City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 2 of 12 The item was then presented to the City Council during a regularly scheduled meeting on October 5, 2023. The item was not presented for a final decision, but instead to inform the Council of the project and to request direction for staff. Upon opening the floor for public comments, the Applicant explained to Council that the proposed vacation was first presented in 2018 and went through multiple administrations and planning staff. When asked by Council whether he had signed documentation from previous administrations in his possession, the Applicant indicate that he had approved permits, payment receipts, and email communications on hand. Upon considering all comments regarding the proposed vacation, the City Council motioned to table the item for the next regularly scheduled City Council meeting to be held on October 18, 2023, so that the Applicant can provide copies of the approved permits, payment receipts, and email communications given by the City.

Upon conclusion of the October 5, 2023, City Council meeting, city staff coordinated with the Applicant to acquire all the documents for the project requested by the City Council. As of October 6, 2023, the Applicant submitted a 79-page document. The document contained a timeline of events along with email communications, encroachment and grading plans/permits, payment receipts, along with images of the project site. It should be noted that many of the submitted items detail the overall project but are not necessarily related to the street vacation request. Furthermore, the submitted items only demonstrate that work on the city right-of-way was permitted and is in no way whatsoever evidence that the subject road segment transferred ownership. The road segment is still owned by the City of Calexico.

RECOMMENDATION:

The purpose of this item is to present the documents requested by Council during their October 5, 2023, meeting along with potential options for the request to vacate 6th Street, submitted by the Applicant, to the City Council so that Council may provide direction to staff on how to proceed with the request. It is important to reiterate that this staff report is not for approving or denying the requested street vacation and is only to inform the City Council of potential actions and for them to provide further instructions for staff. As requested by the City Council, this item was brought back for review during the October 18, 2023, City Council meeting.

It is important to note that given the short timeframe between the October 4 and October 18 City Council meetings, a recommendation on which of the three available options to choose cannot be provided as there was insufficient time for city staff to consult with and review records from the City of Calexico Engineering, Public Works, and Finance Departments. Consequently, only records from the City of Calexico Development Services Department were analyzed.

Upon reviewing all relevant information and hearing all comments for and against the project, the City Council should consider the following action:

1. Provide directions to city staff for which of the following options to proceed with for the requested vacation of a portion of West 6th Street requested by Marco A. Madrigal:
a. Option 1 – Street Vacation
City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 3 of 12 i. Option 1A – General Vacation
ii. Option 1B – Summary Vacation
b. Option 2 – Sale or Lease (5 years or more)
c. Option 3 – Lease (4 years or less)
DISCUSSION AND ANALYSIS:

A vacation is when a public right-of-way or a public service easement is “abandoned” by the City.

Once the subject right-of-way or easement is abandoned, the public use of the land or easement area is relinquished without restrictions to the property owner. The use of the abandoned area usually reverts to the adjacent property owner(s). It is important to note that Sections 8322 – 8323 of the California Streets and Highways Code prescribe specific procedures for the abandonment or vacation of a street or right-of-way. State law requires that notices of public hearing must be posted in a local newspaper and on the street requested for vacation for two weeks prior to the scheduled hearing.

After reviewing the submitted documentation, it was found that there are no records to confirm whether the proper noticing procedures were carried out, pursuant to Sections 8322 – 8323 of the California Streets and Highways Code, prior to the May 30th Planning Commission meeting.

Items Submitted by Applicant: Upon conclusion of the October 5, 2023, City Council meeting, city staff coordinated with the Applicant to acquire all the documents requested by the City Council. As of October 6, 2023, city staff received the following:

1. Project Timeline. A detailed timeline of events beginning from 2018 to the present day. It is important to note that the timeline is told from the Applicant’s perspective. Previous administrations did not keep records of the project and most documents on file were extracted from the submitted timeline. Furthermore, only documents sent directly to the Planning Division email ([email protected]) were confirmed to have been received. It should be noted that many of the items submitted are relevant to the Applicant’s overall project but are not necessarily related to the street vacation request. The submitted timeline consists of the following items:
a. Vacation Request Letter (Relevant to Street Vacation Request) – A letter from the Applicant dated February 13, 2019. This letter is directed to the Development Services Director to request the City of Calexico’s support for his project which consists of combining the surrounding properties and portion of West 6th Street.

There no markings indicating that the letter was received by the City, but a review letter dated March 3, 2019 was prepared and sent to the Applicant.

