REVIEWED BY: Sandra L. Fonseca, Interim Finance Director PREPARED BY: Lilliana Falomir, Public Works Manager - Administrative Telen SUBJECT: Authorize Acting City Manager to Sign Agreement of Professional Services between the City of Calexico and LEE & RO, Inc. in the Amount of $282,814.00 for Engineering Design Services for Chlorine Conversion Project - Gaseous Chlorine Feed System to Liquid Hypochlorite Feed System at Water Treatment Plant and Eastside Water Reservoir. ========================================≤===
Recommendation:

Authorize Acting City Manager to Sign Agreement of Professional Services between the City of Calexico and LEE & RO, Inc. in the Amount of $282,814.00 for Engineering Design Services for Chlorine Conversion Project - Gaseous Chlorine Feed System to Liquid Hypochlorite Feed System at Water Treatment Plant and Eastside Water Reservoir.

Background:

On March 28, 2024, the City of Calexico Public Works Department began requesting proposals from qualified engineering professionals to provide engineering design services for Chlorine Conversion Project - Gaseous Chlorine Feed System to Liquid Hypochlorite Feed System. The City proposes to convert from a gaseous chorine system to a 12.5% bulk sodium hypochlorite disinfection system.

The City owns and operates a Water Treatment Plant ("WTP") and Eastside Water Reservoir ("EWR"). The WTP receives its water supply from the Colorado River through the Imperial Irrigation District's ("|ID") canal. The City's WTP has a design capacity of 14 Million Gallon per Day ("MGD"), with an average daily demand of 9 MGD and current peak flow of 7-8 MGD. The EWR has a design capacity of 6 MGD, with an average daily demand of 1.25 MGD. Both the WTP and EWR currently operate on gaseous chlorine water disinfection system to disinfect the water prior to discharging it into the City's supply lines. The City has concerns regarding the usage of chlorine gas as a disinfectant, as chlorine gas is toxic and poses dangers to the public and operations staff. The WTP is located adjacent to residential and commercial areas, schools and the Calexico International Border and the EWR is located adjacent to residential area. Both facilities pose a significant high risk of chlorine gas exposure to the public.

Since FY2018-2019, the City has been budgeting Water Enterprise funds for this project. City staff has done its absolute best to provide maintenance to both facilities but now the chlorine facilities are out of date and are not in compliance. In addition, it has been exceedingly difficult to find replacement parts and/or vendors who will come to service and repair the chlorine systems because both facilities pose a considerable risk for potential liability. As of today, the City of Calexico is the only City in the Imperial Valley that has not made the switch from gaseous chlorine to liquid hypochlorite.

With the conversion of Gaseous Chlorine Feed System to Liquid Hypochlorite Feed System the City with have a cost savings on the following operation and maintenance:
• Certified Unified Program Agency (CUPA) Annual Permit ($5,000 per year) • CUPA California Accidental Release Prevention Program ($18,000 every 5 years) • Annual Chlorine System Maintenance at WTP and EWR ($50,000 per year) • Annual Quantitative Fit Testing ($1,800 per year)
• Replacement of Scrubbers at WTP and EWR ($152,000 every 10 years) Discussion and Analysis:

On April 18, 2024, the Office of the City Clerk received one (1) proposal from the following company:

Company Amount
LEE & RO, Inc. $282,814.00
City staff has reviewed LEE & RO, Inc. proposal and recommends that the City Council of the City of Calexico authorize the City Manager to sign Agreement of Professional Services between the City of Calexico and LEE & RO, Inc. in the amount of $282,814.00 for Engineering Design Services for Chlorine Conversion Project - Gaseous Chlorine Feed System to Liquid Hypochlorite Feed System at Water Treatment Plant and Eastside Water Reservoir.

