RECOMMENDATION
Approve a Resolution of the City Council of the City of Calexico approving the Memorandum of Understanding (MOU) between the Calexico Police Department (CPD) and the Whole Person Care Clinic Sobering Center (WPCC Sobering Center) to establish a collaborative program aimed at diverting individuals under the influence of alcohol or drugs from incarceration to appropriate care and treatment services.

BACKGROUND
The Calexico Police Department and the Whole Person Care Clinic Sobering Center have identified a shared goal of enhancing public safety and improving outcomes for individuals struggling with substance use. This partnership will provide a secure environment for individuals to sober up while receiving assessments and support services, reducing reliance on incarceration for non-criminal intoxication incidents.

This initiative aligns with broader efforts to promote public health, reduce recidivism, and create cost-effective solutions for addressing substance use in our community.

DISCUSSION
The proposed MOU outlines the roles and responsibilities of both parties in implementing this partnership. Key components include:

1. Referral Process: CPD officers will refer eligible individuals to the WPCC Sobering Center as an alternative to incarceration.

2. Transportation: CPD will arrange safe transport for referred individuals when necessary.

3. Supervised Care: WPCC Sobering Center will provide a safe environment for individuals to sober up, undergo assessments, and access referrals for further care.

4. Training: CPD officers will receive training in referral procedures.

5. Confidentiality: Both parties will adhere to all applicable privacy laws, including HIPAA.

This agreement also includes guidelines for eligibility, funding responsibilities, and dispute resolution mechanisms. The MOU will remain in effect for one year and may be renewed or modified by mutual agreement.

FISCAL IMPACT
The program will utilize existing CPD resources for transportation and referrals. The WPCC Sobering Center will fund its services through its operational budget, ensuring no additional financial burden on the city.

CONCLUSION
Approving this MOU will strengthen the city's efforts to address substance use issues while promoting public safety and improving the overall well-being of affected individuals.