City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 4 of 12 b. Planning Division Review Letter (Relevant to Street Vacation Request) – A letter from the City of Calexico Planning Division dated March 3, 2019, signed by the Associate Planner at the time. The letter states that the use of the street will be considered for approval subject to the following conditions. i. Submit street improvement drawings for the full width of Sixth Street starting from the intersection and up to the auto parking entrance for review by Engineering. It is recommended that a geotechnical engineer review the plans to provide an accurate estimate for construction of the street. ii. Submit a phasing plan indicating the extent of development for each phase.

Any unused portion of the proposed auto storage yard shall be fenced off. iii. Sewer and water lines shall be installed and connected to city utility services in accordance with engineering standards.
iv. A fire hydrant shall be installed on the NW comer of Sixth Street and Emerson Avenue.
c. Engineering Proposals (Relevant to Street Vacation Request) – In response to the City of Calexico letter dated March 3, 2019, the Applicant acquired cost proposals from three different engineering firms (ROVE Engineering, Pyramid Construction and Aggregates, Inc., and Dynamic Consulting Engineers). The proposals list the material and construction costs for implementing the conditions listed for the street vacation request in the City of Calexico review letter dated March 3, 2019. d. Email Chain with Assistant City Manager (Potentially Unrelated to Vacation Request) – An email chain between the Previous City Manager, then assistant City Manager, and the Applicant dating from March 6, 2019, to March 29, 2019. In the email chain, the assistant City Manager requested site photos, a parcel map, assessor’s parcel number (APN) map, title reports, plotted easements, and property maps from the Applicant. The items were requesting to review the project proposed by the Applicant which includes the street vacation. As illustrated on the emails, the Applicant submitted the requested documents as attachments but there are no records of these documents since they were never saved by previous administrations. Since the email chain references an in person conversation, it is unclear whether the emails or the referenced discussion are related to the vacation. e. Email Chain with IVSBDC (Unrelated to Vacation Request) – An email chain between the Assistant City Manager, the Applicant, and the Imperial Valley Small Business Development Center (IVSBDC) dating from August 3, 2019, to August 5, 2019. Per the email chain, the assistant City Manager presented the Applicant to City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 5 of 12 IVSBDC to attempt to get a small business loan. Per the Applicant’s timeline, the request was denied by IVSBDC.
f. Email Chain with City Engineering Department (Unrelated to Street Vacation Request) – An email between the City of Calexico Engineering Department and Dynamic Consulting Engineers dating from October 4, 2019, to November 26, 2019. The email chain discusses the grading plan review for the proposed parking development along with multiple redlines and updated plan submittals. The grading plans went through four reviews prior to being approved by the engineering department. A look through the Development Services Department files found no record of the redlined or updated grading plan submittals. g. Approved Grading Plans (Unrelated to Street Vacation Request) – A copy of a payment receipt and approved grading plans dated December 3, 2019. The payment receipt is in the amount of $11,246. The grading plans were stamped with an “APPROVED” label by the Engineering Department. A look through the Development Services Department files found no record of the payment receipts. h. Approved Encroachment Permit (Unrelated to Street Vacation Request) – An encroachment permit from the City of Calexico Engineering Department stamped with an “APPROVED” label dated March 11, 2021. It is important to note that the encroachment permit is for the paving and not for a fence. It is unclear whether the paving approved by the encroachment permit is for the remaining segment of the road towards Emerson Avenue or only for the segment requested for vacation. The encroachment permit fees were paid using the grading plan fees. A look through the Development Services Department files found no record of the approved encroachment permit.
i. Construction Invoices (Unrelated to Vacation Request) – Construction invoices from ROVE Engineering, SIERRA Material Testing & Inspection, and Pyramid Construction and Aggregates, Inc. totaling $70,389. The invoices are for construction work, testing, and materials for the paving of the subject road section and parking lot. While the invoices are unrelated to the vacation request, they show that the Applicant covered the costs associated with improvements to the area. j. Email Chain with Contract Planner (Unrelated to Street Vacation Request) – An email chain between the Applicant and the then contract planner dating from June 17, 2021, to August 12, 2021. In the email chain, the Applicant is inquiring about the installation of a trailer to serve as an office for the proposed commercial parking lot. The contract planner informs the Applicant of the zoning requirements and then proceeds to review the permit application as the email chain continues. Throughout City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 6 of 12 the review process, the Applicant is submitting any and all information/documents requested by the contract planner.
k. Meetings with Planning Director (Potentially Unrelated to Vacation Request) – A list of ten emails from the previous director of the Development Services Department dating from November 8, 2021, to December 12, 2022. Of the ten emails, seven are meeting appointments to discuss a conditional use permit (CUP), business license, general questions, and a site visit. There are no records indicating what the CUP was for nor what was discussed in these meetings. A review of the emails sent by the previous Planning Director found no additional information on these meetings.
l. Burrowing Owl Monitoring Report (Unrelated to Street Vacation Request) – A Burrowing Owl Monitoring Report prepared by Barrett’s Biological Surveys dated December 2021. The survey was requested by the previous Planning Director and current building inspector after an inspection of the property. The survey did not confirm any burrowing owl sightings.
m. Development Services Dept. letter (Relevant to Street Vacation Request) – A letter signed by both the Applicant and previous Planning Director dated January 4, 2022.

