improvements will be performed during a separate site visit.
Prepare Plan and details for the new driveway and landscaping surround that was constructed under Change Order No.2 between the City and Pyramid Construction. This sheet will be included in the record drawings. The construction of this work was initiated during our on-site engagement for the Project but was completed during the three days that followed. A final inspection of the finished work will be performed during the same site visit to inspect the sewer punch list items.
Coordinate replacement of the existing CCR with the Contractor and process as a change order.

Compensation
AE will provide these services as a change order to our November 3d, 2021, Agreement, for the additional lump sum fee of $9,220. This is broken down as follows:
1. Record Drawing and Final Inspection for Sanitary Sewer $4,350 Record Drawing and Final Inspection for Driveway/Curbs $ 3,430
3. Coordinate replacement of Constant Current Regulator $ 1,440 A detailed breakdown estimate of this fee is attached.

I have reviewed the subject amendment and associated costs and determined the additional contract items are eligible for AIP participation. The following contract items are approved in the total amount of $9,220.

3. Coordinate replacement of Constant Current Regulator The following limitations apply to this action:
• This determination is solely for the purpose of establishing eligibility of costs under the AIP program. This approval does not represent a commitment of Federal funds in addition to the original grant obligation.
• The incorporation of non-participating work items must not directly or indirectly result in any additional cost to the AIP-eligible portion of the project. Please maintain a separate and accurate cost accounting of the non-participating work that will permit a third party auditor to quickly verify proper allocation of costs.
Please forward a copy of the executed change to my attention as soon as it is available. Your record drawings should indicate details addressed by this Change Order.