Consultant agrees to indemnify, including the cost to defend, the City, and its officers, agents and employees from any and all claims, demands, costs or liability that arise out of, or pertain to, or relate to the negligence, recklessness, or willful misconduct of Consultant and its agents in the performance of services under this contract. This indemnity does not apply to liability for damages for death or bodily injury to persons, injury to property, or other loss, damage or expense arising from the sole negligence, willful misconduct or defects in design by the City or its agents, servants, or independent contractors who are directly responsible to the City, or the active negligence of the City. 2 To the fullest extent permitted by law, the Consultant shall (1) immediately defend and (2) indemnify the City, and its councilmembers, officers, agents, and employees from and against all liabilities regardless of nature or type that arise out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of the Consultant, or its employees, agents, or subcontractors. Liabilities subject to the duties to defend and indemnify include, without limitation, all claims, losses, damages, penalties, fines, and judgments; associated investigation and administrative expenses; defense costs, including but not limited to reasonable attorneys' fees; court costs; and costs of alternative dispute resolution. The Consultant's obligation to indemnify applies unless it is finally adjudicated that the liability was caused by the sole active negligence or sole willful misconduct of an indemnified party. If it is finally adjudicated that liability is caused by the comparative active negligence or willful misconduct of an indemnified party, then Consultant's indemnification obligation shall be reduced in proportion to the established comparative liability.
(b) The duty to defend is a separate and distinct obligation from Consultant's duty to indemnify. Consultant shall be obligated to defend, in all legal, equitable, administrative, or special proceedings, with counsel approved by the City, the City and its councilmembers, officers, agents, and employees, immediately upon tender to Consultant of the claim in any form or at any stage of an action or proceeding, whether or not liability is established. An allegation or determination that persons other than Consultant are responsible for the claim does not relieve Consultant from its separate and distinct obligation to defend under this section. The obligation to defend extends through final judgment, including exhaustion of any appeals. The defense obligation includes an obligation to provide independent defense counsel if Consultant asserts that liability is caused in whole or in part by the negligence or willful misconduct of the indemnified party. If it is finally adjudicated that liability was caused by the comparative active negligence or willful misconduct of an indemnified party, Consultant may submit a claim to the City for reimbursement of reasonable attorneys' fees and defense costs in proportion to the established comparative liability of the indemnified party. (c) The review, acceptance or approval of the City's work or work product by any indemnified party shall not affect, relieve or reduce the City's indemnification or defense obligations. This Section survives completion of the services or the termination of this contract. The provisions of this Section are not limited by and do not affect the provisions of this contract relating to insurance.

10. Insurance Requirements.

3. PROJECT UNDERSTANDING AND APPROACH
PROJECT UNDERSTANDING capacity of 14 MGD, as well as to provide redundancy, LEE + RO recommends two (2) double wall type, 4,000-gal capacity The City of Calexico (City) owns and operates a Water Treatment storage tanks for a total storage volume of 8,000 gals.

Plant (WTP) and the Eastside Water Reservoir (EWR). The WTP receives its water supply from the Colorado River through the Eastside Water Reservoir Imperial Irrigation District's (ID) canals. The City's WTP has a For the EWR, LEE + RO's approach for the storage of the bulk design capacity of 14 million gallons per day (MGD), with an sodium hypochlorite will also be based on a minimum of 14 days average daily demand of 9 MGD and current peak flows of 7-8 of on-site storage. At the EWR site, the sodium hypochlorite will MGD. The EWR has a design capacity of 6 MGD, with an average be injected at three application points - the reservoir inlet, the daily demand of 1.25 MGD. The WTP and EWR both currently reservoir outlet, and the recirculation pipe. Based on discussions operate a gaseous chlorine water disinfection system to disinfect with City personnel, the target chlorine residual level is 0.4 the water prior to discharging it into the City's supply lines. The mg/L, as the purpose for adding chlorine at the EWR is to boost City has expressed concern regarding the usage of chlorine gas chlorine residual levels prior to distribution. At the design flow of as a disinfectant, as chlorine gas is toxic and poses dangers 6 MGD, two (2) double wall type, 250-gal capacity storage tanks to the public and operations staff. Since the WTP is located are sufficient to meet the target chlorine residual level. adjacent to residential areas, the risk of chlorine gas exposure to the public is greatly increased in the unlikely event of a The most common tank materials used for sodium hypochlorite large leak. LEE + RO's understanding is that the City desires to storage are fiberglass reinforced plastic (FRP), high density convert from a gaseous chlorine system to a 12.5% bulk sodium linear polyethylene (HDLPE), or high-density cross-linked hypochlorite disinfection system. polyethylene (HDXLPE). We recommend a HDLPE tank because (1) it is more economical than a FRP tank, and (2) no cracking issues from UV radiation due to an indoor installation. These Technical Approach will be further evaluated and presented in the Feasibility Study/ Preliminary Design Report.