The letter stated issues with the street improvements, trailer, previously existing gas station, and the burrowing owl survey. The letter stated that the fence blocking 6th Street must be removed within 14 days, a street vacation request must be submitted, the existing trailer was deemed beyond repair, an abandoned structure last utilized as a gas station prior to 2000 must be removed and contact information from the company that prepared the burrowing owl survey must be provided. Both parties agreed on the letter as illustrated by the signatures. n. Demolition Permit (Unrelated to Street Vacation Request) – An approved demolition permit from the Development Services Department with a February 2022 issue date. The permit was submitted in response to the Development Services Department letter dated January 4, 2022, which stated that an abandoned gas station in one of the properties abutting West 6th Street must be demolished. While no files on the review or inspections were saved, historical aerial photography indicated the structure has been abandoned since before 2000.
o. Street Vacation Application (Relevant to Street Vacation Request) – A uniform application received on April 13, 2022, for the requested vacation of a segment of East 6th Street. Legal descriptions and a lot merger map was submitted along with the uniform application.

City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 7 of 12 p. Engineering Department Status Letter (Unrelated to Street Vacation Request) – A letter from the City of Calexico Engineering Department dated December 20, 2022.

The letter is from the previous city engineer and is requesting that the Applicant install landscaping per the Zoning Code. It stated that there would be no further comments from the engineering department upon installation of landscaping. While there are no records to confirm whether the Applicant met the final condition on the letter nor if the city engineer inspected the site, a Deposit reimbursement was issued indicating that the permit was issued.
q. Deposit Reimbursement (Unrelated to Street Vacation Request) – Reimbursement forms approved by the Public Works Director and Interim Finance Director for the reimbursement of $7,356.48 to the Applicant. All engineering fees for the project were charged from a $10,000 deposit submitted in 2019 by the Applicant and the remaining balanced was reimbursed. The form specifically states that the deposit was to cover engineering fees/administrative fees. A look through the Development Services Department files found no record of the reimbursement. r. Fee/Deposit Collection Form (Relevant to Street Vacation Request) – A fee/deposit collection form dated January 4, 2023, in the amount of $13,772.28. The fee was collected to cover the noticing costs of the vacation request. As mentioned earlier in the report, no records of the noticing exist, and the advertised meetings were cancelled rendering any noticing void.
s. Planning Commission Agenda (Relevant to Street Vacation Request) – The first page of an agenda from a Planning Commission meeting held on May 30, 2023.

Although the agenda lists the item as a public hearing, the noticing mandated by the State of California was not properly executed for the Planning Commission meeting rendering the Planning Commission ruling to approve the street vacation invalid.

As previously mentioned, only documents sent directly to the Planning Division email ([email protected]) were confirmed to have been received. All other emails sent to previous managers and planners are unconfirmed. Furthermore, there are no records of any of the approved permits other than the demolition permit. Most of the approved documents and communications on file were provided by the Applicant.

