RECOMMENDATION:
Adopt a resolution approving and authorizing the recording of a right of way deed dedicating a right of way from the Remington Development Project along McKinley Street to the City of Calexico for public use and finding the action exempt from CEQA.
BACKGROUND:
The Remington Development Project is a multi-family residential development carried out by Chelsea Investment Corporation which consists of the development of five separate lots totaling approximately 19 acres. Phase one consists of the development of three new residential buildings totaling 180 new 100% affordable residential units on lots one through three. The remaining two lots will consist of a retention basin and condominiums. Phase one of the project is currently under construction. Per the conditions of approval for the tentative subdivision map approved by the City Council on February 16, 2022, the applicant is required to provide improvement plans for roadway and utility improvements which will then be dedicated to the City of Calexico. While the final subdivision map has already been approved and recorded, in furtherance of the conditions of approval, the applicant submitted a right-of-way deed for the required dedication for City Council approval.
The purpose of this item is to present the right of way deed attached to this staff report as Exhibit A to the City Council so that they may motion to either approve the right of way deed for recording or not approve the right of way deed for recording.
DISCUSSION AND ANALYSIS:
The item was presented to the City Council during a public hearing held on February 16, 2022, where upon reviewing all pertinent documents and considering public comments, the City Council adopted a resolution approving a vesting tentative map, planned unit development, updated mitigated negative declaration, and conditions of approval for the Remington Apartment Project. As part of the conditions of approval, the applicant is required to provide improvement plans for roadway and utility improvements which will then be dedicated to the City of Calexico. The right of way deed attached to this staff report as Exhibit A was prepared and submitted by the applicant to comply with the adopted conditions of approval. Upon submittal, the right of way deed was forwarded to the City Engineering Department for review. After reviewing the submitted documents, the Engineering Department stated that they had no comments nor objections for the right of way deed.
