SUBJECT: Temporary Encroachment Permit Request for the Installation of a "V" shaped sign located at the intersection of Cole Boulevard and ML King Avenue
BACKGROUND:
On August 24, 2020. the City of Calexico Development Services Department approved a temporary encroachment permit for the installation of a "V" shaped sign measuring approximately 8 feet long by 7 feet high located on the City of Calexico right-of-way at the intersection of Cole Boulevard and M L King Avenue. The temporary encroachment permit issued by the Engineering Department explicitly describes the work as "Temporary Fixed Sign" to be removed per City Notice/Request." The permit application was signed by Mr. Jose L. Yepez, Jr. and dated August 18, 2020. The subject sign was then removed by the Imperial Irrigation District (ID, however, no notice for the sign's removal from the IID was given to the City.
The Applicant submitted request to the City Council for a second temporary encroachment permit to reconstruct the proposed sign. The request was presented to the City Council during a regularly scheduled City Council meeting on May 3, 2023, where staff received instruction from Council to bring back the item at a later date for a ruling. Further instruction was also given to analyze potential updates to the City of Calexico Code of Ordinances to facilitate the development of signs for commercial business in the City.
RECOMMENDATION:
The purpose of this item is to present the Applicants request for a temporary encroachment permit to reconstruct the proposed signage to the City Council. As instructed by the City Council, the City of Calexico City Council Meeting

Should the City Council deem the request to be in conformance with the goals and policies of the City of Calexico, a temporary encroachment permit may be issued for a timeframe of six months or any other period of time or conditions the Council may deem appropriate.
Upon reviewing all relevant information and hearing all comments for and against the request, city staff recommends that the City Council consider the following action:
1. Provide instruction to staff to proceed with the issuance of a temporary encroachment permit for a 6-month timeframe, or any other period of time or conditions the Council may deem appropriate, for the installation of "V" shaped sign measuring approximately 8 feet long by 7 feet high located at the intersection of Cole Boulevard and ML King Avenue.
DISCUSSION AND ANALYSIS:
Temporary Encroachment Permit. Should the City Council find the request to be compliant with the goals and policies of the General Plan, a temporary encroachment permit may be issued by the City Council for a time frame of 6 months or any other period of time the Council may deem appropriate. Additional condition may be added or removed as deemed necessary by Council.
If a temporary encroachment permit were to be issued, it would give the City time to analyze possible options for potential updates to the City of Calexico Code of Ordinances to facilitate the development of the proposed sign as well as other signage for residential businesses in the City of Calexico. Once an analysis has been completed, the findings will be presented to the City Council during a regularly scheduled meeting for their review and consideration.
FISCAL IMPACT
Should a temporary encroachment permit be issued, the proceeds gained from the permit application will go to the City of Calexico.
