AGENDA STAFF REPORT

TO: Mayor and City Council
APPROVED BY: Juan Contreras, Acting City Manager JpL
PREPARED BY: Juan Contreras, Acting City Manager pe

SUBJECT: An Ordinance Amending Calexico Municipal Code Chapters 2.19, 2.27, 2.28,

2.31, and 2.56 Regarding General Commission Procedures, Community Service Commission, Planning Commission and Community Police Advisory, Traffic and Code Enforcement Commission, and Adding a Community Facilities District Commission.

Recommendation:

It is recommended that the City Council:

Review and conduct first reading by title only of Ordinance No. An Ordinance Amending Calexico Municipal Code Chapters 2.19, 2.27, 2.28, 2.31, and 2.56 Regarding General Commission Procedures, Community Service Commission, Planning Commission and Community Police Advisory, Traffic and Code Enforcement Commission, and Adding a Community Facilities District Commission.

Discussion:

The proposed Ordinance amends Chapter 2.19, which includes procedures for all city commissions, committees, and boards and also makes various amendments to certain City commissions and committees and adds a new Community Facilities District Commission.

California Government Code section 65100 establishes a Planning Agency within each city in the state to carry out the purposes of the Planning and Zoning Law (Gov. Code, §§ 6500-66342). The proposed Ordinance would establish the City Council as the City's Planning Agency, designating the City Council to act as the City's Planning Commission. As such, the Ordinance would establish the City Council as the reviewing body for all Planning Commission items and suspend processes where the Planning Commission plays an advisory role to the City Council.

Page 1 of 4 ends

Many projects require a recommendation by the Planning Commission to the City Council for project approval, necessitating two or more public hearings and one or more months between public hearings before final action on a project is taken by the City Council. Where a City Council acts as the Planning Commission, one additional layer of project review in the entitlement process would be eliminated, allowing projects to move forward in a more expeditious manner. Legislative acts and adoption of major planning and regulatory documents, such as the pending Housing Element and corresponding rezoning program, would also be able to be considered more expeditiously. City Council decisions on projects are also final, eliminating the time and costs associated with appealing Planning Commission decisions to the City Council. Preparing separate agendas, conducting meetings, and taking minutes for Planning Commission meetings also necessitates additional staffing and resources. Where the City Council acts as Planning Commission, limited Planning & Building Department staff would no longer need to dedicate a significant amount of time on preparing for and attending separate Planning Commission meetings and would be able to be redirected to areas where current deficiencies exist, such as providing more timely responses to citizen inquiries and requests on planning, building, and zoning matters. Past Planning Commission meetings have also frequently been cancelled, in some instances for not reaching a quorum due to member absences. With the City Council acting as the Planning Commission, project proponents would be able to prepare more predictable project timelines, as City Council meetings are regular.

Proposed Ordinance Revisions:

The proposed Ordinance amends Chapter 2.19 Eligibility and Procedures for Commissions, Boards and Committees, Chapter 2.27 Community Service Commission, Chapter 2.28 Planning Commission, and Chapter 2.56 Community Police Advisory Commission and repeals and replaces Chapter 2.31 by adding a Community Facilities District Commission.