POTENTIAL ACTIONS:

Option 1 – Vacation. According to Part 3 under Division 9 of the California Streets and Highway Code, there are two procedures for vacating a roadway. The first is the general vacation process and the second is a summary vacation which are both summarized below:

City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 8 of 12 Option 1A – General Vacation. Upon receiving a petition or request from an interested party, the following steps must be completed:
a. Per Section 8322 of the California States and Highway Code, a notice of public hearing on the requested vacation shall be published for at least two successive weeks prior to the hearing in a daily, semiweekly, or weekly newspaper. b. Per Section 8323 of the California Streets and Highway Code, at least two weeks before the day set for the hearing, the legislative body shall post conspicuously notices of vacation along the line of the street. At least 3 notices must be posted and shall not be posted more than 300 feet apart.
c. If the City Council finds that the street described in the notice of public hearing is unnecessary for present or prospective public use, the City Council may adopt a resolution vacating the street. The resolution may provide conditions set by the City Council and the recording of the resolution may be withheld until all conditions have been met.
d. Upon addressing all conditions set by the City Council, a certified copy of the resolution of vacation, attested by the city clerk under seal, shall be recorded at the County of Imperial Recorder’s Office. Upon such recordation, the vacation is complete.

Option 1B – Summary Vacation. While a shorter process than the general vacation, the following steps must still be taken:
e. Per Sections 8330 – 8334.6 of the California Streets and Highway Code, a summary vacation is only possible under any of the following conditions:

1. If the street has been superseded by relocation.

2. If the street has excess right-of-way not required for street purposes.

3. If the street has been impassable for vehicular travel for a period of five consecutive years and no public money was expended for maintenance of the street during that time.

4. A summary vacation cannot take place if it would cut off all access of a property to the street or if it terminates a “public service easement” as defined in Streets and Highways Code Section 8306 (unless the requirements of Streets and Highways Code Section 8333 are met).

5. If a portion of a street lies within property under one ownership and does not continue through that property or touch other property.

It is important to reiterate that only one of the following items needs to be determined in order to proceed with a summary vacation. The subject roadway is compliant with condition number 5 above as the Applicant is the owner of all four City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 9 of 12 surrounding properties. Furthermore, an argument can be made that the four parcels will be merged into one after the vacations to meet condition number 4 above.

Per condition number 3 above, the subject roadway has been an undeveloped dirt road as early as 1985 and as late as 1959. While this shows that no public money was spent on the roadway within the last five years, the roadway was not impassable to vehicular traffic given that there was access to the surrounding properties.

Conditions number 1 and 2 are not compatible with the project. f. Per Section 8335 of the California Streets and Highway Code, the City Council may vacate a street by adopting a resolution which states all of the following:

1. That a vacation is made under Chapter 4 in Part 3, Division 9 of the California Streets and Highway Code.

2. The name or other designation of the street and a precise description of the portion vacated. The description of the portion vacated may be by a precise map which is recorded or to which reference is made in the resolution on which is permanently maintained by the public entity.

3. The facts under which the summary vacation is made. If the vacation is made pursuant to Section 8332, the statement shall include the date of the agreement. The resolution is prima facie evidence of the facts stated.

4. That from and after the date the resolution is recorded, the street vacated no longer constitutes a street.

5. If the resolution of vacation applies to a public service easement vacated by a public officer or employee delegated authority pursuant to subdivision (a), a certification that all entities having any right, title, or interest in the public service easement being vacated have been notified of this action.
g. Upon adoption by City Council, a certified copy of the resolution of vacation, attested by the city clerk under seal, shall be recorded at the County of Imperial Recorders Office. Upon such recordation, the vacation is complete.

Option 2 – Sale or Lease (5 Years or More). Surface and sub-surface rights for road rights-ofway belong to the City which allow the City the option to sell or lease this portion of 6th Street as a means of generating revenue to the City. In order to do so, the City is required to declare the property as being surplus. As such, the sale or lease would be subject to the Surplus Land Act (SLA) which was signed into law by Governor Newsom via Assembly Bill 1486 (AB 1486). The aim of AB 1486 is to increase the availability of real property in California for affordable housing development by requiring the prioritization of affordable housing when selling or leasing public lands no longer necessary for agency use. Beginning January 1, 2021, local agencies are required to City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 10 of 12 send, and the State Department of Housing and Community Development (HCD) is required to review negotiation summaries for each surplus land and exempt surplus land transaction in the state.

While the sale or lease of the subject property will provide monetary funds to the City of Calexico, any sale or lease for a period of five years or more will trigger SLA. Per Assembly Bill 1486, as of January 1, 2021, local agencies are required to send, and the State Department of Housing and Community Development (HCD) is required to review, negotiation summaries for each surplus land and exempt surplus land transaction in the state.
“Surplus Land” is defined as land owned by any local agency that is determined to be no longer necessary for the agency’s use, except property being held by the agency for the purpose of exchange. “Exempt Surplus Land” is defined as land that is less than 5,000 square feet in area, less than the applicable minimum legal residential building lot size or has no record access and is less than 10,000 square feet in area, and that is not contiguous to land owned by a state or local agency and used for park, recreational, open-space, or affordable housing. It is important to note that land that is a former street is classified as exempt surplus land only if the land is conveyed to an owner of an adjacent property. Per SLA, exempt surplus land only requires a declaration via resolution and a determination with written findings sent to HCD at least 30 days prior to disposition.