In this section we discuss our approach to implementing the desired improvements. A summary matrix of the preliminary Chemical Pumps design criteria that is described in more detail in this approach is LEE + RO recommends peristaltic pumps for hypochlorite included as Exhibit 3-1 on the following page. injection to a pre-clarifier, a pre-filter, and a clearwell at the WTP, and for injection to the reservoir inlet, outlet, and recirculation

Peristaltic pumps are compact in size, have low capital costs, have a high turndown ratio, and are relatively Water Treatment Plant easy to maintain. There are fewer components (e.g. tubing) LEE + RO's approach for storage of the bulk sodium hypochlorite in contact with the chemical. They come with leak detection at the WTP will be based on a minimum of 14 days of on-site for tubing failures, and they do not experience pump priming storage. Based on discussions with City WTP Operations issues. Their disadvantages include a limited discharge pressure staff, the WTP's summertime maximum chlorine consumption (less than 125 psi or 290 feet of head), the feed rate slowly is currently 260 pounds per day (Ibs/day). Each pound of diminishes over time due to degradation of the tubing, and chlorine gas is equivalent to one gallon (gal) of 12.5% sodium the tubing must be replaced at regular intervals to prevent hypochlorite solution, so the equivalent 12.5% sodium failure. The recommended peristaltic pump is equipped with a hypochlorite solution would be 260 gals/day. As such, at a peak tube replacement alarm function, which will alarm and notify flow of approximately 7-8 MGD, the WTP would consume 260 O&M staff to replace the tube before it fails. Additionally, gals/day of sodium hypochlorite, so one (1) 4,000-gal capacity our preliminary evaluation indicates that total dynamic head storage tank will provide sufficient storage (260 gals/day x 14 losses at injection points are not significantly high, and the days is 3,640 gals). However, to accommodate the full design recommended peristaltic pumps can be used.

Chlorine Conversion Project - Gaseous Chlorine Feed System To Liquid Hypochlorite Feed System Piping and valves
Chemically compatible materials, such as polyethylene (PE) tubing or PVC, should be used in sodium hypochlorite applications.

Inside the chemical building, the chemical piping will be rigid PVC between the pump and storage tank, whereas flexible PE tubing will be used between the pump discharge and the injection points at WTP and EWR. Piping located outside of the chemical building containment area should be double-walled. Exposed plastic piping located outside of the building, including double-walled containment piping shall be CPVC, which exhibits better UV resistance than PVC. All buried plastic piping will be PVC. For the hypochlorite system, we recommend using PVC vented ball valves to vent any off-gasses and prevent the valve from exploding.

A - Sample Proposal Evaluation Form

The City of Calexico ("City") is requesting proposals from qualified engineering professionals to provide engineering design services for Chlorine Conversion Project - Gaseous Chlorine Feed System to Liquid Hypochlorite Feed System. The City proposes to convert from a gaseous chorine system to a 12.5% bulk sodium hypochlorite disinfection system.

The City owns and operates a Water Treatment Plant ("WTP") and Eastside Water Reservoir ("EWR"). The WTP receives its water supply from the Colorado River through the Imperial Irrigation District's ('IID") canal. The City's WTP has a design capacity of 14 Million Gallon per Day ("MGD"'), with an average daily demand of 9 MGD and current peak flow of 7-8 MGD. The WTP is located adjacent to residential and commercial areas, schools and the Calexico International Border and the EWR is located adjacent to residential arca. Both facilities pose a significant high risk of chlorine gas exposure to the public.

The contract will be regulated according to the provisions of all federal, state and local laws and ordinances that are applicable. This includes compliance with prevailing wage rates and their payment in accordance with California Labor Code, Section 1774. All Service Providers and sub- consultants) shall pay all workers not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by the Director of the Department of Industrial Relations, State of California, for the type of work performed and the locality in which the work is to be performed, pursuant to sections 1770 et seq. of the California Labor Code. Prevailing wage rates are available on the Internet at: http://www.dir.ca.gov. All Service Providers and sub-consultants) shall comply with the registration and qualification requirements pursuant to sections 1725.5 and 1771.1 of the California Labor Code.