The subject street is approximately 21,712 square feet which disqualifies it from being classified as exempt surplus land should the City choose to proceed with a sale or lease of 5 years or more.

It is also important to note that the SLA process may take as little as 3 to 4 months or as long as 6 or more months, and must go through the following process:

1. City Council declares subject property as surplus land via resolution.

2. A Notice of Availability (NOA) is sent out to developers who have notified HCD of their interest in developing affordable housing on surplus local public land, any local public entity within the jurisdiction where the surplus land is located, and the Department of Housing and Community Development (HCD) for a period of 60 days.

3. If a local agency receives a notice of interest from an interested party within the first 60 days, the disposing agency and the interested party shall enter a 90-day good faith negotiation beginning on the first day after the end of the 60-day period.

If no notice of interest is received, then the 90-day negotiation period may be skipped.

4. Prior to agreeing to terms to dispose of surplus property, local agencies must send a description of notices of availability sent, and negotiations conducted, in addition to a copy of any restrictions to be recorded against the property, to HCD for a final review.

5. Upon receiving a response from HCD and addressing all comments, local entities may proceed with disposing of the property.

An on-site appraisal was not conducted for the subject property, but a cursory review of the current price for industrial land in Calexico was done and estimated that the cost per acre for the sale of industrial land in the City is estimated to be around $250,000 per acre. Since the subject roadway City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 11 of 12 is approximately half an acre, the potential cost would be $125,000. It is important to note that the estimate is from a cursory review and the actual cost is unknown until an on-site appraisal is conducted. The estimate is subject to change upon an on-site appraisal.

Option 3 – Lease (4 Years or Less). Per Section 102(h)(1) of the SLA Guidelines prepared by HCD, a lease of land on which no development or demolition will occur, or which has a term of less than 5 years (including any extensions, amendments, or options) is not subject to SLA. Any lease that does not meet the previously mentioned requirements is subject to the SLA process.

While an on-site appraisal was not conducted for the subject property, a cursory review of the current lease price for industrial developments was conducted. Upon researching the leasing prices of eight (8) different industrial properties within the City, it was estimated that the average annual lease for industrial land in Calexico is approximately $11.24 per square foot. Note that the properties researched have immediate access to a major roadway and are for existing warehouse developments. There were no vacant industrial parcels available for lease during the cursory review. Given that the roadway requested for abandonment/vacation does not have any of the previously mentioned factors, the potential lease cost may be significantly less than the estimated yearly lease of $11.24 per square foot. The previously stated cost is from a cursory review and the actual lease cost is unknown until an on-site appraisal is conducted. The estimate is subject to change upon an on-site appraisal.

ENVIRONMENTAL
CEQA (California Environmental Quality Act) is a statute that requires state and local agencies to identify the significant environmental impacts of their actions and to avoid or mitigate those impacts, if feasible. A public agency must comply with CEQA when a project “receives some discretionary approval from a government agency which may cause either a direct physical change in the environment or a reasonably foreseeable indirect change in the environment.” Compliance can be met by determining whether a project is exempt from CEQA or preparing an environmental analysis, typically a negative declaration (ND), mitigated negative declaration (MND) or environmental impact report (EIR).

The requested street abandonment/vacation is exempt from CEQA review via Section 15061(b)(3) of the CEQA Guidelines for Implementation which states the following:
“The activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment.

Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.” (California Code of Regulations).

As a street vacation, it can be seen with certainty that there is no possibility that the requested text amendment may result in a significant effect on the environment. The Applicant’s proposal to develop the area as a private parking lot is also exempt on the same basis.

FISCAL IMPACT
If the subject portion of West 6th Street were to be abandoned, the costs for staff time, public hearings, and public noticing shall be borne by the Applicant. Upon abandoning the subject City of Calexico City Council Meeting
Requested West 6th Street Abandonment – October 18, 2023 Page 12 of 12 roadway, the City of Calexico will no longer be responsible for the maintenance cost of said portion to be abandoned/vacated.

1 Marco Parking Timeline:
10/05/2023
Marco Parking:
• The city of Calexico in 2016 started the Cesar Chavez Blvd. project. Because of a condemnation of the property in 500 Cesar Chavez Blvd. We were asked to move to the new property line to give space for the new improved boulevard that was planned. There was a considerable reduction of area, we were reduced 40 cars of capacity, this move really impacted our business. Because of this situation we started to look for a new place to relocate our business. Ref.1 • We got an opportunity to acquire two lots to relocate our business in late 2018, we started to talk with Ralph Morales, then Planning and Building Manager. He collaborated with us with the first requirements to be done to get a license to operate in this place. We explained the situation that we were facing in the Cesar Chavez address, and he started to help us with viable options. Ref.2-5 • We asked for the abandonment of the portion of the street between the two lots of us, in February 2019 we delivered a letter as requested by Ralph Morales (Ref.6). Ralph Morales in March/3/2019 presented our project in a PRC Meeting, in this meeting, the most important requirements that caught our attention were: the improvement asked for the entrance, we had to pave at least one lane to give access to my business and inside of the parking lot everything has to be asphalt or concrete, we were told there that Calexico was not going to give license to a parking lot with dirt surface. We were later told that the city was willing to abandon the portion of street between the two lots we asked on the condition that we need to do the complete improvements, asphalt paving of the street and sidewalk of the north side of the street. Around this time, we asked for a legal document in which we commit to do this entrance street improvement in the future so we can move to the new location and raise enough capital for such improvement, but we were not given that opportunity, stating that once the city abandoned a land the developer most of the time never complies with what was agreed. At this point, we had to make improvements worth at that moment more than $700,000 to finish the complete project, we got proposals from rove engineering, pyramid, and SLA paving. SLA at that time estimated the work at 180,000/acre for just the asphalt which is total of $450,000 for all the complete area approximately, the preparation of base should have been done previously for them. With the condition of our business at that time we were barely making profits, we ended up with no visible options to continue. Ref. 7-11 • Ralph Morales gave us permission to install a fence on the street for our protection, these new lots came with a problem of homeless people and addicts living inside the lots. Most of the time been aggressive when asked to leave. Ref.12
• We met Miguel Figueroa, at that time he was occupying the position of Assistant city manager, community, and economic development Director, attending to our needs, he helped us with the process for the donation of the portion of the street (Ref.13). After meetings I send him an email with the Title report to be reviewed by attorney Seth Merewitz (3/28/2019). Ref.14-15 • Around June 2019 the Cesar Chavez Blvd was completed, and there were installed concrete walls between the lanes. We as a transportation company use big trailers, because these concrete walls, the access to our business was difficult and dangerous, tight space to maneuver, high density and high-speed traffic made it difficult for other companies to continue delivering cars with us. As a result, most companies stopped delivering cars with us. Ref. 16 2 • Miguel Figueroa introduced us to Meredith Garcia of Imperial Valley Economic Development Corporation (IVEDC) for funding (8/5/2019), unfortunately we did not get any funding option to finish our project. Ref. 17
• With the help of Carlos Beltran of Dynamics, the engineering department and David Dale we got to an agreement, have some requirement changes, according to David Dale the street abandonment was done, he said at that moment that the city of Calexico had no funds nor use for that portion of street, we also agreed on in-site improvements changes, we were able to change the asphalt/concrete to class II Base, with prior consultation with Air Pollution Control District (APCD). Ref. 18-27
• From the engineering department Ivan Negrete helped us to have our plans approved (10/4/19 to 11/19/19). Miguel Figueroa said that to help us, we will do a one payment for the complete project, instead of the 6%-7% that normally is paid. Once the plans were approved, we made a paymentof $11,246 (12/3/2019). Ref. 28-31
• On January 22, 2020, Jose Saldana from the water department did the work of hydrant and water service line according with the plan requirements. We didn’t find a water line and there was no main water pipe near this area, we had to make this improvement to comply with what fire department’s requirements. We spent $37,119.33 for this improvement. Ref. 32 • Once we were ready to finish with the street improvements, we went back with engineering for an encroachment permit (3/11/21) (Ref. 33), Rove engineering was the contractor that did the street improvements (Ref. 34). Inspections for this work were made by Paul Gastelum from Sierra materials & testing (Ref. 35). The engineering department inspected the job which was paid from deposit for $1,016.00. Total spending in street improvement $ 47,666.5. • We worked in the grading, class II base installation, retention basins to start phase 1 as was originally agreed on plans. Here we spent more than 2 years working daily ourselvesin the property total spending for the materials and testing: $25,878. (Ref 36- 41). Once we had the new lot ready, with most of the improvements done, we move everything to the new location around May 2021.