To whom it may concern:

PureAir Filtration has alerted the City of Calexico that their emergency chlorine system is out of date and not compliant. The system is at full risk if there is a chlorine leak to not have the necessary coverage or safety precautions. This system has been out of date for a minimum of 2 years. The City of Calexico has been provided with lab results verifying that the system is out of compliance and additional quotes for replacement. PureAir Filtration cannot be held liable in the event of a chlorine gas leak. The release of chlorine gas can pose a risk to employees, the community, and/or the surrounding environment. Pure Air Filtration has fully passed on the potential liability and responsibility onto the City of Calexico, which includes the City of Calexico Water Treatment Plant.

RE: Conversion from Chlorine Gas to Liquid Chlorine
Dear Mr. Saldana:

As your Safety Consultant, I would like to thank you for inviting me to present this letter in support of the City of Calexico's intention to convert its current method of operation from a gaseous chlorine water disinfection system to a system that will use liquid chlorine instead. From a safety standpoint this is the best decision the City of Calexico could take considering the danger your current operation places over the surround community, businesses and our neighbor, the City of Mexicali.

As you know, chlorine gas was first used by French chemist Claude Berthollet to bleach textiles in 1785. Later on, it was pioneered by a German scientist later to be a Nobel laureate, Fritz Haber of the Kaiser Wilhelm Institute in Berlin, in collaboration with the German chemical conglomerate IG Farben, which developed methods for discharging chlorine gas against an entrenched enemy; yes, it was used rather effectively as an instrument of war because of the excellent tissue damage and kill rate that it produced in WWI. As history now shows, NONE of the First World War's combatants were prepared for the introduction of poison gas (chlorine gas) as a weapon. Yes, chlorine gas is extremely dangerous to human life and health.

Chlorine is a powerful irritant that can inflict damage to the eyes, nose, throat, and lungs. At high concentrations, such as the one you are currently using chlorine gas 100%, and prolonged exposure, it can cause death by asphyxiation. German chemical companies BASF, Hoeschst and Bayer (which formed the IG Farben conglomerate in 1925) made chlorine gas in cooperation with Fritz Haber and found a way to develop methods of discharging chlorine gas against enemy trenches.

Having said this, public safety is probably the primary reason for changing from chloring gas at 100% potency to the 12.5% potency of the liquid chlorine (sodium hypochlorite) disinfection system you propose to install. Another reason is that the equipment you are currently using is old and deteriorating rapidly. As is true with most cities that are still using this outdated system of disinfection, finding parts for the equipment currently in use is getting harder and harder to find. Often times, some Cities have to settle for spare parts that have been refurbished and may/may not be up to industry standards. Invariably, this opens the potential for equipment failure and potentially dangerous discharge. This is much like playing Russian Roulet with your employees and the surrounding community's safety. You currently have approximately ten, 1-ton cylinders of chlorine gas. You might be using four of these at any given time and have about two, 1-ton full cylinders as back up and about two, 1-ton cylinders that are empty. That is a lot of chlorine gas.

If you are having second thoughts about the conversion, simply answer the following questions.

1. Are you prepared for a catastrophic chlorine gas spill?

2. Does the City of Calexico have the technical and human resources to evacuate residents within a 3-mile radius from your plant?

3. Can the emergency evacuation take place within minutes of the spill?

4. If not, how will you handle the 9-1-1 calls for help against chlorine gas exposure?

5. Does the City of Calexico have the financial resources to handle liability claims that may arise after a spill?

6. Does the City of Calexico have the financial resources for the clean-up that has to take place after a spill?

7. How would the City of Calexico handle the release of 4 to 6 tons of chlorine gas towards our neighboring city, Mexicali?

As you can see, the information in each corresponding Safety Data Sheet clearly shows that Chlorine Gas is by far more dangerous than Sodium Hypochlorite 12.5%. Therefore, it makes a lot of sense that you are wanting to change from the gas ased disinfectant method to using the Sodium Hypochlorite 12.5% method. We commend you for wanting to make thi rogressive move as all Imperial Valley cities who have a water treatment plant have already made the conversion. The Cit It has been a pleasure writing this correspondence in support of a conversion. If I may answer any questions you may have, please feel free to call me at your convenience. Until then, I remain Respectfully yours,