Total spending for improvements: $110,664.82, not including man hours of all these years to make possible this project.
• As we returned to look for Ralph Morales, we noticed he retired, so we started to work with Christopher Velasco (6/17/21 to 8/12/21). He told me there was no documentation in the planning division, he asked me for documentation again to continue with the process, unfortunately he resigned his job before we could make any progress. Ref. 42-49 • Now from October-November 2021, we started to work with Lisa Tylenda, Miguel Figueroa, and chuck Cortez. As we were never given document specifying the agreement reached with David Dale and Ralph Morales, and since we always received a favorable response from Mr. Dale, including plans already signed and approved, we never thought we were going to be in the middle of this situation. Ref. 50
• A first inspection was done by Lisa and Chuck (11/8/21 -11/15/21), the intention was to see if I had the minimum requirements for temporary use and get a business license, so we can have the process of the street in the background while having the opportunity to operate, Lisa before this day told me that once the inspection was done, we will be signing a conditional permit that same day. During the inspection, inside in my home trailer, I had a pellet pistol gun, taser gun and a tree 3 machete-saw which I have next to my bed, chuck saw the pistol and said “ that is illegal”, after telling him that the pistol wasn’t a fire arm, just a pellet pistol of CO2 cartridges, he just said “ yeah, lets said is a pellet pistol” heading out of the room without confirming what he was stating about a real gun situation. I got multiple negative comments in general to my business and at the end, Lisa and Chuck went to the far side of the lot for a while and exited the lot afterthat. • The day after the inspection, Miguel Figueroa, started making an interrogatory, he said that in the inspection report, the inspector saw weapons, and the most important thing is that they saw birds protected by a federal migratory act and he was concerned about the fact that I was using these weapons to hunt these birds down. What worried me was the fact that the information passed from Mr. Cortez to Miguel Figueroa, was given without context, Cuauhtemoc never tried to do a minimum of investigation to report relevant and correct information, because of this I was subjected to a bad judgement. I started to explain my situation at that time to Miguel, in this new location, when I first got there, the place was in complete abandonment, for the first months before fencing out that place, every day I had interaction with at least 10 drug addicts going in and out inside my lots, once this addicts were under the influence they started to be aggressive and destructive, police came multiple times but same results, drug addicts returned days after they were removed, police officers explained me that there’s been a long history in this place of dead people by overdose, and by this time, I had been a victim multiple times of trespassing and theft, 2 cars had been stolen months before, and at nights I had multiple encounters with people inside my lot, trying to steal things from me. That was the reason for having 3 different types of weapons, to protect myself from thieves and dangerous people. My neighbor, Mr. Murga, can confirm my story with this drug addicts, the day I met him he was wearing his army suit, trying to intimidate them tired of the situation at that time (Ref. 51-56). After this explanation, Miguel Figueroa told me that everything was going to be paused because of the burrowing owls that Lisa and Chuck saw in my lot.
• Burrowing owl report- 12/15/21, after spending time investigating and with the help of a certified biologist, Marie Barrett, I realize this there was lack of knowledge by the inspectors, there was no physical evidence that the burrowing owls were occupying 100% a burrow in my lot, they mostly were sheltering. Lack of knowledge ended pausing for months my project, wasting time and money. Ref. 57-63
• The second inspection was done, verifying the burrowing owl issue. • Chuck Cortez gave us a letter, notice to abate and items to correct for conditional use permit process, 1/4/21, removal of fence and gate, gas station documentation, etc. We were told that we had to prove and do corrections in all the items in that document to continue with the process of a conditional permit. Mark Vazques in 2019 was the person that originally work on the documentation of the street abandonment, but no documentation was archived, engineering department had the permits for the work done for the street, still not all departments had that information. Ref. 64-65
• Demolition permit gas station 2/10/22. Ref. 66-67
• Lisa told us we can do ourselves the utilities jobs, water, and electrical improvements. • Uniform application forstreet abandonment and Topography documentation, Meets & Bounds and lot mergers by Dynamic consulting engineers, David Beltran- document for the street abandonment 4/13/22. Ref. 68-72
4 • Chuck Cortez: change the name to care-taker unit instead of office, to use the trailer as home. We will use a separate parking booth for the parking operation. • Waited for a close session from the city council, for approval. Elapsed time: approx. 5 months • 9/27/22 send Lisa Marco Parking Timeline document for fee waiver, e-mail. • 11/29/22 Fee waiver meeting- $9,000, No Fee Waiver granted. Esperanza Colio First Meeting (New City Manager).
• Meeting with Lisa, 12/12/22- inspection visit to site scheduled to next day, to see if we somehow can get a conditional permit.
• Third inspection was conducted in 12/13/22, until this third inspection now Cuauhtemoc is concerned about material used as top layer, saying is not base. The Engineering department has already conducted inspections in the past and we were already cleared of this subject (Ref. 73).

Previously, before getting our plans approved, IMPERIAL COUNTY AIR POLLUTION CONTROL DISCTRICT (ICAPCD), instructed me that complying with what the Rule 800 and 805, was good with them (Ref. 74-77), it’s clear that not having access to water, cause the base to get loose during all this time. Lisa told us that the process of the abandonment of the street will take 3-4 months, the city council so far has only given instructions to proceed with this process and all the funding is on us, approximately $8,500. If the Planning Commission doesn’t approve all the money is not refundable. Theres no way I can have a utilities service and no temporary use permit until we have the process of the street before.
• 12/15/22 Meeting with city manager, second meeting, no guarantee of an abandonment of street, Mrs. Colio says we may have an opportunity on the planning commission to approve the street abandonment, but there’s no 100% guarantee.
• City Council meeting: 12/21/22, 3 minutes with city council members, presented our project in a short format.
• Reimbursement check received 12/23/22- - total: $7356.48. from the original deposit made when I got my plans approved, I got the money back to make a deposit later for the abandonment process.

Ref. 78-83
• Payment done, $13,772.28 to start with the process of street abandonment 1/3/23, 3–4-month process, wait for planning commission hearing and city council hearing. Ref. 84 • Lisa Tylenda sets dates for planning and city council hearings, planning commission on 3/27/23 and city council hearing on 4/5/23. Both hearings got cancelled eventually. • Lisa Tylenda resigned her position in Calexico.
• Kevin Grant- started working at Calexico in Planning. • Kevin Grant- planning commission, favorable recommendation towards our project. 5/30/23 Ref. 85 • Kevin Grant- resigned his position in Calexico.
• Pending city council hearing – 7/24/23

Dear Ralph Morales:

By this present letter I am requesting your support in my business. Marco Parking is being in business since 2003 currently located at 500 Cesar Chavez in Calexico, CA. Right now this business is operating with many limitations due to the fact of the new Port of entry at Rio Nuevo due to the great reduction of parking lot due to the expansion of the boulevard; it will not be possible for us to continue operating in this location this expansion makes it difficult for us to access a truck with hauling, as well as limiting our working hours for construction works, severely impacting business income.

Because of this, I feel the need to find a new space to continue with my business. We have the opportunity to acquire two land located at 149 w 6th and 144 W 6th through a financial. For which I request your support to unite the two lands. Uniting the two lands provides a useful utility for the business, the flow of vehicles would be better and mainly for security reasons, because it could have greater control to be able to close all access with a single fence.

Waiting for a favorable response and thanking your attention and support.

Thank you,
MARCO MADRIGAL L.

I PROJECT DESCRIPTION AND BIOLOGICAL REQUIREMENTS
Marco Parking, 149 W Sixth Street, Calexico CA. 92231 is deaning their lot for future construction. In the process, burrowing owls (BUOW) were observed sheltering in the concrete piles that were to be moved. Map attached.

I SITT SURVEY
On December 7, 2021 a survey was condocted by Marie Barren biologist. No BUOW or BUOW signs (whitewash, pellets, feathers, prey remnants) were observed in the concrete pile. As BUOWs might be using concrete piles as a shelter area, biologist recommended that the removal area be monitored.

I CONSTRUCTION ACTIVITIES
On December 15, 2021, removal of the concrete piles was begun and monitored by biologist, Marie Barren. Conditions on site: 46°F; clear skies and 4 mph wind.

No BUOW were observed at 7 AM prior to start of concrete removal activities or during removal. Area was monitored tl!ltil concrete piles were either removed or flattened so that the area was not attractive to BUOW.
